A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINALLY ACCEPTING THE COMPLETION
AND THE FURNISHING OF ALL PLANT, LABOR, SER-
VICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES
AND TRANSPORTATION INOLUDING POWER, FUEL AND
WATER, AND PERFORMING ALL WORK NECESSARY TO
CONSTRUCT AND COMPLETE THE FOLLOWING PUBLIC
IKPROVEMENT:CONSTRUCTION OF AN 18-INCH STEEL

FROM PLACENTIA AVE. TO SUNKIST ST.. AND ALONG SUN-
KIST ST. FROM LA PAUA'.A AVE. TO THE ANAHEIM-OLIVE RD.,
WORK ORDER NO. 1353.
WHEREAS, the City Counoil of the City of Anaheim did oaule to
be pu~11shed in a newspaper of general oi~culation, printed, pUblished and
cirou~ated in the City of Anaheim, to wit: The Anaheim Bulletin, on the

proposals for furnishing the following:
All plant, labor, services, materials (except those
to be furnished by the City, as set forth in the
specifications) and equipment, and all utilities
and transportation, including power, fuel and water,
and perform all work necessary to construct, install
and complete, in a good and workmanlike manner, in
strict accordance with the plans and specifications
on file in the office of the City Clerk or the City
Engineer of the City of Anaheim, the following pub-
lic improvement, to wit: The construction, installa-
tion and completion of an eighteen (18) inch steel
cylinder concrete water line, with valves, fittings
and all appurtenances, along La Palma Avenue, from
Placentia Avenue to Sunkist Street, and along Sun-
kist Street from La Palma Avenue to the Anaheim-
Olive Road, Work Order No. 1353.

the prevailing rate of wages for each type of labor needed to execute

WHEREAS, at a regular meeting, of the City Council held on the

~P. M. of said date J said City Counoil did hold a publio hearing
for ~h. purpose of opening sealed proposals reoeived up to that time, for

plans and drawings therefor on file in the office of the Oity Clerk
Of the City of Anaheim, of the publio improvement hereinabove more

WHEREAS, the Oity Oouncil did thereupon refer said bids to
the City En~ineer for examination

WHEREAS, the City Counoil did meet in regular

partioularly desoribed and set forth, and the City En~ineer
of the City of Anaheim did thereupon make his
~eport and submit his tabulation of said sealed proposals, and the

for the oonstruotion, installation and completion of said 18 inch steel

poeal submitted therefor, and thereupon aocepted said bid and did

for furnishing all plant, labor, servioes, materials and equipment
and all utilities and transportation, inoluding power, fuel and water,
and performing all work neoessary to construct and complete, in a good
and workmanlike manner, in strict aocordanoe with the speoifications,
pl~s, and drawings, the said public improvement as speoified in said
notioe inviting sealed proposals, and did authorize the Mayor and the
City Clerk of the City of Anaheim to execute a oontract for and on
behalf of the City of Anaheim with J. E. Young Pipe Line
~ractor. Inc. , whioh said contraot was duly
and entered into on the 8th day of May

WHEREAS, the said J. E. Youn~ Pipe Line Contractor, Inc.
has furnished all plant, labor, services, materials and equipment and
all utilities and transportation, and performed all work neoessary
for the oonstruotion and oompletion, in a good and workmanlike manner,
in striot aooordance with the speoifications, plans, drawings, of said
pub~ic improvement as speoified in the notioe inviting sealed proposals
and in the detail, design, plans, profiles, drawings and speoifications
prepared by George E. Holvoke. City EnQineer , and the oontraot
made and entered into with them by the City of Anaheim; and
WHEREAS, the City Engineer
has duly oertified to the construotion and oompletion of said pUblic
improvement hereinabove mentioned and described in aooordanoe with
the plans and speoifioations and the oontraot doouments duly made and
entered into with said J. E. Young Pipe Line Contractor. Inc.; and
WHEREAS, the City Counoil finds that said contractor has oom-
ple~ed said public improvement hereinabove more partioularly desoribed
in aooordanoe with the provisions of the oontraot and the oontraot
doouments, and that notioe of completion should be filed and payment
of the balanoe due said contraotor authorized in aooordance with the
oontract doouments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Anaheim that all plant, labor, servioes, materials and equipment

and all utilities and transportation, and the performanoe of all
wo*k neoessary to construct, install and complete, in a good and
wo~~nlike manner, in striot aooordance with the speoifioations,
pl.ns and drawings therefor on file in the offioe of the City
Ol.rk of the City of Anaheim, together with the appurtenanoes
th.reto of said pUblic improvement hereinabove more partioularly
de~oribed and set, forth, in the City of Anaheim, by said oon-
tr"ot~r, be, and the same is hereby, aooept ed, sui) je ot, neverthe-
le.a, to all the terms, conditions and provisions of the oontract
d04uments, and that the balance due said oontraotor for said work
bepdd to them thirty-five (:35) days from and after final
a048ptance of said work as evidenoed by the adoption of this
re~olution, but not sooner than thirty (30) days after the date
of the filing of notice of completion, exoepting only suoh sum
or ,sums as may lawfully be withheld in aocordance with the pro-
vidions of said oontract and contraot doouments. That aooeptanoe
by the oontraotor of said payments made in accordance with said
final estimate shall operate and shall be a release to the Oity of
An_heim, its officers, agents and employees from all claims and
liabilities due the contractor for anything done or furnished or
wi~hheld or for anything relating to the work or any aot or neg-
ledt of the City, its officers, agents and employees, exoepting
en~y olaims against the City for any amounts withheld by the City
at the time of such payment.
AND BE IT FURTHJ:R RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
to execute and file a notice of oompletion of said work as required
bylaw.
THE FOREGOING RESOLUTION was signed and approved by me
