A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE JOINT INSTALLATION
OF FLASHING LIGHT SIGNALS AT BROADWAY CROSSING
NO. BK- 509.1, ANAHEIM: PROVIDING FOR THE
PAYMENT OF A PORTION OF THE COST THEREOF BY
THE CITY; AND AUTHORIZING THE MAYOR AND CITY
CLERK TO ENTER INTO AN AGREEMENT WITH SOUTHERN
PACIFIC COMPANY.

WHEREAS, the Southern Pacific Company and the City of
Anaheim contemplate the joint installation of flashing light
signals at West Broadway, Crossing No. BK- 509.1, Anaheim,
Orange County, California; and
WHEREAS, Southern Pacific Company and the City of
Anaheim desire to enter into an agreement for the construction
and installation of said flashing light signals, and to provide
for the maintenance functions that are to be performed by the
Southern Pacific Company and the City, and to specify the pro-
portionate share of the costs that are to be borne by the City
and Southern Pacific Company, as more particularly set forth
in the form of agreement submitted to the City by Southern
Pacific Company.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the agreement this day submitted to
the City Council by the Southern Pacific Company, to be made
and entered into by and between said Company and the City, for
the joint installation of said flashing light signals at West
Broadway, Crossing No. BK- 509.1, Anaheim, Orange County,
California, the terms and conditions of which agreement are as
hereinafter set forth, be, and the same is hereby approved and
accepted. That the terms and conditions of said agreement are
as follows:
1. Southern Pacific Company shall furnish all neces-
sary labor, materials, tools and equipment to install and shall
install four (4) flashing light grade crossing signals, together
with actuating and operating circuits and adequate instrument
housing, at said crossing. Said signals shall be located
approximately as indicated in red on the print of Southern
Pacific Company's Los Angeles Division Drawing B -3721, Sheet
No. 2, dated November 2, 1962, attached to and made a part of
said agreement.
Such installation shall include the removal of
the existing Standard No. 1 crossing signs indicated in yellow
on said print above mentioned.
2. Installation of and all materials for said signals
shall be in accordance with Southern Pacific Company's usual
standards and in compliance with Standard No. 8 of General
Order No. 75B of the Public Utilities Commission of the State
of California.
3. The City of Anaheim shall reimburse said Southern
Pacific Company promptly upon receipt of bills therefor, for
fifty per cent (50 of all cost and expense incurred by said
Company in connection with the installation of said flashing
light signals and appurtenances and the removal of the existing
crossing signs.
4. The City, at City's expense, shall construct and
maintain the necessary traffic islands.
5. After the installation of said signals has been
completed, Southern Pacific Company shall maintain said signals
so long as the same may remain in place. The cost of main-
taining said crossing signals and appurtenances shall be
apportioned between the City and Southern Pacific Company as
may be prescribed by law or by agreement. In the event there
shall be no applicable law or agreement so apportioning such
cost by December 31, 1963, the City and Southern Pacific Company
shall submit the apportionment of such maintenance expense to
the decision of the Public Utilities Commission of the State of
California.
6. Installation of said signals, with division of
cost as outlined above, shall be undertaken as soon as labor
and materials are available following execution of said agree-
ment and shall be completed within one year thereafter.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 26th day of March, 1963.
