78-418RESOLUTION NO. 78R -418 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R -600 AND AMENDED BY RESOLUTION NOS. 73R -255, 73R -387, 73R -532, 74R -433, 75R -315, 75R -469 74R -479 AND 76R -378. WHEREAS, the City of Anaheim maintains a water distribution system for the furnishing of water to residents and inhabitants of the City of Anaheim; and WHEREAS, it is desirable and necessary that charges for service be fixed; and WHEREAS, the City has by ordinance and resolution made certain covenants with bondholders in connection with issuance of water revenue bonds; and WHEREAS, it is the policy of the City Council that Anaheim's Water Utility shall be self - supporting from charges made by the City for installation of water mains, for water furnished to consumers and for all services rendered in connection therewith; and WHEREAS, the cost of many individual items of labor, materials and equipment used by the Water Utility has increased substantially since the present water rates were established; and WHEREAS, a water commodity adjustment clause contained in Resolution No. 72R -600 provides automatic adjustment for the price of water purchased or pumped, including the cost of electrical energy to pump water, by the City of Anaheim, and distributed to its water customers; and WHEREAS, it is necessary to take into account the Orange County Water District (OCWD) basin equity assessment amount in order to recover fully increases in the costs covered by the water commodity adjustment clause; and WHEREAS, the Public Utilities Board has recommended increasing water rates to conform with the revenue requirments of the 1978 -79 budget and has recommended certain changes in the water commodity adjustment clause; and WHEREAS, Section 10.16.420 of the Anaheim Municipal Code provides that the City Council shall, by resolution, establish rates to be charged by the City of Anaheim for water furnished to consumers and services rendered in connection therewith. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Water Rates, Rules and Regulations adopted by Resolution No. 72R -600 and amended by Resolution Nos. 73R -255, 73R -387, 73R -532, 74R -433, 75R -315, 75R -469, 75R -479 and 76R -378 be, and the same is hereby amended as follows, to wit: CITY OF ANAHEIM Water Utility Post Office Box 3222 Anaheim, California 92803 Page No. ii RATES. APPLICABILITY Applicable to all--areas served by the Utility and to all rate schedule commodity charges. B. PURPOSE To provide for the automatic adjustment of the Utility's water rate schedule commodity charges per 100 cubic feet whenever the cost per acre foot (A.F.) of water is increased with respect to the base year of 1971 -72 due to changes in the Orange County Water District (OCWD) pump tax and basin equity assessment, the Metropolitan Water District of Southern California (MWD) and the Municipal Water District of Orange County (MWDOC) acre foot charge for treated water and /or the costs of electricity associated with underground water production. All water purchased from MWD and MWDOC shall be deemed to be treated water for the purpose of computing the commodity adjustment. Also, to establish the method for acre foot and any resulting change schedule commodity charges per 100 C. COST OF WATER determining the cost of water per (to the nearest mill) to the rate cubic feet. The cost of water shall be the sum of the per cent of water pumped times its total cost per A. F.* plus the per cent of water purchased times its total costs per A. F. The total cost per A. F. of pumped water is the sum of the OCWD pump tax plus the cost of electricity to pump water per A. F. The total cost per A. F. of purchased water is the MWD price per A. F. for treated domestic water. For the base year 1971 -72, 70 per cent of the water was pumped and 30 per cent was purchased. Based on the A. F. costs indicated below, the cost of water for the base year is $28.90 per A. F. for all water except irrigation and $18.85 per A. AMOUNT OF ADJUSTMENT 1. Computation of the amount of commodity adjustment to be applied to the rate schedule commodity charges is illustrated in the following example: If, starting September 7, 1973, 75% of the water is to be pumped and 25% is to be purchased, and the A. F. costs are as shown, then OCWD Pump Tax Electrical Pumping Domestic Water Cost per A.F. 75 X ( $17.00 + $7.97 ) _ $18.73 MWD A.F. Price, Treated Domestic Water 25% X ( $63.00 = $15.75 Cost Per A.F. = $ 34.48 Then $34.48 - $28.90 = $5.58 increase per A. F. compared to the base year. And since one A. F. = 43,560 cubic feet = 435.6 hundreds of cubic feet, then the commodity adjustment = $5.58/435.6 = $0 Adjustment for irrigation service would be computed in a similar manner using the base year average cost per acre foot of $18.85. 2. Starting July 1, 1976, the commodity adjustment amount calculated as illustrated in D.i above shall be adjusted to include system losses as shown below. The System Loss Factor used to calculate the commodity adjustment shall be based on water system losses for the most recent complete fiscal year. In territory capable of being annexed to the City of Anaheim where proceedings have been commenced in good faith for the annexation of said territory to the.City and where a petition for annexation is filed with the City Clerk, signed by a majority of the registered voters registering and residing in said territory proposed to be annexed to the City, and by the owners of more than 50% of the value of the territory proposed to be annexed, as shown by the last equalized assessment roll, and said proceedings are diligently advanced, then in the event, the water rates in such territory outside the city limits shall be the same as the rates within the city limits for a period of not to exceed six months. RULE NO. 9 RENDERING AND PAYMENT OF BILLS A. RENDERING OF BILLS 1. Billing Period. Bills for water service will be rendered bi- monthly monthly, or as otherwise provided in the tariff schedules. 2. Metered Service. a. Bills for metered service will be based on meter registrations. Meters will be read as required for the preparation of regular bills, opening bills and closing bills. B. If, because of unusual conditions or for reasons beyond its control, the Utility is unable to read the customer's meter on the scheduled reading date, the Utility may bill the customer for estimated consumption during the billing period, and make any necessary corrections when a reading is obtained. Estimated consumption for this purpose will be calculated con- sidering the customer's prior usage, the Utility's experience with other customers of the same class in that area, and the general characteristics of the customer's operations. Adjustments for any under estimate or over estimate of a customer's consumption will be reflected on the first regularly scheduled bill rendered and based on an actual reading following the period of inaccessi- bility. Access to the meter, sufficient to permit its being read, shall be provided by the customer as a pre - requisite to the Utility making any adjustment of water consumption billed on an estimated basis. 3. -Pro Rata Computation. a. All bills for water service rendered will be computed in accordance with the applicable thirty -day rate schedule, but the size of any commodity block and the amount of the customer, service, or minimum charge, specified therein, will be prorated on the basis of the ratio of the number of days service has been rendered to the number of days in an average month of thirty -days.
