.iHEREAS, the City Council of the City of Anaheim did
cause to be pUblished in a ne~vspaper of general circulation,
printed, published and circulated in the City of Anaheim, to wit:
'The Anaheim Bulletin, on the_}i.t.h and 20th dayS of ~cembeL1-__..
1956 , , a notice inviting sealed uroposals for

All plant, labor, services, materi.ls and
equipment, and all utilities and transpor-
tation, including power, fuel and water, and
performing all work necessary to construct
and complete, in a good and workmanlike manner,
in strict accordance with the plans and specifica-
tions on file in the office of the City Clerk of
the City of Anaheim, the following public improve-
ment, to wit: The Lincoln Avenue Sewer., on the
north and south sides of Lincoln Avenue between
Euclid Avenue and Muller Street, consisting of the
construction of 8-inch standard strength V.O.P.
sewer laterals, 81 x 41 wyes, standard strength,
thirteen standard 4-foot brick manholes, Jacking,
resurfacing and appurtenant work, as indicated on
the plans, Job No. 1085,
in accordance with the designs, plans, profiles and specifications
of said public improvement on file in the Off' ;e of the City Clerk
of ~he City of Anaheim; and

c3ived by the City Council of the City of Anah im at the Office of
the City Clerk of the City of Anaheim up to th~ hour of 7;00 o'clock

of all plant, labor, servic-e-s-; mater-fa'fS and e-quipment, all utili-
ties and transportation, incluQing power, fuel and water, and per-
forming all work necessary to construct and complete, in a good ane
"orkmanlike manner, the public improvement hereinabove more particu-
larly mentioned and described and which notice did state and declare
that ~ursuant to the orovisions of Section 1770 of the Labor Code,
the City Council of the City of Anaheim had ascertained the prevailing
rate of vrages in the locality in which this type of labor is to be pel-
formed for each craft or ty)e of Horkman or mechanic needed to execute
the contract and did set forth the prevailing hourly wage scale so
ascertained; and

form with the City of Anaheim upon the terms and conditions speoified
in the notioe inviting sealed proposals and the proposal submitted
by said sucoessful bidder or bidders and in accordance with the plans
and specifioations for said public improvement hereinabove described
and in accordance with the terms, conditions and provisions of this
resolution, and that said successful b~dder or bidders to whom eaoh
oontraot is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the contraot price for
all labor, materials and equipmen~ to be furnished and performed as
set forth in the sealed propOsals submitted by said bidder for the
oonstruotion of said public improvement together with the appurtenances
thereto or such portion thereof as is covered by said contract as
security for the faithful performance of said contract and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
construc~on cost of said public improvement covered by said contraot
as security for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE IT FURTHER RESOLVED that said successful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfactory to the Ci t.y ot Anaheim publio
liability, property damage, compensation, and other insuranoe in
the amounts and for the purposes as set forth and specified in the
notice inviting sealed proposals and subjeot to the approval of the
City Attorney as to form and suffiCiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the City of Anaheim be, and they are hereby, authorized and direoted
to make, exeoute and enter into for and on behalf of the-City of Ana-
heim a written contract with said successful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performing
all work as hereinabove more particularly described for the construc-
tion, installation and completion of said public improvement herein-
above desoribed upon the terms and oonditions as speoified in the
notioe inviting sealed proposals, the detailed design, plans, prOfiles,
drawings and general specifications and detailed specifioations and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the City Olerk of the City of Anaheim and in strict accordance with
the terms, oonditions and prOVisions of this Resolution, and in aocord-
ance with all the contract documents herein speoified.
THE FOREGOING RESOLUTION is signed and approved by me this

WHEREAS. the City Council did thereupon refer said bids to

and report to the City Counoil, and said City Engineer
did examine and tabulate said sealed proposals and did report to the
Oouncil the result of his examination and tabulation; and
WHEREAS the City Oounoil finds that the sealed proposal sub-
mithd by E. k. BERN.ARD, 5868 Lime Aveaue, Lone: Beach S. California
is the lowest responsible proposal submitted for the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, inoluding power, fuel and water an4 performing all work
necessary to oonstruot and complete in a good and workmanlike manner
in strict acoordance with the specifications, plans and drawings
therefor on file in the office of the City Olerk of the City of Ana-
helmof the publio improvement hereinabove mentioned and desoribed,
together with the appurtenanoes thereto, and as speoified in the
notioe inviting sealed proposals, and that said proposal of said
above named bidder should be acoepted and a contraot awarded to said
bidder in aocordance therewith; and
WHEREAS, the City Council finds that the above mentioned
sealed proposal is the lowest responsible proposal received and that
the person, firm or corporation submitting said proposal is a
re.ponsible person, firm or corporation and that the proposal sub-
mitted is the best suited and fitted for the publio improvement to
be oonstructed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that the sealed proposal submitted by
