A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AMENDING RESOLUTION NO.
5714. IN RECLASSIFICATION PROCEEDINGS NO.
F-59- 60 -42.
WHEREAS, the City Council did heretofore, to wit, on
December 22, 1959, adopt Resolution No. 5714 in reclassification
proceedings No. F- 59- 60 -42, upon application from Russell C. Jay
and Ben Rochelle for a change of zone of certain real property
described in said application; and
WHEREAS, Conditions No. 1 and 2 of Resolution No. 5714
read as follows:
"1. That all buildings constructed on subject
property be limited to one story in height;
and that the maximum number of units per
lot be limited to five on that portion of
subject property described as Lots 1, 3 and
4 of Tentative Tract No. 3552, and to a
maximum of four units per lot on the remainder
of said property.
"2. That the owners of subject property place of
record standard City of Anaheim R -3 Deed
Restrictions, approved by the City Attorney,
which restrictions shall limit all buildings
constructed on said property to one story in
height, shall limit the number of units con-
structed on each lot to five units on the
property described as Lots 1, 3 and 4 of
Tentative Tract No. 3552, and shall limit the
number of units per lot to four on the re-
mainder of subject property."
AND WHEREAS the City Council finds that buildings two
stories in height should be permitted on Lots 1, 3 and 4 of
Tentative Tract No. 3552, and that said Conditions No. 1 and 2
of Resolution 5714 should, therefore be amended to allow two
story construction on Lots 1, 3 and 4 of Tentative Tract No.
3552, with a maximum of five units per lot; and
WHEREAS, the City Council does further find that an
ordinance has never been adopted directing said change of zone
and completing said proceedings.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that Resolution No. 5714 in reclassification pro-
ceedings No. F- 59 -60 -42 be, and the same is hereby amended by
amending ConditionsNo. 1 and 2 thereof to read as follows:
"1. That all buildings constructed on subject
property shall be limited to one story in
height, with the exception of the buildings
constructed on Lots 1, 3 and 4 of Tentative
Tract No. 3552, which shall be limited to
two stories in height; and that the maximum
number of units per lot shall be limited to
five on that portion of subject property

described as Lots 1, 3 and 4 of Tentative
Tract No. 3552, and to a maximum of four
units per lot on the remainder of said
property.
"2. That the owners of subject property place
of record standard City of Anaheim R -3
Deed Restrictions, approved by the City
Attorney, which restrictions shall limit
all buildings constructed on said property
to one story in height, with the exception
of the buildings constructed on Lots 1, 3
and 4 of Tentative Tract No. 3552, which
shall be limited to two stories in height;
shall limit the number of units constructed
on each lot to five on the property des-
cribed as Lots 1, 3 and 4 of Tentative
Tract No. 3552, and shall limit the number
of units per lot to four on the remainder
of subject property.
BE IT FURTHER RESOLVED that in all other respects
said Resolution No..5714 be, and remain in full force and
effect.
BE IT FURTHER RESOLVED that the City Attorney be,
and he is hereby authorized and directed to prepare and
submit to the City Council an amendment to Article IX,
Chapter 2 of the Anaheim Municipal Code to amend said
Anaheim Municipal Code to accomplish the object herein
found and determined to be necessary and proper.
THE FOREGOING RESOLUTION is signed and approved by
me this 19th day of January, 1960.
