A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim has heretofore duly passed and adopted a resolution
recommending denial of a change in the boundaries of the zone
or zones hereinafter mentioned and described, after having
fixed a time and place for the holding of a public hearing
thereon in the manner and as prescribed in Title 18 of the
Anaheim Municipal Code, and after having duly held and conducted
such public hearing to consider said proposed change of zone
or zones, and after having received evidence and reports from
persons interested therein; and
WHEREAS, within a period of forty (40) days fallowing
the hearing thereon, the Planning Commission did duly announce
by formal resolution its. f findings of facts and declare its
opinions and reasons for recommending denial of said proposed
change in the boundaries of the zone or zones hereinafter
mentioned and described; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City Plan-
ning Commission, the City Council did fix the 16th day of
Jul y 19639 as the time, and the City raiREil Chambers
in he Ci ty HallTn the City of Anaheim as the place for a public
hearing upon said proposed amendment to Title 18 of the Anaheim
Municipal Code, and the exclusion of said property, hereinafter
described, from the zone in which it is now situated and the
incorporation thereof in the zones hereinafter set forth; and did
give notice thereof in the manner and form as provided in said
Title 18 of said Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such public
hearing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports and did there-
upon consider the summary of evidence presented at said public
hearing before the Planning Commission, its report of findings
and recommendations; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated,
and incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby amended, and that all of the property
and area situated in the City of Anaheim, County of Orange,
State of California, described as follows:
PARCEL 1:
That portion of lot 24 of Golden State Tract No. 2, in
the City of Anaheim, County of Orange, State of Califor-
nia, as per map recorded in Book 4, page 68 of Miscel-
laneous Maps, in the office of the County Recorder of
said County, described as follows:

Beginning at the southeast corner of said lot 24, said
point also being the center line intersection of East
La Palma Avenue and Acacia Street as shown on a map of
Tract No. 1364, recorded in Book 52, pages 42 and 43
of said Miscellaneous Maps; thence North 0 48' 10" West
105.00 feet along the East line of said lot 24; thence
West 155.00 feet parallel with the South line of said
lot 24, to the easterly line of said Tract No. 1364;
thence South 0 48' 10' East 105.00 feet along said
East line to said South line; thence East 155.00 feet
to the point of beginning.
Said land is included within the area shown on a map
filed in Book 34, page 42 of Record of Surveys, in the
office of the County Recorder ofsaid County.
PARCEL 2:
That portion of lot 24 of Golden State Tract No. 2,
in the City of Anaheim, County of Orange, State of
California, as per map recorded in Book 4, page 68 of
Miscellaneous Maps, in the office of the County Recorder
of said County, described as follows:
Beginning at a point on the easterly line of said lot 24
North 0 48' 10' West 165.00 feet from the southeast cor-
ner of said lot 24, said southeast corner also being the
center line intersection of East La Palma Avenue and
Acacia Street as shown on a map of Tract No. 1364, re-
corded in Book 52, pages 42 and 43 of said Miscellaneous
Maps; thence West 155.00 feet parallel with the South
line of said lot 24 to the East line of said Tract No.
1364; thence South 0 48' 10" East 60.00 feet along said
East line to a line parallel with and northerly 105.00
feet measured along said East line from the South line
of said lot 24; thence East 155.00 feet along said paral-
lel line, to the easterly line of said lot 24; thence
North 0 48' 10" West, 60.00 feet to the point of begin-
ning.
Said land is included within the area shown on a map
filed in Book 34, page 42 of Record of Surveys, in the
office of the County Recorder of said County.
PARCEL 3:
That portion of lot 24 of Golden State Tract No. 2, as
shown on a map thereof recorded in Book 4, page 68, Mis-
cellaneous Maps, records of said Orange County, described
as follows:
Beginning at a point on the Easterly line of said lot 24,
distant North 0 48' 10" West 165.00 feet from the South-
east corner of said lot 24, said Southeast corner also
being the center line intersection of East La Palma
Avenue and Acacia Street, as shown on a map of Tract No.
1364, recorded in Book 52, pages 42 and 43, Miscellaneous
Maps, records of said Orange County; thence West parallel
with the South line of said lot 24, a distance of 155.00
feet to the East line of said Tract No. 1364; thence
North 0 48' 10" West along said East line, 60.00 feet;
thence East parallel with said South line, 155.00 feet
to the Easterly line of said lot 24; thence South

0 48' 10" East along said East line 60.00 feet to the
point of beginning.
be excluded from R -1, ONE- FAMILY RESIDENTIAL ZONE and incorporated
in C -1, NEIGHBORHOOD- COMMERCIAL ZONE, upon the following conditions:
1. That the owners of subject property shall deed
to the City of Anaheim a strip of land 53 feet
in width, from the center line of the street,
along La Palma Avenue for street widening
purposes.
2. That the owners of subject property shall deed
to the City of Anaheim a strip of land 32 feet
in width, from the center line of the street,
along Acacia Street for street widening
purposes.
3. That the owners of subject property shall pay
to the City of Anaheim the sum of y $2.00 per
front foot, along Acacia Street and La Palma
Avenue for street lighting purposes.
4. That sidewalks and driveways shall be constructed
along La Palma Avenue and Acacia Street, as re-
quired by the City Engineer and in accordance
with standard plans and specifications on file
in the Office of the City Engineer, prior to
final building inspection.
5. That the owners of subject property shall deed
to the City of Anaheim a 3 -foot overhang ease-
ment along the westerly boundary of subject
property.
6. That trash storage areas shall be provided in
accordance with standard plans on file in the
Office of the Director of Public Works and Super-
intendent of Streets, prior to final building
inspection.
7. That 5 by 5 -foot tree wells shall be provided at
approximately 50 -foot intervals in the Acacia
Street and La Palma Avenue parkways abutting sub-
ject property; that plans for said tree wells and
the landscaping therein shall be submitted to and
approved by the Superintendent of Parkway Mainten-
ance; and that said tree wells shall be planted
prior to final building inspection.
8. That a 6 -foot masonry wall shall be constructed
along the west and north property lines, prior
to final building inspection.
9. That the owners of subject property shall place of
record City of Anaheim C -1 Deed Restrictions,
approved by the City Attorney, which restrictions
shall limit the C -1 uses of subject property to
business and professional offices, including a
pharmacy, the primary use of which shall be the
dispensing of drugs and medications with only in-
cidental sales of other merchandise.

10. That all air conditioning facilities shall be
contained within the building or shielded from
view.
11. That subject property shall be developed sub-
stantially in accordance with plans and specifi-
cations, as amended herein, on file with the City
of Anaheim, marked "Exhibits Nos. 1, 2, 3 and 4
provided, however, that a strip of land of a
minimum width of 6 -feet shall be landscaped and
said landscaping maintained abutting the La Palma
Avenue and Acacia Street rights of way; that plans
for said landscaping shall be submitted to and
approved by the Superintendent of Parkway Mainten-
ance; and that said landscaping shall be installed
prior to final building inspection.
12. That Conditions Nos. 1, 2, 3, 5 and 9 above
mentioned shall be complied with within a period
of 180 days from date hereof or such further time
as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and deter-
mined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 16th day of July, 1963.
