WHEREAS, the City Plan i:•g Commission of the City of Anaheim has heretofore duly p -.esed and adopted a resolution declar- ing its intention to change,the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a publicitariag thereon in the manner and as prescrib in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of z ®ne or zone; and did rec©y:ive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following t s. final hearing thereon, the Planning Commission did duly announce formal resolution its findings of facts; and declare its opinions and reasons for recommending =;n amendment to said Article IX, Chapter 2 of the Anaheim Municipal Cod to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and RESOLUTION NO. 6160 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. -1- WHEREAS, upon receipt of the report and recommendation the City Planning Commission, the City Council did thereupon fix the 26th day of July 1960 as the time and the Count Chamber in the Hof thirty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop arty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: Lot 1 of the Joseph i'iscus+ Su division, as shoun on. a map recorded. in 2ook 6, Page. 73 of i ii sce l la Maps, s of Orange County, 'l California. Tbat subject property he developed sub- stantially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 3. That twenty (20) off-street parking spaces be provided for employees. That suitoble landscaping be provided and maintained along the front property line for a depth of 20 feet. 5 That the owner of subject property place of record standard City of Analteim C-3 Deed Restrictions, approved by the City Attorney, which restrictions shall 1iiit the uses of the property to a new car agency or any C-I uses. 3. 6. That the owner of suhect property deed to the City of Anaheir, a strip of land feet in width, from the center linc of the street, along Los Angeles Street for street widening purposes. 7. That sidewalks be installed, along Los Angeles Street, as required by the City Enjineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer. D. That a bond in an amount and form satisfactory to the City of Anahei:n be posted with the City -2- to guarantee the installation of the sidewalks above mentioned and the construction of the block wall mentioned in Condition No. 1 hereof. 9. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lightino purposes. 10. That until such time as the new building is constructed on subject property, access to the residential area be blocked off by means of a barricade at, the rear of the existing buildino. 11. That the tire sales business be conducted within the building. 12. That all of the above conditions, with the exception of Conditions Nos. 1, 2, "I, 1 1, 7. 10 and 11 he complied with within a period or 90 day from date hereof, or such further time as the City Council may grant. IT FURTHER T-'62soLvEn that the City Attorney and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object her( in found and determined to be necessary and proper.
