A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Pro-
ceedings No. 63 -64 -7 to consider an amendment
to Title 18 of the Anaheim Municipal Code relating to zoning,
and to consider a change in the boundaries of the zone or
zones hereinafter mentioned and described, and at said hearing
did receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing thereon the Planning Commission did duly adopt a resolu-
tion containing a report of its findings, a summary of the
evidence presented at said hearing, and a recommendation that
the proposed amendment be adopted by the City Council and that
a certain zone or zones be changed as hereinafter set forth;
and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings, and recommendation of the City
Planning Commission the City Council did fix the 13th day
of August 19 63 as the time and the City Council
Chamfers in the City Hall of the City of Anaheim as the place
for a public hearing upon said proposed amendment to Title 18
of the Anaheim Municipal Code, and the exclusion of said prop-
erty, hereinafter described, from the zone or zones in which
it is now situated, and the incorporation thereof in the zone
or zones hereinafter set forth; and did give notice thereof
in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public
hearing, and did give all persons interested therein an oppor-
tunity to be heard, and did receive evidence and reports, and
did thereupon consider the summary of evidence presented at
said public hearing before the Planning Commission, its report
of findings, and recommendation; and
WHEREAS, the City Council does find and determine
that the amendment to Title 18 of the Anaheim Municipal Code
should be adopted and that the property hereinafter described
should be excluded from the zone or zones in which it is now
situated and incorporated in the zone or zones as hereinafter
set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Title 18 of the Anaheim Municipal
Code be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County of
Orange, State of California, to wit:

PARCEL 1:
That portion of lot 17 of the Miles Rancho, in the
City of Anaheim, County of Orange, State of
California, as per map recorded in Book 4, page 7 of
Miscellaneous Maps, in the Office of the County Recorder
of said County, together with that portion of Spadra
Road, lying between said lots as shown on said map,
vacated by order of the Board of Supervisors of said
County, a copy of which was recorded May 16, 1917, in
Book 11, page 176 of Deeds, as shown on a map filed in
Book 9, page 41 of Record of Surveys, in the Office
of said County Recorder.
PARCEL 2:
Those portions of lots 13 and 17 of the Miles Rancho,
in the City of Anaheim, County of Orange, State of
California, as per map recorded in Book 4, page 7 of
Miscellaneous Maps, in the Office of the County Recorder
of said County, together with that portion of Spadra
Road, lying between said lots as shown on said map,
vacated by order of the Board of Supervisors of said
County, a copy of which was recorded May 16, 1917, in
Book 11, page 176 of Deeds, described as a whole as
follows:
Beginning at the northeast corner of the land shown on
the map filed in Book 9, page 41 of Record of Surveys,
being on the westerly right of way line of Palm Street
69.50 feet in width as shown on said map thence along
said westerly right of way line North 15 01' 33" West
43.43 feet; thence South 83 23' 40" West 72.51 feet to
a line parallel with and westerly 42.00 feet from the
westerly line of said land shown on said Record of
Survey map; thence along said parallel line South
0 00 40'' Vest 160.71 feet to a line parallel with
and northerly 53.00 feet from the center line of La
Palma Avenue thence along said parallel line
North S9 55 40" East 42.00 feet to said West line;
thence North 0 00' 40" East 127.00 feet to the
northwest corner of said land shown on said Record
of Survey map; thence North 89 55' 40" East 41.30
feet to the point of beginning.
be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor-
porated in C -3, HEAVY COMMERCIAL ZONE, upon the following
conditions:
1. That the owners of subject property shall deed
to the City of Anaheim a strip of land 45 feet
in width, from the center line of the street,
along Harbor Boulevard, for street widening
purposes.
2. That the owners of subject property shall deed to
the City of Anaheim a strip of land 53 feet in
width from the center line of the street, along
La Palma Avenue, for street widening purposes.

3 That the non standard driveway shall be removed
and reconstructed, and that sidewalks shall be
constructed along Harbor Boulevard as required by
the City Engineer and in accordance with standard
plans and specifications on file in the Office
of the City Engineer.
4 (a) That all engineering requirements of the City
of Anaheim along La Palma Avenue, including prepara-
tion of improvement plans and installation of all
improvements, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities or
other appurtenant work shall be complied with as
required by the City Engineer and in accordance
with standard plans and specifications on file
in the Office of the City Engineer; and (b) that
a bond in an amount and form satisfactory to the
City of Anaheim shall be posted with the City to
guarantee the installation of said engineering
requirements.
5 That the owners of subject property shall pay to
the City of Anaheim the sum of $2.00 per front
foot, along Harbor Boulevard and La Palma Avenue,
for street lighting purposes.
6. That trash storage areas shall be provided in
accordance with standard plans on file in the
Office of the Director of Public Works and
Superintendent of Streets, prior to final
building inspection.
7. That subject property shall be developed sub-
stantially in accordance with plans on file with
the City of Anaheim, marked 7° Exhibits Nos. 1 and
2,' and in accordance with Service Station Site
Development Standards on file with the City of
Anaheim, marked ''Exhibit No. 3," and made a part
of these reclassification proceedings.
8. That the owners of subject property shall place
of record City of Anaheim C -3 Deed Restrictions,
approved by the City Attorney, which restrictions
shall limit the use of subject property to a
service station or /and C -1, NEIGHBORHOOD
COMMERCIAL ZONE, uses only.
9. That Conditions Nos. 1, 2, 3, 4(b), 5 and 8 above
mentioned shall be complied with within a period
of 180 days from date hereof, or such further
time as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and
determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by
