A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING A VARIANCE. (NO. 811).

WHEREAS, the City Planning Commission of the City of Ana-
heim did receive a petition from the property owner___ ...J..
of certain real property situated in the City of
Anaheim, County of Orange, State of California, described as follows:
That portion of the Southeast quarter of the Southwest quarter of
Seotion 7, in Township 4 South, Range 10 West, in the Ranoho Los
Coyotes, as shown on a map thereof recorded in-Book 51, Page 10,
Klacellaneous Maps, records of Orange County, California, desoribed
as follows:
Beginning at a point in the South line Of said Southeast quarter,
distant thereon South 880 581 West 212.10 feet from the Southeast
corner of the West half of the East 20.00 acres of the Southeast
quarter of the Southwest quarter of said Section 7, and running
thence North 00 481 10. West 627.91 feet; thence South 880 59' West,
69.37 feet; thence South 00 48' 10" East 627.91 feet, more or less,
to & point in the South line of said Southeast quarter of the Sout~
west quarter; thence North 880 581 East along said South line, 69.37
feet ~o the point of beginning.
AND WHEREAS, the City Planning Commission did hold a pub-
lic hearing at the City Hall in the City of Anaheim upon said peti-
tion on October 21. 1957 , notices of which said public
hearings were duly given as required by law and the provisions of
Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, investiga-
tion and studies made by itself and in its behalf and after due
consideration of all evidence and reports offered at said hearing,
did adopt its Resolution No. ~Q ,recommending to the City Coun-
cil of the City of Anaheim that ariance No. 811 be granted upon
the conditions stated in said resolution; and
WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.

3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that a conditional zoning variance be, and the
same is hereby granted to JERRY VICTOR MALER, CLARA MALHER, and
ISIDORO MALHER, 2437 West Lincoln Avenue, Anaheim, California, to
oonstruct a JG-Unit Motel on the property hereinabove described,
subject to the follOWing conditions:

1. That said motel be oonstructed in accordance with the
new detailed plans presented to the City Council and on
file with the City of Anaheim.
2. That that property on the west of the hereinabove de.
scribed property, owned by said applioants, and more
partioularly described as follows:
The North 1;0 feet of the West 47 feet of the
following described property:
That portion of the Southeast quarter af the
Southwest quarter of Seotion 7, in Township 4

County, California, described as follows:
Beginning at a point in the South line of said
Southeast quarter, distant thereon South 880 58'
West 212.10 feet from the Southeast corner of
the West half of the East 20.00 acres of the
Southeast quarter of the Southwest quarter of
said Section 7, and running thence North 00 48'
10" West 627.91 feet; thence South 880 59' West,
116.37 feet; thence South 00 48' 10" East 627.91
feet, more or less, to a point in the South l1ne
of said Southeast quarter of the Southwest quarter;
thenoe North 880 58' East along said South line,
116.37 feet to the point of beginning,
be included in this varianoe and used tor parking purposes.
), That a 9Q-foot minimum building setback line be estab-
lished along Lincoln Avenue, from the oenter line ot the
street.
4. That a 6-foot solid fence be construoted along the east
property line; and that 6-foot louvers be installed on
the balconies for screening and to obstruot the view from
the seoond story units.
The City Oouncil hereby reserves the right to revoke such
variance permit for good cause or failure of said owners Or their
heirs, suceessors or assigns, to comply with the Anaheim Municipal
Code and regulations and the oonditions herein. Said varianoe is
granted for the term prescribed by the Anaheim Municipal Code unless
otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me this
26th day of November, 1957.
