A RESOLUTION OF THE CITY COUNOIL OF THE CITY
OF ANAHEIMFIHALLY ACCEPTING THE COMPLETION
AND THE FURNISHING OJ' ALL PUNT, LABOR, SER-
VIOES, MATERIALS AND IQUIPMEIT AND ALL UTILITIES
AND TRANSPORTATION INCLUDING POWER, FUEL AND
WATER, AND PERFORKING ALL WOU NECESSARY TO
OONSTRUOT AND COMPLETE THE FOLLOWING PUBLIO
IMPROVEMEN'1': THE LEWIS STREET SEWER JIvIPROVEMENT,
FROM BALL ROAD TO A POINT 1.900 FEET SOUTH

WHEREAS, the City Council of the City of Anaheim did oause to
be pqb11shed in a newspaper of general oi~oulation, printed, pUblished and
oi~odlated in the City of Anaheim, to wit: The Anaheim Bulletin, ~n the
~h!~, 26th days of June , 19 S6 , a notioe inviting
se41~ proposals for furnishing the following:
All plant, labor, services, materials and equip-
ment, and all utilities and transportation, in-
cluding power, fuel and water, and performing all
work necessary to construct and complete in a
good and workmanlike manner, in strict accordance
with the specifications, plans and drawings there-
for on file in the office of the City Clerk of the
City of Anaheim, the following public improvement,
to wit: The Lewis Street Sewer Improvement, from
Ball Road to a point 1,000 feet south thereof,
consisting of the construction of standard manholes,
la-inch V.C.P. sewer laterals, remodeling existing
manholes, and appurtenant work, as indicated on
the plans, Job No. 1069,

WHEREAS, at a regular meeting of the City Counoil held on the

WHEREAS, the City Council of the City of Anaheim did oause to

work necessary to construct and complete in a
good and workmanlike manner, in strict accordance
with the specifications, plans and drawings there-
for on file in the orfice of the City Clerk of the
City of Anaheim, the rollowing public improvement,
to wit: The Lewis Street Sewer Improvement, from
Ball Road to a point 1,000 reet south thereof,
consisting of the construction of standard manholes,
10-inch V.C.P. sewer laterals, remodeling existing
manholes, and appurtenant work, as indicated on
the plans, Job No. 1069,

the pre~ailing rate of wages for each type of labor needed to execute

WHEREAS, at a regular meeting of the City Council held on the

forming all work neoessary to oonstruct and complete, in a good and
wOrkmanlike manner, in strict aooordanoe with the speoifioations,
p1ans and drawings therefor on file in the offioe of the Oity Clerk
of the City of Anaheim, of the public improvement hereinabove more
particularly desoribed and set forth; and
WHEREAS, the City Council did thereupon refer said bids to
the City. Engineer for examination
tabulation and report to the City Council, and saidCitv Engineer
did thereupon examine and tabulate said sealed
p~pGsals and report the result of his tabulation to the City Counoil;
and
WHEREAS, the City Counoil did meet in regular
se"don on the 10th ~ of July , 19 56 , at the hour
of, ~()Q o'clock p.X. to consider the sealed proposals submitt.d
forurnishing materials and performing the work hereinabove more
Partioularly desoribed and set forth, and the City Engineer
of' the Oity of Anaheim did thereupon make his
report and submit his tabulati~n of said sealed proposals, and the
Oity Oounoil did thereupon find and determine that the sealed proposal
submitted by Plumbing Contractors. Inc.. Sanitary Division.
for the construction, installation and completion of said Lewis Street
Sa~~r ~mDrovement. from Ball Road to a point 1,000 ft. south thereof,
he*eimahove mentioned and described was the lowest responsible pro-
po.al submitted therefor, and thereupon accepted said bid and did
aw~d a oontract to said P1umbinc Contractors. Inc.. Sanitary Division,
for furnishing all plant, labor, servioes, materials and equipment
and all utilities and transportation, including power, fuel and water,
and performing all work necessary to construot and complete, in a good
and workmanlike manner, in strict accordance with the specifioations,
plans, and drawings, the said public improvement as speoified in said
notioe inviting sealed proposals, and did authorize the Mayor and the
Oity Clerk of the City of Anaheim to execute a contract for and on
behalf of the City of Anaheim with P11lmbinii Contractors. Inc.

lla e and entered into on the 16th day of July

WHEREAS, the said Plumbin:;z Contractors, Inc., Sanitary Division,
has furnished all plant, labor, services, materials and equipment and
all utilities and transportation, and performed all work neoessary
for the oonstruction and completion, in a good and workmanlike manner,
in strict accordance with the specifioations, plans, draWings, of said
pub1io improvement as specified in the notioe inviting sealed proposals
and in the detail, design, plans, profiles, drawings and speOifications
prepared by George E. HolYOke. City Engineer , and the oontract
made and entered into with.. ~lt by the City of Anaheim; and

WHEREAS, the City En~ineer
has duly certified to the oonstruotion and completion of said pUblio
imptovement hereinabove mentioned and desoribed in aocordanoe with
the plans and specifioations and the contract doouments duly made and
entered into with said Plumbing Contractors. Inc.. Sanitary ; and
Division
WHEREAS, the Oity Counoil finds that said contractor has oom-
pleted said publio improvement hereinabove more partioularly desoribed
in aooordanoe with the provisions of the contraot and the contraot
doc~ents, and that notice of completion should be filed and payment
of the balance due said oontractor authorized in aooordance with the
contract doouments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Anaheim that all plant, labor, services, materials and equipment

aDd all utilities and transportation, and the performanoe of all
w~k neoessary to oonstruot, install and oo~plete, in a good and
w~kaanlIke manner, in striot aooordanoe with the speolfioations,
plan. and drawings therefor on file in the ~ffioe of the Oity
Olark of the Oity of Anaheim, together with the appurtenanoes
thereto of said public improvement hereinabove more partioularly
deBoribed and set forth, in the City of Anaheim, by said OOJr
traotor, be, and the same is hereby, aooepted, subJeot, neverthe-
le.s, to all the terms, oonditions and provisions of the oontraot
doouments, and that the balanoe due said oontraotor for said work
be paid to it thirty-five <'S) days from and after final
aooeptanoe of said work as evidenoed by the adoption of this
reJalutIon, but not sooner than thirty <'0) days after the date
af the filing of notice of oompletion, exoepting only suoh sum
or sums as may lawfully be withheld in aooordance with the pro-
visions of said oontract and oontraot doouments. That aooeptanoe
by the oontraotor of said payments made in aooordanoe with said
final estimate shall operate and shall be a release to the City of
An~eim, its officers, agents and employees from all olaims and
liabilities due the contractor for anything done or furnished or
withheld or tor anything relating to the work or any aot or neg-
lect of the City, its offioers, agents and employees, excepting
only olaims against the City for any amounts withheld by the City
at the time of such payment.
AND BE IT FURTHJ:R RESOLVED that the Mayor and the Oity
Olerk of the Oity of Anaheim be, and they are hereby, authorized
to exeoute and file a notioe of oompletion of said work as required
by law.
THE FOREGOING RESOLUTION was signed and approved by me
