A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 425
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a Conditional Use Permit from
D. H. ABLES and EUNICE M. ABLES, 34865 Acacia, Yucaipa, Califor-
nia, permitting the construction of a drive through restaurant
and a waiver of the minimum parking space requirements on the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
Beginning at the intersection of the North line
of Lot 4, in said Block 12, extended Westerly
along the center line of Garden Grove Road, in
the City of Anaheim, as shown on said map;
thence Easterly along said Westerly extension
and the North line of Lot 4, 210 feet; thence
South, parallel to the center line of Garden
Grove Road, 162 feet; thence West, parallel
to the North line of said Lot 4, and its
Westerly extension, 210 feet to a point in the
center line of Garden Grove Road; thence, North
along said center line, 162 feet to the point
of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on May 27 ,19 63 notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. 782 Series 1962 -63
denying Conditional Use Permit No. 425
and
WHEREAS, thereafter, within twenty -two days from the
date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action of the City
Planning Commission in denying said Conditional Use
Permit and did thereupon fix the 25th day of June
19 63 as the time and the Council Chamber in the City Hall

of the City of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 425 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion denying Conditional Use Permit No. 425 be, and the
same is hereby sustained and that the request of D. H.
ABLES and EUNICE M. ABLES for a Conditional Use Permit to con-
struct a drive through restaurant, and permitting a waiver of
the minimum parking space requirements on the property herein
before described, be and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 25th day of June 19 63

the City Council of the City of Anaheim, held on the 25th day of
June, 1963, by the following vote of the members thereof:

ABSENT: COUNCILMEN: None
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said Resolution No. 63R -556 on the
25th day of June, 1963.
