A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT A
CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS
OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2
OF THE ANAHEIM MUNICIPAL CODE SHOULD BE
AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE;
AND RESCINDING RESOLUTION NO. 5320.
WHEREAS, heretofore, to wit, on the 4th day of May,
1959, an application was filed by Miles A. Sharkey with the
City Planning Commission requesting an amendment to Article
IX, Chapter 2 of the Anaheim Municipal Code and a reclassifi-
cation of the property hereinafter described by removing it
from the zone in which it is situated and incorporating it in
an M -1 Zone; and
WHEREAS, the City Planning Commission did thereupon
fix a date for a public hearing to be held on the 2nd day of
June, 1959, to consider said application, notice of which
said public hearing was duly given as required by state law
and the provisions of the Anaheim Municipal Code; and
WHEREAS, the City Planning Commission did hold a
public hearing within forty (40) days from and after the date
of filing said application at the City Hall in the City of
Anaheim and after due inspection, investigation and studies
by itself and in its behalf and after due consideration of
all evidence and reports offered at said hearing, did find
and determine that said application should be denied and did
thereupon recommend to the City Council of the City of Anaheim
that said application be denied; and
WHEREAS, within a period of twenty (20) days from
and after the decision of said City Planning Commission, the
applicant did, to wit, on the 2nd day of June, 1959, file a
written appeal with the City Council appealing from said
decision; and
WHEREAS, upon receipt of the report and recommenda-
tion of the City Planning Commission, the City Council did
thereupon fix the 30th day of June, 1959, as the time and
the Council Chamber in the City Hall of the City of Anaheim
as the place for a public hearing upon said proposed amendment
to said Article IX, Chapter 2 of the Anaheim Municipal Code
and said change of zone and reclassification of said property,
and gave notice thereof as required by law and the Anaheim
Municipal Code; and
WHEREAS, at the time and place fixed for said
public hearing, the City Council did duly hold and conduct
such public hearing and did give all persons interested therein
an opportunity to be heard and did receive evidence and reports
and did thereupon consider the recommendations of the City
Planning Commission; and

WHEREAS, the City Council does find and determine that
the property and area proposed to be changed from the zone in which
it is now situated to a different zone, as hereinafter set forth,
is more suitable for the zone or zones to which it is proposed to
change said property and area and that the inclusion of said pro-
perty and area in such new zone or zones will increase the value
of said property and area and will not depreciate the values of
property in adjoining zones,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that all of the property and area situated
in the City of Anaheim, County of Orange, State of California,
described as follows, to wit:
Lot 16, Block K of the Kraemer Tract, recorded in
Book 12, Pages 87 and 88, Miscellaneous Records of
Los Angeles County, California,
be changed from R -A, RESIDENTIAL AGRICULTURAL ZONE to the
following zones upon the conditions hereinafter set forth:
That a strip of land 50 feet in width along
Anaheim Road and a strip of land 50 feet in
width along La Palma Avenue be changed to
P -L, PARKING LANDSCAPING ZONE;
That the balance of subject property be changed
to M -1, LIGHT MANUFACTURING ZONE,
upon the following conditions:
1. That the owners of subject property deed to
the City of Anaheim a strip of lands feet in
width, from the center line of the street,
along Anaheim Road for street widening purposes;
and a strip of land 53 feet in width, from the
center line of the street, along La Palma
Avenue for street widening purposes.
2. That all engineering requirements of the City
of Anaheim along La Palma Avenue and Anaheim
Road, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities,
or other pertinent work, be complied with as
required by the City Engineer and in accordance
with standard plans and specifications on file
in the office of the City Engineer, and that
said engineering requirements or improvements
be installed at the time the property is
developed.
3. That the owners of subject property either:
(a) Pay to the City of Anaheim at the time said
property is developed the sum of $2.00 per
front foot on both La Palma Avenue and
Anaheim Road for street lighting purposes, or
(b) Install street lights in accordance with
plans and specifications approved by the
Office of the City Engineer.

14.. That approval of the Orange County Flood
Control District be obtained with reference
to the development of said property.
5. That the owners of subject property place of
record M -1 Deed Restrictions approved by the
City Attorney.
6. That Conditions No. 1 and 5 above mentioned be
complied with within a period of 90 days from
date hereof, or such further time as the
Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an amendment to Article IX, Chapter 2 of the
,Anaheim Municipal Code to amend said Anaheim Municipal Code to
accomplish the object herein found and determined to be
necessary and proper.
BE IT FURTHER RESOLVED, that Resolution No. 5320
adopted June 30, 1959 be, and the same is hereby rescinded.
THE FOREGOING RESOLUTION is approved and signed by
