A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING THE REQUEST OF THE CHURCH
OF JESUS CHRIST OF LATTER DAY. SAINTS FOR A
SPECIAL USE PERMIT TO.ERECT A CHURCH.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a Special Use Permit from
Corporation of the Presiding Bishop of the Church of Jesus
Christ of Latter -Day Saints, a Utah Corporation Sole, to erect
a church on the following described property:
All that certain real property situated in the
City of Anaheim, County of Orange, State of
California, described as follows:
Lot 10 of the Anaheim Homestead Tract, as shown
on a map thereof recorded in Book 26, Page 10,
Miscellaneous Records of Los Angeles County,
California;
EXCEPTING THEREFROM the North 630.88 feet
thereof measured to the center line of the
60 foot street commonly known as North Street.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
request on August 17, 1959, notices of which said public hearing
were duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered
at said hearing, did adopt its Resolution No. 33, Series
1959 -60 granting Special Use Permit No. 46 upon the conditions
therein set forth; and
WHEREAS, thereafter, within twenty days from the date
of the adoption of said resolution, a written appeal was filed
with the City Council of the City of Anaheim protesting the
action of the City Planning Commission granting said Special
Use Permit, and said appeal was set for public hearing on
September 22, 1959 at 7:00 o'clock P.M. at the City Hall in
the City of Anaheim, and notice of such public hearing was
duly given as required by law and the provisions of Section
9200.17 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to
be heard and did receive evidence and reports; and
WHEREAS, the City Council does find that:
1. There is no substantial property right
possessed by other property in the same
vicinity and zone and denied the subject
property.

2. It appears that the subject property can
be adequately developed and used under
the present zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of. Anaheim that the action of the City Planning
Commission granting Special Use Permit No. 46 to Corporation
of the Presiding Bishop of the Church of Jesus Christ of
Latter -Day Saints, a Utah Corporation Sole, c/o Dr. Paul S.
Arnold, 1L16 West Center Street, Anaheim, California, to
erect a church, on the property hereinabove described, be
and the same is hereby disapproved, and that Special Use Permit
No. 46 be and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by
me this 12th day of January, 1960.

do hereby certify that the foregoing resolution was introduced
and adopted at a regular meeting provided by law, of the City
Council of the City of Anaheim, held on the 12th day of January,
1960, by the following vote of the members thereof:
AYES: COUNCILMEN: Coons, Fry, Pearson, Thompson
and Schutte.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed. said resolution on the 12th daffy of
January, 1960.
