1960-5836A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix time and place for the holding of a public hearing thereon in the manner and as prescrib -.d in Artiole.IX, Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct such public h -aring to consider said proposed change of zone or zone and did r calve evidence and reports from persons inter est th- rsein; and WHEREAS, within a period of forty (40) days following the final hearing thereo the Planning Csmmissi#n did duly announce by formal resolution it findings of f.. and declare its opinions and reaso:• s for recommending an.mendment to ,p aid Article IX Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and RESOLUTION NO 8 b olo WHEREAS upon receipt of the r._port and recommendation of the City Planning Commission the City Council did thereupon fix the 2 rd day of Febr a» 19_60 as the time and the Count Chamber^ in the ity Half of the City of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article IX Chapter 2 of the Anaheim Municipal Code; and WHEREAS at the time and p1ao fixed for said public hear= ing the City Council did duly hold and conduct such public hearing and did give all persons into- ;re.ted therein an opportunity to be heard and did receive evident: and reports and did thereupon con sider the recommendatio ns of the City Planning Commission;_ and WHEREAS the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone as hereinafter set forth is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop- erty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim County of Orange State of California described as follows: to wit: F- 59 -60 -72 PARCEL 1: The South 200.00 feet of the East 91.00 feet of the West 371.00 feet measured along the South and West lines respectively of the South 6•- Acres of the West half of the Southwest quarter of the South- east quarter of Section 20, Township L South, Range 10 West, in the Rancho Los Coyotes, as shown on a map thereof recorded in Book 51, page 7, et seq., Miscellan- eous Maps, records of said Orange County, as the South- east quarter of said Section 20 is shown on a map of sur- vey recorded in Book 17, page 27, Record of Surveys, in the office of the County Recorder of said Orange County. PARCEL 2: The South 200.00 feet of the East 91.00 feet of the West 462.00 feet measured along the South and West lines, respectively of the South 8 Acres of the West half of the Southwest quarter of the Southeast quarter of Section 20, Township L South, Range 10 West, in the Rancho Los Coyotes, County of Orange, State of California, as the Southeast quarter of said Section 20 is shown on Record of Survey Trap filed in Book 17, page 27, of Records of Surveys of said County. PARCEL 3: That portion of the Southwest quarter of the Mutheast quarter of Section 20, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as the Southeast quarter of said Section 20 is shown on a map filed in Book 17, page 27, of Record of Surveys in the office of the County Recorder of said County, described as follows: Beginning at a point on the South line of said Southwest quarter of the Southeast quarter distant thereon 5 5 3 feet East of the Southwest corner of said Southwest quarter of the Southeast quarter; thence North 350.00 feet parallel with the West line of said Southwest quarter of the South- east quarter; thence East 109.00 feet parallel with the South line of said Southwest quarter of the Southeast quarter, to the East line of the West half of the Southwest quarter of the Southeast quarter; thence South 350.00 feet along said East line to the South line of said Southwest quarter of the Southeast quarter; thence West 109.00 feet a long said South line to the point of beginning. EXCEPT the East 20.00 feet of the North 20.00 feet of the South 220.00 feet measured along the East and South lines, respectively. PARCEL The Southerly 200.00 feet of the Easterly 91.00 feet of the Westerly 553.00 feet, measured along the West and South lines, respectively of the South 8.5 acres of the West half of the Southwest quarter of the Southeast quarter of Section 20, Township 4 South, Range 10 West, in the Rancho Los Coyotes, County of Orange, State of California, as the Southeast quarter of said Section 20 is shown on Record of Survey Map filed in Book 17, page 27, of Record of Surveys, in the office of the County Recorder of said County. be changed from R -A, RESIDETIAL- AGRICULTURAL GONE to C -1, NEIGHBOR- HOOD-COMMERCIAL ZONE, upon the following conditions: 2- ATTE 1. That the owners of subject property deed to the City of Anaheim a strip of land 60 feet in width from the center line of the street, along Katella Pvenue, for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the Cit Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 3. That the owners of subject property pay to the City of Anaheim the sum of x;2.00 per front foot along Katella Avenue for street lightin`: purposes. 1. That a concrete masonry wall 6 -feet in height be con- structed along the boundary between this property and any adjacent R -1 zoned properties. 5. That the owners of subject property place of record standard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall provide that all exterior lighting for parking lots or other purposes shall ee installed so that the light will not shine into any of the adjacent R -1 zoned properties; that no public address or speaker system shall be per- mitted on the exterior of the buildings; that the build ing presently located on subject property shall be removed and replaced with a new commercial type building within a period of 3 years from date hereof; and that the buildings to be constructed on subject property shall be limited to one story, not exceeding twenty feet, in height. 6. That Conditions Nos. 1, 2(b), 3 and 5 above mentioned be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, end he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Muni.. cipal Code to amend said Anaheim Lunicipal Code to accomplish the object herein found and determined to be necessary and proper.
