1960-5782WHEREAS, the City Pl:r..:ni g Commission of the City of Anaheim has heretofore duly passed =nd adopted a resolution declar- ing its intentioe to change the boundaries of the zone or zones hereinafter mentioned and described aed did fix w time and place for the holding of a public hearing then on in the manner and as prescrib =d in Artioi IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public he ring to consider said proposed change of zone or zon and did reoo ;ive evidenee and reports from persons interested therein s and WHEREAS, within a period of forty (10) days following the final hearing thereon, the Planning C mmiffision did duly announce by formal resolution its findings of facets .-.1i d declare its opinions and reaso.•:s for recomm =nding an amendment to -.aid Article IX Chapter 2 of the Anaheim Municipal Coda to effect the proposed changes in the b undaries of the z *;ne hereinafter mentioned and described, and A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. RESOLUTION NO.'�82 WHEREAS, upon rceipt of the re port and recommendation of the City Planning Commission, th City Council did thereupon fix the day of 19 as the time and the ci Coun Chamber in the city of the ity of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in th manner =.nd as pro ided in said Article. IX, Chapter 2 of the Anaheim Municip =l Code and WHEREAS, t the time and piaco fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons inters ted therein an .opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and are proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zon s to which it is proposed to change said property and area and that the inclusion of said prop erty and area in such new zone or zones will incre:.se the value of said property and area and will not deprc =ciate the values of prop- erty in adjoining zones. NOW THEREFORE, BE IT RESOLVED by th City Council of the City of Anaheim th =t all of the property and are situated in the City of Anaheim, County of Orange, Stat f California, described as follows° to wit° F- 5 9e60 -66 PARCEL 1: Lots 73 to 80 inclusive of Placentia Acres, as shown on a map recorded in Book 7, Page 1I, Miscellaneous Maps, Records of said Orange County. PARCEL 2: The West 10 feet of the West 165 feet of the West 660 feet of that portion of Lot 2 in Block K of the Kramer Tract, as per map thereof recorded in Book 12, Pages 87 and 88, Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at a point in the Easterly line of said lot, 28 chains Southerly from the Northeasterly corner of said lot; thence Southerly along said Easterly line 12.03 chains to the Southeasterly corner of said lot; thence Westerly along the South line of said lot, 20 chains to the Southwesterly corner of said lot; thence Northerly along the Wester- ly line of said lot, 12.03 chains to the Southwesterly corner of the tract of land described in the deed from Nattle Goetz and husband to Emma Shaffer, recorded December 6, 1917, in Book 316, Page 202, Deeds, Records of said Orange County; thence Easterly along the Southerly line of said tract, 20 chains to the point of beginning. PARCEL 3: Lot A of Tract No. 800, as per map recorded in Book 29, Page 13, Miscellaneous Maps, Records of said County, together with the Southwesterly one -half of Simmons Avenue abandoned and vacated by order of the Board of Supervisors of Orange County, California, a certified copy of which order was recorded in the Office of the County Recorder of said Orange County. ALSO the East half of that portion of Richard Street lying West of Lots 32 to 39 inclusive of Placentia Acres, as shown on a map thereof recorded in Book 7, Page 14, Miscellaneous Maps, Records of said Orange County, said Richard Street having been vacated and abandoned by order of the Board of Supervisors of Orange County on November 6, 1946, a certified copy of which was recorded November 9, 1946, in Book 1505, Page 1142, Official Records, in the Office of the County Recorder of said Orange County. Excepting that portion lying Westerly of the Easterly line of a strip of land of the uniform width of 95 lying 47.50 feet on each side of the following described line. Beginning at a point on the center line of Anaheim Road said point distant North 73 °08 E. along said center line 1582.53 feet from its intersection with the center line of Dowling Street -2- be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE, to the following zones, upon the conditions hereinafter set forth: That a strip of subject property 50 feet in width, along Anaheim Road, be changed to P -L, PARKING LANDSCAPING ZONE; and upon the as its said point of intersection is shown in County Surveyor's Transit Book 123, Page 22, on file in the Office. of Orange County Surveyor; thence from said point of beginning, N. 6° 28 02" E. 426.70 feet to the beginning of a tangent curve, concave Easterly and having a radius of 1500 feet; thence Northerly along said curve 880 feet, more or less to a point in the Southerly line of Lot 51 of Placentia Acres, as shown on a map thereof recorded in Book 7, Page 14, Miscellaneous Maps, Records of said Orange County, said point being distant South ?3° 081 31" 1ni. 584.92 feet from the Southeasterly corner of Lot 71 of said Placentia Acres Tract. That the remainder of subject property be changed 2rteki's+i`� of subject property be obtained from Orange County Flood Control District and filed with the City of Anaheim before said property is developed. 2. That the owner of subject property deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Anaheim Road for street widening purposes. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work, be complied with as required by the City Engineer, at the time subject property is developed, and in accordance with standard plans and specifications on file in the office of the City Engineer. 1E.. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot along Anaheim Road, for street lighting pur- poses, and that said amount be paid at the time the property is developed. 5. That Condition No. 2 above- mentioned be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
