A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim has heretofore duly passed and adopted a resolution
recommending denial of a change in the boundaries of the zone
or zones hereinafter mentioned and described, after having
fixed a time and place for the holding of a public hearing
thereon in the manner and as prescribed in Title 18 of the
Anaheim Municipal Code, and after having duly held and conducted
such public hearing to consider said proposed change of zone
or zones, and after having received evidence and reports from
persons interested therein; and
WHEREAS, within a period of forty 0) days fallowing
the hearing thereon, the Planning Commission did duly
by formal resolution its.findings of facts and declare Its
opinions and reasons for recommending denial of said proposed
change in the boundaries of the zone or zones hereinafter
mentioned and described; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City Plan-
ning Commission, the City Council did fix the 1st day of
October 1963, as the time, and the City o� until Chambers
in the City HallTn the City of Anaheim as the place for a public
hearing upon said proposed amendment to Title 18 of the Anaheim
Municipal Code, and the exclusion of said property, hereinafter
described, from the zone in which it is now situated and the
incorporation thereof in the zones hereinafter set forth; and did
give notice thereof in the manner and form as provided in said
Title 18 of said Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such public
hearing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports and did there
upon consider the summary of evidence presented at said public
hearing before the Planning Commission, its report of findings
and recommendations; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated,
and incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby amended, and that all of the property
and area situated in the City of Anaheim, County of Orange,
State of California, described as follows:

PARCEL 1:
The easterly 152 feet of Lot 9 of the Golden State
Tract No. 2, as shown on a map recorded in Book 4,
page 68, Miscellaneous Maps, records of said Orange
County. The westerly line of said easterly 152
feet being parallel with and distant 152.00 feet
westerly of the easterly line of said Lot 9.
PARCEL 2:
Lot 10 of the Golden State Tract No. 2, as shown on
a map recorded in Book 4, page 68, Miscellaneous
Maps, records of said Orange County.
EXCEPTING THEREFROM that portion thereof which lies
northwesterly of the southeasterly line of a strip
of land 70 feet in width lying 39.5 feet southeasterly
and 30.5 feet northwesterly of the following described
line:
Beginning at a point in the West line of the North-
east quarter of Section 2, Township 4 South, Range
10 West, San Bernardino Base and Meridian (being
also the center line of Acacia Street) distant
thereon North 0 07' 05" East, 58T53 feet from
the center of said Section 2, and also distant
thereon South 0 07' 05" West, 1269.32 feet from
the North quarter corner of said Section 2; thence
North 72 54' 32" East, 30.38 feet to the beginning
of a tangent curve, concave Northwesterly and having
a radius of 1000 feet; thence Northeasterly along
said curve through a central angle of 28 24' 12"
an arc distance of 495.73 feet; thence tangent
to said curve, North 44 30' 20" East, 114.70 feet
to the beginning of a tangent curve, concave South-
easterly and having a radius of 1000 feet; thence
Easterly along said curve through a central angle
of 45 43' 46 an arc distance of 798.13 feet;
thence tangent to said curve, South 89 45' 54" East,
1398.41 feet to a point in the East line of said
Northeast quarter of Section 2 (being also the center
line of Cypress Street) distant thereon
South 0 00' 50" West, 619.28 feet from the North-
east corner thereof, and also distant thereon
North 0 00' 50" East, 2588.91 feet from the center
line intersections of said Acacia Street and Romneya
Drive as shown on a map of Tract No. 2913, recorded
in book 96, page 41, Miscellaneous Maps, records of
said Orange County.
PARCEL 3:
The Northerly 100 feet of Lot 14 of Golden State Tract
No. 2, as shown on a map recorded in Book 4, page 68,
Miscellaneous Maps, records of said Orange County.
EXCEPTING THEREFROM that portion conveyed to the State
of California by deed recorded January 15, 1957, in
book 3769, page 499, Official Records, described as
follows:

Beginning at a point on the Easterly line of said
Lot 14, distant south 0 02' 40" West 98.14 feet
from the Northeast corner of said Lot 14, thence
South 88 43' 05" West 48.20 feet to the Southerly
line of the Northerly 100 feet of said Lot 14;
thence South 89° 03' 32" East along said Southerly
line of the Easterly line of said Lot 14; thence
North 0 02' 40" East 1.87 feet to the point of
beginning.
PARCEL 4:
Lot 9 of the Golden State Tract No. 2, as shown on
a map recorded in Book 4, page 68, Miscellaneous
Maps, records of said Orange County.
EXCEPTING THEREFROM the easterly 152 feet, the
westerly line of said easterly 152 feet being
parallel with and distant 152.00 feet westerly
of the easterly line of said Lot 9.
be changed from M -1, LIGHT INDUSTRIAL ZONE to R -3, MULTIPLE
FAMILY RESIDENTIAL ZONE, WITH THE EXCEPTION OF PARCEL 1 of
subject property, which shall remain in the M -L, LIGHT-
INDUSTRIAL ZONE; and that said change of zone of PARCELS 2,
3 and 4 shall be made upon the following conditions:
1. That the final tract maps of the R -3 portion of
subject property (Parcels 2, 3 and 4) shall be
submitted to and approved by the City Council,
and then recorded in the Office of the Orange
County Recorder.
2. That the area along Baxter Street indicated on
the plans as "Not a Part," constitutes a lot
split; therefore, the additional dedication and
improvement of Baxter Street and Via Burton to
City standards shall be accomplished at the
time the existing buildings are relocated.
3. That the owner of subject property shall pay
to the City of Anaheim the sum of $25.00 per
dwelling unit, to be used for park and recreation
purposes, said amount to be paid at the time
the building permit is issued.
4. That trash storage areas shall be provided in
accordance with standard plans on file in the
Office of the Director of Public Works and
Superintendent of Streets prior to final
building inspection.
5. That the R -3, Multiple- Family Residential Zone
portion of subject property shall be developed
substantially in accordance with plans and
specifications on file with the City of Anaheim,
marked "Exhibit No. 1, Revision No. 1,'" and
Exhibits Nos. 2 through 10.

6. That the M -1, Light Industrial Zone portion of
subject property (Parcel 1) shall be developed
in accordance with Anaheim Municipal Code require-
ments, including the requirement that a building
setback area from the abutting residential zone
equal to the height of the wall or side of any
abutting structure be established, and that a
25 -foot building setback be provided along Baxter
Street and Via Burton in accordance with Section
18.52.060(2 -j) of said Code.
7. That a six -foot masonry wall shall be constructed
along the northerly and southerly boundaries of
subject property in addition to the point of
separation between the R -3 and M -1 Zones,
which wall shall be constructed prior to final
building inspection.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and
determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 29th day of October, 1963.
