WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application from ROF1ERT R. DOWLING,
15622 Placentia-Yorba Boulevard, Placentia, California, for a
Conditional Use Permit to construct a two-story, multiple-family
planned residential development, with carports, and permitting
a waiver of the one-story height limitation on the following
described property situated in the City of Anahe im, County of
Orange, State of California, tc wit:

the Kraemer Tract, as shown on a map recorded in Book 12,
pages 87 and 58 of Miscellaneous Records of Los Angeles
County, California, South 67 East. 1567. feet from
a stone at the Northwest corner of said Block G;

AND WHEREAS, the City Plannin Commission did hold
public hearing at the City Hall in the City of Anaheim upon
said application bn August 19, 196, notices of which said
public hearing were duly piven as required by law and the
provisions of Title la, Chapter 18.76 of the Anaheim Funicipal
Code; and
said Commission, after due inspoction, in-
vestigation and studies made by itself and in its behalf and
after du consideration of all evidence and reports offered
at said hearino Hid adopt its Resolution Ho. 885, Series 1962-61l,,
denying Conditional Use r'ermit No h22; and

the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in denyino said Conditional Use
Permit and did thereupon fix the 17th day of September, 1963, as
the time and the Council Chamber in the City ,Holl of the rity
of Anaheim as the place for a public hearing upon said
tional Use Permit, and notice-z of such bublic hearino were duly
given as required by law and the provisions of Titlo 18, Chan_
ter 18.7( of the Anaheim Municipal Code; and

hoaring, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, th:e City Council finds, after careful considera-
tion of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that:
1. The probo use is Properly one for which a
Conditional Use Permit is authorized by the
Anaheim Nunicipal Code.
9. The proposed use will not adversely affect the
adjoining land uses and the growth and develoP-
ment of the area in whicb it is proposed to be
located.
The size and shape of the site proposed for the
use is adcuate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and eneral welfare.
The traffic generated by the proposed use will
not impose an undue burden upon the streets and
hiohways desibned and improved to carry the
traffic in the area.
5• The grantino of the Conditional Usc Permit under
the conditions imposed will not he detri:Tental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim-
NUAT, THEREFOTiE, 32 IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission denying said Conditional Use 7crmit be, end the
same is hereby disapproved, and that Conditional Use 7
No. 1 .22 be, and the same is hereby, granted permitting the
construction of two-story, multiple -family planned resi-
dential development, with carports, a waiver of the one-story
heicht limitation and a waiver of the 6-foot masonry wall
rccuirement along the easterly property line, on the property
hereinbefore described, subject to the following conditions:
That the owner of subject property shall pay to the
City of Anaheim the sum of .2.5.00 per dwelling
unit, to be used for park and recreation purpose,
said amount to be paid at the time the butldina
permit is issued.
2. That trash storage areas shell be provided in ac-
cordance w7th approved plans on file in the Office
of the Director of Public 1ofhs and Superintenlent
of Streete, prior to final 'anticline insnectior.

The City Council hereby reserves the right to
revoke such Conditional Use Permit for good caue or failure
of said owner, his heirs, successors or assigns to comply
with the Anaheim Munleioal Code and reeulations and the con-
ditions herein.
