RESOLUTION NO. 4253 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS N!CES'SARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOOLD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the 'City Planning Commission of the City ot Ana- heia has heretofore duly passed and adopted a resolution declaring its intenUon to chang. the boundaries of the zone or zones herein.. arter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and al prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports trom persons Int.rested therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by for.al resolution its findings of facts and declare its opinions and rea.ons for recommending an amendment to said Article IX, Chapter 2 ot the Anaheim Municipal Code to effect the proposed chang.. in the boundaries of the zone hereinafter mentioned and described, and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the ~day of De~er , 19 57 , as the Ume and the Councl1 ~in the Chy Hill of the city of Anahelm as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said pUblic hear- ing, the City Council did duly hold and conduct such public hearing and did give all per.ons interested therein an opportunity to be heard and did receive evidence and report., and did thereupon con- sider the recommendations of the City Planning Commission, and WHER!A.S, the City Council does find and determine that the prop.rty and area proposed to be changed trom the Ion. in which It i. now tltuated to a dltferent zone, a. hereinatter s.t torth, il more luitable for the zone or zonel to whioh It il propos.d to Change .aid property and area and that the inclulion ot laid prop.rty and ar.a In such n.w zone or zones will lnereas. the value ot .aid prop.rty and ar.a and will not depreciate the valu'l ot property in adjoining zones. That the owner of subject propert~ place of reoord standard City of Anaheim 0-1 Deed Restriotions, approved by the City Attorney. 2. That all engineering requirements of the City of Anaheim, such as street lights, ourbs and gutters, sidewalks, street grading and paving, drainage facilities or other pertinent work be complied with as required by the City Engineer. 3, Said change of zone shall not become effective unless within sixty days, or such further time as the Council may grant, the restrictions herein required to be imposed upon the property shall have been executed by the owners of the property, submitted to the City for approval and filed of record. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City . Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper, THE FOREGOING RESOLUTION is approved and signed by me this 1rd day of Deaember ,19 ~7 .
