99-180RESOLUTION N0. g9R_~~n A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE ANAHEIM GENERAL PLAN DESIGNATED AS AMENDMENT NO. 367, EXHIBIT "A." WHEREAS, the City of Anaheim, pursuant to the recommendations of the Planning Commission of the City of Anaheim, adopted a General Plan for the City of Anaheim; and WHEREAS, on the 19th day of July, 1999, the City Planning Commission of the City of Anaheim did hold a public hearing to consider a General Plan Amendment. The General Plan Amendment does consider changing the land use designation for the area of land consisting of approximately 1.5 acres located at the northeast corner of Lincoln Avenue and State College Boulevard and on the south side of Ward Terrace, and having frontages of 394 feet on the north side of Lincoln Avenue, 145 feet on the east side of State College Boulevard and 129 feet on the south side of Ward Terrace (128 South State College Boulevard, 2015- 2107 East Lincoln Avenue and 2104 Ward Terrace) from the Low Density Residential and Commercial Professional land use designation to the General Commercial land use designation; and that the certain real property in the City of Anaheim, County of Orange, State of California, is more particularly described as: LOT 8 OF TRACT NO. 1843, AS SHOWN ON A MAP RECORDED IN BOOK 53, PAGES 45 AND 46 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA PARCEL 1: THAT PORTION OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER AND THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 12, TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO SAN JUAN CAJON DE SANTA ANA, AS SHOWN ON A MAP RECORDED IN BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF LOT 13 OF TRACT NO 1843, AS SHOWN ON A MAP RECORDED IN BOOK 53, PAGES 45 AND 46 OF SAID MISCELLANEOUS MAPS; THENCE NORTH 89° 34' 07" WEST, ALONG THE SOUTH LINE OF SAID LOT 13 AND THE WESTERLY EXTENSION THEREOF, 150.00 FEET TO A POINT IN THE CENTERLINE OF PLACENTIA AVENUE, AS SHOWN ON THE CENTERLINE OF PLACENTIA AVENUE, AS SHOWN ON SAID MAP OF TRACT N0. 1843; THENCE SOUTH 0° 25' 53" WEST, ALONG SAID CENTERLINE OF PLACENTIA AVENUE, 195.19 FEET; THENCE SOUTH 0° 11' 45" WEST 4.25 FEET TO THE INTERSECTION OF THE CENTERLINES OF PLACENTIA AVENUE AND ANAHEIM- OLIVE ROAD, AS SHOWN ON SAID TRACT N0. 1843; THENCE SOUTH 78° 52' 26" EAST, ALONG SAID CENTERLINE OF ANAHEIM-OLIVE ROAD, 162.82 FEET TO THE INTERSECTION OF THE SOUTHERLY EXTENSION OF THE WEST LINE OF LOT 12 OF SAID TRACT NO. 1843' THENCE NORTHERLY ALONG SAID EXTENDED LINE AND THE WEST LINE OF SAID LOT 12 A DISTANCE OF 163.88 FEET TO THE NORTHWEST CORNER OF SAID LOT 12; THENCE NORTH 37° 53' 25" WEST 16.13 FEET; THENCE NORTH 0° 25' 53" EAST 53.12 FEET TO THE POINT OF BEGINNING. ALSO EXCEPTING THEREFROM THAT PORTION DESCRIBED IN DEED TO THE CITY OF ANAHEIM RECORDED AUGUST 24,M 1998 AS INSTRUMENT N0. 19980555467 OF SAID OFFICIAL RECORDS; and WHEREAS, at said public hearing, the City Planning Commission did duly adopt its Resolution No. PC 99-136 containing a report of its findings, a summary of the evidence presented at said hearing, and recommending that said Amendment to the General Plan designated as Amendment No. 367 be adopted by the City Council changing the land use designation for the aforedescribed area to "General Commercial" in accordance with Exhibit "A"; and WHEREAS, upon receipt of said Resolution, summary of evidence, report of findings and recommendations of the City Planning Commission, the City Council did fix the 17th day of August, 1999, as the time, and the City Council Chamber in the Civic Center as the place for a public hearing on said proposed Amendment No. 367 and did give notice thereof in the manner and as provided by law; and WHEREAS, the City Council such public hearing and did give all an opportunity to be heard, and did and did consider the recommendations Commission; and did duly hold and conduct persons interested therein receive evidence and reports of the City Planning -4- WHEREAS, the City Council does find and determine that Amendment No. 367 changing the land use designation in the aforedescribed area in accordance with Exhibit "A" on file with the City should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Amendment No. 367 to the General Plan changing the land use designation for the aforedescribed area to "General Commercial" in accordance with Exhibit "A" on file with the City be, and the same is hereby, approved. BE IT FURTHER RESOLVED that the Planning Department be, and it is hereby, instructed to amend the General Plan Map to conform to General Plan Amendment No. 367 as herein adopted and approved.
