A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ACCEPTING A GRANT DEED CONVEYING TO THE
CITY OF ANAHEIM CERTAIN REAL PROPERTY FOR MUNI-
CIPAL PURPOSES.

WHEREAS, the City Council of the City of Anaheim did
heretofore, by resolution adopted on November 22, 1960, authorize
and direct the initiation of condemnation proceedings, which re-
sulted in the commencement of Orange County Superior Court Case
No. 94500, being entitled, "City of Anaheim vs. Morris A. Polin,
et al. and
WHEREAS, Henry Wagner and Emma C. Wagner, husband and
wife, two of the defendants to said litigation and owners of a
portion of the property sought to be condemned, offered to sell
and convey said property to the City of Anaheim for the sum of
$7,000.00; and
WHEREAS, the City Council finds and determines that said
offer is fair and reasonable and should be accepted and said sum
be paid to said defendants upon receipt of a good and sufficient
deed conveying said property to the City of Anaheim; and
WHEREAS, said defendants have this day submitted a form
of deed to the City Council to convey said real property to the
City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the grant deed submitted to the City
Council by Henry Wagner and Emma C. Wagner, husband and wife,
granting to the City of Anaheim the following described real prop-
erty situated in the City of Anaheim, County of Orange, State of
California, to wit:
All that portion of Lot A of Tract No. 97, in the City
of Anaheim, County of Orange, State of California, as
per map recorded in Book 11, Page 39 of Miscellaneous
Maps, in the Office of the County Recorder of said
County, described as follows:
Beginning at a point in the easterly line of Parry
Avenue, 115 feet southerly from the northwest corner
of said Lot A, and thence southerly along said easterly
line of Parry Avenue, 40 feet; thence easterly parallel
with the northerly line of said Tract, 135.32 feet;
thence northerly parallel with the easterly line of
Parry Avenue, 40 feet; thence westerly 135.32 feet to
the point of beginning.
be, and the same is hereby, accepted by the City Council of the
City of Anaheim.
BE IT FURTHER RESOLVED by the City Council of the City
of Anaheim that the Director of Finance be, and he is hereby,
authorized and directed to deliver to the City Attorney's office
the sum of $7,000.00 made payable to "Henry Wagner and Emma C.
Wagner, husband and wife and the City Attorney's office is
authorized and directed to deliver the said sum of $7,000.00 to
Henry Wagner and Emma C. Wagner when it holds a good and suffi-
cient deed from said Henry Wagner and Emma C. Wagner to the City
of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 16th day of July, 1963.
