RESOLUTION NO. 4254
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 860.
WHEREAS, the City Planning COmmission of the City of
Anaheim did receive a petition from the owner of certain real
property situated in the City of Anaheim, County of Orange, State
of California, described as follows:
Lot 1 of Tract No. 1460.
(Said property is located at 1215 North
Street, Anaheim, California.)
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim on November 4,
1957. notices of which said public hearing were duly given, as
required by law and the provisions of Section 9200.17 of the Anaheim
Municipal COde; and
WHEREAS, said City Planning Commission, after due inspec-
tion, investigation and studies made by itself and in its behalf.
and after due consideration of all evidence and reports offered at
said hearing, did adopt Resolution No. 106 -- Series 1957-58, recom-
mending that Variance No. 860 be denied; and
WHEREAS, thereafter, within twenty (20) days from the date
of the adoption of said resolution a written appeal Was filed with
the City Council of the City of Anaheim protesting the action of the
City Planning Commission denying said variance, and said appeal was
set for public hearing on the 3rd day of December, 1957, at 7:00
olclock P.M., in the City Hall in the Oity of Anaheim, and notice
of such public hearing Was duly given as required by law and the
prOVisions of Section 9200.17 of the Anaheim Municipal COde; and
WHEREAS, at the time and place fixed for said pUblic
hearing, the City Council did duly hold and conduct such pUblic
hearing and did give all persons interested therein an opportunity
to be heard; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council does
find that:
1. There is no substantial property right
possessed by other property in the same
vicinity and zone and denied the subject
property.
2. It appears that the sub ject property can
be adequately developed and used under
the present zone.
NOW, THEREFORE, BE IT RESOLVED by the City Counoil of the
City of Anaheim that the action of the City Planning Commission
denying Variance No. 860 requesting permission to erect a 4-unit,
single-story apartment house on the property hereinabove desoribed,
be and the same is hereby sustained, and that Variance No. 860 be,
and the same is hereby denied.

THE FOREGOING RESOLUTION is approved and signed by me
this 3rd day of December, 1957.
