A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE
BOUNDARIES OF CERTAIN ZCNES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceedings
No, 62 to consider an amendment to
Title lb of the Anaheim Municipal Code relating to zoning, and to
consider a change in the boundaries of the zone or zones hereinafter
mentioned and described, and at said hearing did receive evidence ar
reports from persons interested therein and from its staff; and
WHEREAS, within a period of forty days following said
hearing thereon the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the proposed
amendment be adopted by the City Council and that certain zone or
zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of evi-
dence, report of findings, and recommendation of the City Planning
Commission the City Council did fix the _19th day of February_,
19 63 as the time and the City Council Chambers in the City Hall
of City of Anaheim as the place for a public hearing upon said
proposed amendment to Title 18 of the Anaheim Municipal Code, and
the exclusion of said property, hereinafter described, from the zone
or zones in which it is now situated, and the incorporation thereof
in the zone or zones hereinafter set forth; and did give notice
thereof in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public hearing,
and did give all persons interested therein an opportunity to be
heard, and did receive evidence and reports, and did thereupon
consider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings, and
recommendation; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should be
adopted and that the property hereinafter described should be
excluded from the zone or zones in which it is now situated and
incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County of
Orange, State of California, to wit:
The southeast quarter of the southeast quarter of
the southwest quarter of Section 12, Township 4
South, Range 11 West, in the Rancho Los Coyotes,
in the city of Anaheim, county of Orange, state
of California, as per map recorded in book 51,
page 11 of Miscellaneous Maps in the office of
the County Recorder of said county.

EXCEPT the southerly 253,00 feet thereof.
ALSO EXCEPT that portion condemned by the state
of California by a final order of condemnation,
a certified copy of which was recorded July 29,
1957, in book 3989, page 163, Official Records.
be excluded from C -1, NEIGHBORHOOD COMMERCIAL ZONE and incorpo-
rated in R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the
following conditions:
1. That the owner of subject property shall deed
to the City of Anaheim a strip of land 45 feet
in width, from the center line of the street,
along Dale Avenue for street widening purposes.
2. (a) That all engineering requirements of the
City of Anaheim along Dale Avenue, including
preparation of improvement plans and installation
of all improvements, such as curbs and gutters,
sidewalks, street grading and paving, drainage
facilities, or other appurtenant work shall be
complied with as required by the City Engineer
and in accordance with standard plans and
specifications on file in the Office of the
City Engineer; and (b) that a bond in an
amount and form satisfactory to the City of
Anaheim shall be posted with the City to
guarantee the installation of said engineering
requirements.
3. That the owner of subject property shall pay to
the City of Anaheim the sum of $2.00 per front
foot, along Dale Avenue, for street lighting
purposes.
4. That the owner of subject property shall pay
to the City of Anaheim the sum of $25.00 per
dwelling unit to be used for park and recreation
purposes, said amount to be paid at the time
the building permit is issued.
5. That adequate areas for trash storage, accessible
to trash -truck pickup, shall be provided as
determined and required by the Street Maintenance
and Sanitation Division of the Public Works
Department, which areas shall be enclosed with
a solid fence or wall prior to final building
inspection.
6. That fire hydrants shall be installed as required
and determined to be necessary by the Chief of
the Fire Department, and that said hydrants shall
be installed prior to final building inspection.
7. That the owner of subject property shall deed to
the City of Anaheim a 3 -foot public utility over-
hang easement along the westerly boundary of
subject property.
8. That subject property shall be developed
substantially in accordance with Exhibits
Nos. 1, 2 and 3, as amended herein, on file
with the City of Anaheim.
9. That all buildings constructed on subject
property shall comply with the height limita-
tions of the Anaheim Municipal Code for R -3
Zones.
10. That the proposed driveway at the intersection
of Tyler Avenue and Dale Street shall be re-
designed so that there will be a minimum offset
of five feet from the "before curve radius.
11. That the interior walls of the proposed car-
ports shall be stuccoed; that enclosed storage
cabinets shall be provided along the rear wall
of each carport; that adequate auto bumper
guards shall be provided at the rear of each
carport to protect the interior walls of the
proposed carports; and that all of said items
shall be completed prior to final building
inspection.
12. That a strip of land 45 feet in width, from the
center line of the street, along the westerly
side of Dale Avenue extending southerly from
subject property to the northerly boundary
of Lincoln Avenue, plus a 15 -foot property line
return at the corner of Dale and Lincoln Avenues,
shall be deeded to the City of Anaheim and
improved to City standards as required by the
City Engineer; and that said dedication and
improvement shall be accomplished simultaneously
with the development of subject property.
13. That a 6 -foot masonry wall shall be constructed
along the north property line, which wall shall
be stepped down to a height of 42 inches at
Dale Avenue, to provide adequate sight distance;
and that a masonry wall shall be constructed
along the westerly boundary of subject property,
which wall shall be six feet in height above
the grade level of the property to the west of
subject property.
14. That the intersection of Kendor Drive and Tyler
Avenue shall be constructed as a modified knuckle
and improved by the owner of subject property,
the necessary plans for said construction and
improvement to be prepared by the City Engineer.
15. That the completion of these reclassification
proceedings is contingent upon the granting of
Conditional Use Permit No. 348.
16. That Conditions Nos. 1, 2(b), 3 and 7 above
mentioned shall be complied with within a period of
180 days from date hereof, or such further time as
the City Council may grant.

BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and de-
termined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by
