-~ A RESOLUTION OF ThE CIT`f"COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERitiiINl?'JG THAT A
CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS
OF THE CITY, AND THAT ARTICLE IY, CHAPTER 2
OF THE ANAHEIM MUNICIPAL CODE. SHOULD BE
AMEDIDED TO ACCOi~iPLISH SAID CHANGE OF ZOi~TE.
WHEREAS, the City Planning Commission of the City
of Anaheim has heretofore duly passed and adopted a resolution
recommending denial of a change in the boundaries of the zone
or zones here inaf ter mentioned and described, of tc~r having fixed
a time and place for the holding of a public hearing thereon in
the manner and as prescribed in Article IX, Chapter 2 of the
Anaheim Municipal Code, and after ]laving duly held and conducted
such public .hearing to consider said pro-posed change of zone or
zones, and after having received evidence and reports from persons
interested therein; and
WHEREAS, within a period of forty (1~0) days following
the hearing thereon, the Planning Commission did duly announce by
formal resolution its findings of facts and declare its opinions
and reasons for recommending denial of said proposed change in
the boundaries of the zone or zones hereinafter mentioned and
described; and
WHEREAS, upon receipt of the report and recommendation
of the Cit3.T Planning Commission, the City Council did thereupon
fix the lst day of December, 1458, as the time and the Council
Chamber in the City Hall of the City of Anaheim as the place for
a public hearing upon said proposed change of zone, and did give
notice thereof in the manner and as provided in said Article IX,
Chapter 2 of the Anaheim iUiunicipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such public
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports, and did
thereupon consider the recommendations of the City Planning
Commission; and
WHEREAS, the City Council does find and determine that
the property and area proposed to be changed from the zone in
which it is now situated to a different zone, as hereinafter set
forth, is more suitable for the zone or zones to which it is
proposed to change said property and area and that the inclusion
of said property and area in such new zone or zones will increase
the value of said property and area and will not depreciate the
values of property in adjoining zones.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that all of the property and area situated
in the City of Anahei;+1, County of Orange, State of California,
described as follows, to wit:
That portion of the Tdortheast quarter of the Southeast
quarter of Section 15, Township L!- South, Range 11 West,
S.B.B. 8~ M., in the Rancho Los Coyotes, as shown on a
map by Charles T. Healey upon survey by him about 1870
for the Stearns Ranchos Company, described as follows:
Beginning at a point on the East line of said Section
15, 2036.76 feet North from the Sout'r~east corner thereof;

be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE to R-3, MULTIPLE-
F,4MILY RESIDENTIAL ZONE, upon the following conditions:
1. That the owner of subject property place of record
standard City of Anaheim R-3 Deed Restrictions,
approved by the City Attorney.
2. That the owner of subject property deed to the City
of Anaheim a strip of land 53 feet in width, from
the center line of the street, along Knott Avenue,
for street widening purposes.
3. (a) That all engineering requirements of the City
of Anaheim, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities, or
other pertinent work be complied with as required
by the City Engineer and in accordance with stand-
ard plans and specifications on file in the office
of the City Engineer; and (b) that a bond in an
amount and form satisfactory to the City of Anaheim
be posted with the City to guarantee the instal-
lation of said engineering requirements.
I~.. That the owner of subject property pay to the City
of Anaheim the sum of $2.00 per front foot for
street lighting purposes.
5. That the owner of subject property pay to the City
of Anaheim the sum of $25.00 per dwelling unit, to
be used for park and recreation purposes, said
amount to be paid at the time the building permit
is issued.
5. That the final tract map subdividing subject property
be recorded in the office of the County Recorder of
Orange County.
7. That all buildings to be erected on subject property
shall be constructed in accordance with the plans
this day submitted to and reviewed by the City
Council, and on file with the City of Anaheim.
8. That all of the above conditions, with the exception
of Conditions Nos. 3(a), 5 and 7, be complied with
within a period of 180 days from date hereof, or
such further time as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he i5 hereby authorized and directed to prepare and submit to the
City Council an amendment to Article IX, Chapter 2 of the Anaheim
Municipal Code to amend said Anaheir~l Municipal Code to accomplish
the object herein found and determined to be necessary and proper.
