A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Pro-
ceedings No. 63 -64 -27 to consider an amendment
to Title 18 of the Anaheim Municipal Code relating to zoning,
and to consider a change in the boundaries of the zone or
zones hereinafter mentioned and described, and at said hearing
did receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing thereon the Planning Commission did duly adopt a resolu-
tion containing a report of its findings, a summary of the
evidence presented at said hearing, and a recommendation that
the proposed amendment be adopted by the City Council and that
a certain zone or zones be changed as hereinafter set forth;
and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings, and recommendation of the City
Planning Commission the City Council did fix the th day
of November 19 63 as the time and the ity Council
Chambers in the City Hall of the City of Anaheim as the place
for a public hearing upon said proposed amendment to Title 18
of the Anaheim Municipal Code, and the exclusion of said prop-
erty, hereinafter described, from the zone or zones in which
it is now situated, and the incorporation thereof in the zone
or zones hereinafter set forth; and did give notice thereof
in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public
hearing, and did give all persons interested therein an oppor-
tunity to be heard, and did receive evidence and reports, and
did thereupon consider the summary of evidence presented at
said public hearing before the Planning Commission, its report
of findings, and recommendation; and
WHEREAS, the City Council does find and determine
that the amendment to Title 18 of the Anaheim Municipal Code
should be adopted and that the property hereinafter described
should be excluded from the zone or zones in which it is now
situated and incorporated in the zone or zones as hereinafter
set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Title 18 of the Anaheim Municipal
Code be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County of
Orange, State of California, to wit:

PORTION A"
The Southerly 390 feet of that portion of the South-
west quarter of the Southwest quarter of Section 8,
Township 1_i. South, Range 10 West, San Bernardino Base
Meridian, described as follows:
Beginning at the Northwest corner of Parcel 1 of
the deed to Charles J. Weber, et ux, recorded
December 1, 1928, in book 222, page 272, Official
Records, records of Orange County; thence South along
the West line of said Parcel 1, ?72 feet more or less,
to the South line of the Southwest quarter of the
Southwest quarter of said Section 8; thence West
along said South line 85 feet more or less to the South-
east corner of the land conveyed to Gustave Koenig
and wife, by deed recorded on June 6, 1930, in book
389, page 163, Official Records of said Orange County;
thence North along the East line of said land con-
veyed to Koenig and wife and its Northerly prolonga-
tion 772 feet more or less, to an intersection with
the Westerly prolongation of the North line of said
parcel 1 as described in said deed to Weber and wife;
thence East along said Westerly prolongation of said
North line 85 feet more or less, to the point of
beginning.
EXCEPTING THEREFROM the south 40 feet thereof (Lincoln
Ave.).
PORTION "B"
The Northerly 382 feet of that portion of the South-
west quarter of the Southwest quarter of Section 8,
Township L_ South, Range 10 West, S.B.B. M. des-
cribed as follows:
Beginning at the Northwest corner of Parcel 1 of the
deed to Charles J. Weber, et ux, recorded December 1,
1928, in book 222, page 272, Official Records, records
of Orange County; thence South along the West line
of said Parcel 1, 772 feet more or less, to the South
line of the Southwest quarter of the Southwest quarter
of said section 8; thence West along said South line
85 feet more or less to the Southeast corner of the
land conveyed to Gustave Koenig and wife, by deed
recorded on June 6, 1930, in book 389, page 163,
Official Records of said Orange County; thence North
along the East line of said land conveyed to Koenig
and wife and its Northerly prolongation 772 feet
more or less, to an intersection with the Westerly
prolongation of the North line of said parcel 1 as
described in said deed to Weber and wife; thence
West along said Westerly prolongation of said North
line 85 feet more or less, to the point of begin-
ning.
EXCEPTING THEREFROM the south L1.0 feet thereof (Lincoln
Ave.)
be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE and incorpora-
ted in the following zones, upon the conditions hereinafter set forth:
That Portion At of the property hereinabove described
shall be changed to C -1, NEIGHBORHOOD COMMERCIAL ZONE; and
That Portion "B" of the property hereinabove described
shall be changed to P -1, Automobile Parking Zone.

That said change of zones shall be made upon the
following conditions;
1. That sidewalks shall be installed along Lincoln
Avenue, as required by the City Engineer and in
accordance with standard plans and specifications
on file in the Office of the City Engineer, prior
to final building inspection.
2. That trash storage areas shall be provided in ac-
cordance with approved plans on file in the Office
of the Director of Public Works and Superintendent
of Streets, prior to final building inspection.
3. That the owner of subject property shall pay to
the City of Anaheim the sum of $2.00 per front
foot, along Lincoln Avenue for street lighting
purposes.
L. That the existing common driveway at the east end
of subject property shall be removed and replaced
with curb, gutter and sidewalk, prior to final
building inspection.
5. That subject property shall be developed substan-
tially in accordance with plans and specifications
on file with the City of Anaheim, marked "Exhi-
bits Nos. 1 and 2."
6. That a strip of land of a minimum width of six
feet adjacent to the Lincoln Avenue frontage shall
be landscaped and said landscaping maintained, as
indicated on Exhibit No. 1 on file with the City;
and that plans for said landscaping shall be submit-
ted to and approved by the Superintendent of Parkway
Maintenance; and that said landscaping shall be in-
stalled prior to final building inspection.
7. That tree wells shall be provided at approximately
)4.0 -foot intervals in the Lincoln Avenue parkway
abutting subject property; that plans for said
tree wells and the plantings therein shall be sub-
mitted to and approved by the Superintendent of
Parkway Maintenance; and that said tree wells shall
be planted with trees prior to final building in-
spection.
8. That a 6 -foot masonry wall shall be constructed
along the north and west property lines where sub-
ject property abuts single family residential
development, prior to final building inspection.
9. That a 2 -year bond, in an amount and form satis-
factory to the City of Anaheim, shall be posted
with the City to guarantee the installation of a
6 -foot masonry wall along the east property line.
10. That all air conditioning facilities shall be con-
tained within the building, or properly shielded
from view.
1 1 That Portion "B" of subject property shall be paved
with asphalt, as stipulated by the Petitioner, and
ATTEST:
that the proposed parking spaces shall be
striped in accordance with the minimum dimen-
sions design for off street parking approved
by the City of .Anaheim, which work shall be
completed prior to final building inspection.
12. That the owner of subject property shall place
of record City of Anaheim Deed Restrictions,
approved by the City Attorney, on Portion "B"
of subject property only, which restrictions
shall limit the use of Portion "B" to parking
purposes only.
13. That Conditions Nos. 3, 9 and 12 above mentioned
shall be complied with within a period of 180
days from date hereof, or such further time as
the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney
be, and he is hereby authorized and directed to prepare and
submit to the City Council an ordinance amending Title 18
of the Anaheim Municipal Code to accomplish the objects here-
in found and determined to be necessary and proper.
THE FOREGOING RESOLUTION is signed and approved
by me this 5th day of November, 1963.
