A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT THE
PUBLIC INTEREST AND NECESSITY REQUIRE THE
ACQUISITION, CONSTRUCTION AND COMPLETION OF
A PUBLIC UTILITY EXTENSION AND PUBLIC IMPROVE-
MENT, CONSISTING OF A DOMESTIC WATER SYSTEM
IN CERTAIN PORTIONS OF THE CITY OF ANAHEIM AND
IN CERTAIN AREAS CONTIGUOUS THERETO AND THE
ACQUISITION THEREOF BY THE CITY OF ANAHEIM BY
EMINENT DOMAIN PROCEEDINGS OF CERTAIN PROPERTY
OF DYKE WATER COMPANY IN SAID CERTAIN PORTIONS
WITHIN AND CONTIGUOUS TO SAID CITY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SECTION 1.
It is hereby found and determined that the public
interest and necessity require the acquisition, construction and
completion of a public utility extension and public improvement,
consisting of a domestic water system lines and works in the
City of Anaheim as hereinafter more particularly described in
the appendix attached hereto and by this reference made a part
hereof, to be used for and necessary for:
(1) The production, transmission and distribution
of water for the purpose of furnishing and
supplying domestic and irrigation water to
the City of Anaheim and certain of the
inhabitants thereof; and
(2) The proper development, control and circula-
tion of such water, at this time, and the
future proper development and control thereof,
as a part of the water system owned and operated by the City
of Anaheim for furnishing and supplying water to said City and
certain of the inhabitants thereof.
SECTION 2.
The public interest and necessity require the taking
and acquisition by the City of Anaheim for said public utility
extension and public improvement and use, of the domestic
water system lines and works of the Dyke Water Company, located
within certain portions of the City of Anaheim and within
certain areas contiguous thereto as more particularly described
in the appendix attached hereto, marked Exhibit "A" and by this
reference made a part hereof.
The City Council hereby finds that the taking of the
property hereinbefore referred to is necessary for the said
public utility extension and public improvement.

SECTION 3.
Said public improvement is planned and located in the
manner which will be most compatible with the greatest public
good and the least private injury.
SECTION 4.
The City Attorney of the City of Anaheim is hereby
directed to bring an action in the Superior Court of the State
of California, in and for the County of Orange, in the name of
the City of Anaheim to condemn by eminent domain proceedings
the property described in Section 2 hereof.
SECTION 5.
For the purposes of bringing such an action, the City
Attorney is hereby empowered to incur in the name of the said
City, all obligations and expenses incidental thereto.
THE FOREGOING RESOLUTION is approved and signed by
me this 19th day of February, 1963.

AND I FURTHER CERTIFY that the Mayor of the City of
