RES-2024-128RESOLUTION NO.2024- 12 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING CERTAIN PROPERTIES ALONG MANCHESTER AVENUE TO BE "SURPLUS LAND" PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 54221(b)(1) WHEREAS, the Surplus Land Act, codified in California Government Code sections 54220, et seq. ("SLA"), defines "surplus land" as land owned in fee by any local agency for which the local agency's governing body takes formal action in a regular public meeting declaring that the land is surplus and is not necessary for the agency's use; and WHEREAS, the SLA requires the City of Anaheim ("City") to formally declare properties as "surplus land" or "exempt surplus land" prior to taking action to dispose of such properties; and WHEREAS, a declaration of "surplus land," and the issuing of notices of availability required by the SLA, is a process adopted in State law, with the intent of ensuring prioritization of affordable housing; and WHEREAS, as required by the Redevelopment Agency Dissolution Act, the Successor Agency to the Anaheim Redevelopment Agency ("Successor Agency") prepared and received approval for the California Department of Finance ("DOF") of a Long -Range Property Management Plan ("LRPMP") pursuant to Health and Safety Code Section 34191.1, which identified certain properties to be retained by the City "for future development" purposes; and WHEREAS, the City owns five (5) properties located on North Manchester Avenue, transferred from the Successor Agency pursuant to the LRPMP, that are not needed for the City's use ("Surplus Properties"), as set forth in Exhibit A to this Resolution, which is incorporated herein by this reference; and WHEREAS, this declaration of "surplus land" does not obligate the City to subsequently dispose of the Surplus Properties and the City may in the future determine that these properties are necessary for its use and not move forward with any disposition of any specific property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. Based on the above recitals and its independent review of Exhibit A, the City Council hereby declares the properties listed in Exhibit A to be Surplus Properties not necessary for the City's use. 2. The City Council finds and determines that this action results in no binding commitment to authorize or advance the disposition of any of the Surplus Properties; will not result in a direct or indirect physical change in the environment; and does not constitute an "approval" of a "project" pursuant to CEQA Guidelines Sections 15004 and 15352.
