As a homeowner in the Colony District with a Mills Act home I ask that you uphold the denial of the vinyl
windows the petitioner wishes to reverse. I have had to replace one of my windows that is street facing,
and while I sympathize with the homeowner, it is clearly stated in the contract that any modificaitons
need to be cleared with the City prior to beginning. Wood windows are quite expensive as I have
unfortunately had the burden of realizing, but are eligible for Energy Star rebates, and are
readily available with proper planning.
Further approving this appeal only encourages more rule breaking, and appeals. This is a poor use of city
resources. Owning a Mills Act House is not a free lunch -- the discount on property tax is to be used to
maintain the exterior of the house, as I have had to do as well as my neighbors. The homeowner is free to
use vinyl windows on non visible areas of their house which is a reasonable compromise. The
homeowner is also free to end their Mills Act contract if they so choose, however this would be the
worst case scenario for all parties. That being said, it is an available remedy.
