JHEREAS, the City Council of the City of Anahe im did
cause to be published in a newspaper of general circulation,
printeQ, published and circulated in the City of Anaheim, to wit:
The Anaheim Bulletin, on the 14th and 20th days of December,

All plant, labor, services, materials and equip-
ment, and all utilities and transportation, in-
cluding power, fuel and water, and performing all
work necessary to constrct and complete in a good
and workmanlike manner, in strict accordance with the
specifications, plans and drawings therefor on file
in the office of the City Clerk of the City of Ana-
heim, the following public improvement, to wit:
The Lincoln Avenue Sewer, on the south side of
Lincoln Avenue from Magnolia Avenue to Dale Avenue,
consistinc of the construction of 12-inch and 8-inch
extra strength V.C.P. sewer laterals, construction of
eight standard 4-foot brick manholes, one standard
trap manhole, two standard drop manholes, 12" x 4"
extra strength wyes, jacking, resurfacing, and
appurtenant work as indicated on the plans,

in accordance with the designs, plans, profiles and specifications

forwing all work necessary to construct and complete, in a good anQ

larly mentioned and described and which notice did state and declare
th&t ~ursuant to tne provisions of Section 1770 of the Labor Code,
the City Council of the City of Anaheim had ascertained the prevailing'

the contract and did set forth the prevailing hourly wage scale so

WHEREAS, the 01ty Oounoil finds that the sealed proposal sub-

is the lowest responsible proposal submitted for the furnishing of all
plant, labor, servioes, materials and equipment, all utilities and
transportation, including power, fuel and water an4 performing all work
necessary to construot and complete in a good and workmanlike manner
in strict acoordance with the specifications, plans and drawings
theretor on file in the office of the Oity Olerk of the City of .Ana-
heim of the public improvement hereinabove mentioned and desoribed,
tocether with the appurtenances thereto, and as apeoified in the
notioe inviting sealed proposals, and that said proposal of said
abClve named bidder should be accepted and a contraot awarded to said
bidder 1n aocordance therewith; and
WHEREAS, the City Council finds that the above mentioned
sealed proposal is the lowest responSible proposal received and that
the person, firm or corporation submitting said proposal is a
re.ponsible person, firm or corporation and that the proposal sub-
mitted is the best suited and fitted for the public improvement to
be oonstruoted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM, that the sealed proposal submitted by

tor the furnishing of all plant, labor, services, materials and
eq~ipment, all utilities and transportation, inoluding power, fuel
and water and performing all work necessary to oonstruot and complete

sealed proposals, the public works and improvements hereinabove more
p~tiou1arly mentioned and described, together with the appurtenanoes
thereto, be, and the same is hereby, accepted, and that a contraot
fo~ the construotion and oompletion of said public improvement be,
and the same is hereby, awarded to the said above named bidder.
AND BE IT FURTHER RESOLVED that the suocessful bidder or
bidders upon each contract awarded as hereinabove set forth shall
be, and they are hereby required to execute a oontraot in the required

form with the City of Anaheim upon the terms and oonditions specified
in the notioe inviting sealed proposals and the proposal submitted
by said suooessfu1 bidder or bidders and in accordance with the plans
and speoifications for said public improvement hereinabove desoribed
and in acoordanoe with the terms, conditions and provisions of this
resolution, and that said successful bidder or bidders to whom eaoh
contraot is awarded shall be required to furnish a surety bond in an
amount equal to one hundred per cent (100%) of the oontraot prioe for
all labor, materials and equipment to be furnished and performed as
set forth in the sealed proposals submitted by said bidder for the
oonstruotion of said public improvement together with the appurtenances
thereto or suoh portion thereof as is covered by said contraot as
seourity for the faithful performance of said contract and a separate
surety bond in an amount equal to one hundred per cent (100%) of the
construc~on cost of said publio improvement covered by said oontract
as security for the payment of all persons performing labor and furn-
ishing material for said project.
AND BE IT FURTHER RESOLVED that said suocessful bidder or
bidders be, and they are hereby required to furnish to the City of
Anaheim in companies satisfaotory to the City of Anaheim public
liability, property damage, compensation, and other insuranoe in
the amounts and for the purposes as set forth and speoified in the
notioe inviting sealed proposals and subject to the approval of the
City Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City Olerk
of the City of Anaheim be, and they are hereby, authorized and direoted
to make, exeoute and enter into for and on behalf of the City of Ana-
heim a written contract with said successful bidder or bidders for the
furnishing of all plant, labor, materials, and equipment and performing
all work as hereinabove more particularly described for the oonstruo-
tion, installation and oompletion of said publio improvement herein-
above described upon the terms and conditions as speoified in the
notioe inviting sealed proposals, the detailed design, plans, prOfiles,
drawings and general specifications and detailed specifications and
drawings and all addenda thereto and all modifications incorporated
therein prior to the date of the opening of bids, on file in the office
of the City Olerk of the City of Anaheim and in strict accordance with
the terms, conditions and provisions of this Resolution, and in accord-
ance with all the contract documents herein specified.
