A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 442
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application from Gaetone Abandonato,
1700 Irvine Avenue, Newport Beach, California, for a Conditional
Use Permit to construct two single- story, duplex apartments,
and permitting a waiver of the rear yard building setback, the
ten -foot garage width and the ten -foot end -to -end building
separation requirements, on the following described property
situated in the City of Anaheim, County of Orange, State of
California, to wit:
That portion of the Southwest quarter of the North-
east quarter of Section 22, Township 4 South, Range
10 West, in the Rancho San Juan Cajon de Santa Ana,
City of Anaheim, County of Orange, State of Califor-
nia, as said section is shown on a map recorded in
Book 51, Page 10, Miscellaneous Maps, records of said
Orange County, described as follows:
Beginning at the Southeast corner of Lot 10 of Tract
No. 2005, as shown on a map thereof recorded in Book
56, Pages 43 and WI, Miscellaneous Maps, records of
said Orange County, and running thence South 89 56t
43" West along the South line of said Lot 10, and its
Westerly extension, 127.85 feet more or less, to the
most Westerly corner of the strip of land described
in the deed to Gaetane Chartier Abandonato, recorded
May 24, 1956 in Book 3523, Page 366, Official Records
of said Orange County; thence South 35 21* 53" East
along the Southwesterly line of said strip of land,
243.74 feet to an angle point therein; thence con-
tinuing along said Southwesterly line, South 4o0 521 20"
East 17.01 feet to the most Southerly prolongation of
the Easterly line of said Lot 10 of Tract No. 2005;
thence North 6° 081 26" West along said Southerly
prolongation, 210.89 feet to the point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on July 8, 1963 notices
of which said public hearing were duly given as required by
law and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. 826 Series 1963 -6l1
granting Conditional Use Permit No. yip, S ā€˛hjoct to trp
conditions therein set forth and
WHEREAS, thereafter, within twenty -two (22) days
from the date of the adoption of said resolution, the City
Council did elect, upon its own motion, to review the action
of the City Planning Commission in granting_ said Condi-
tional Use Permit and did thereupon fix the 13th day of
August 1963 as the time and the Council Chamber
in the City Hall of the City of Anaheim as the place for a
public hearing upon said Conditional Use Permit, and notices
of such public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said
hearing, that:
1. The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining 1.nd uses and the growth and develop
ment of the area in which it is proposed to be
located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
4. The traffic generated by the proposed use will
not impose an undue burden upon the streets and
highways designed and improved to carry the
traffic in the area.
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Planning
Commission granting said Conditional Use Permit be, and
the same is hereby sustained and that Conditional Use
Permit No. ![t2 be, and the same is hereby, granted
permitting the construction of two single- story, duplex
apartments, and a waiver of the rear yard building setback,
the ten -foot building separation and the ten -foot garage
width requirements on the property hereinbefore described,
subject to the following conditions:
1. That sidewalks shall be constructed along Palm
Street, as required by the City Engineer and in
accordance with standard plans and specifications
on file in the Office of the City Engineer, prior
to final building inspection.
2. That the owner of subject property shall pay to the
City of Anaheim the sum of $25.00 per dwelling unit,

to be used for park and recreation purposes, said
amount to be paid at the time the building permit
is issued.
3. That trash storage areas shall be provided in ac-
cordance with standard plans on file in the Office
of the Director of Public Works and Superintendent
of Streets, prior to final building inspection.
4. That subject property shall be developed sub-
stantially in accordance with plans and specifi-
cations on file with the City of Anaheim, marked
"Exhibits Nos. 1 and 2, except as amended by the
City Planning Commission; provided, however, that
the garages be relocated and increased to ten (10)
feet in width, and that landscaping be installed on
the southerly portion of subject property.
5. That a 6 -foot masonry wall shall be constructed
along the northerly and westerly boundaries, ex-
cepting the southerly 75 feet (approximately) of
the westerly boundary, of subject property, prior
to final building inspection.
6. That this Conditional Use Permit is granted subject
to the completion of Reclassification Proceedings
No. 63 -64 -1 now pending.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of
said owner, her heirs, successors or assigns to comply with
the Anaheim Municipal Code and regulations and the conditions
herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 13th day of August, 1963.
