RESOLUTION NO. 3543
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHElI': AUTHORIZING 'rHE
PURCHASE AND ACQUISITION OF CERTAIN
REAL PROPERTY, ,FOR PUBLIC PURPOSES.
WHEREAS, Nutwood Properties, Inc. and Nutwood Pro-
perties #3, Inc., both California corporations, are the owners
of the hereinafter described real property, together with the
well, meter and appurtenances thereto located on said property,
situated in the City of Anaheim, County of Orange, State of
California; and
WHEREAS, said owners have offered to sell said real
and personal property to the City of Anaheim for the sum of
$4,975.00, cash, lawful money of the United States; and
WHEREAS, the City Council does find and determine that
public convenience and necessity require the purchase and acqui-
sition of said parcel of real property, together with the well,
meter and appurtenances thereto located on said property, for
public purposes, and that the price which the owners thereof are
willinE to accept is reasonable and not out of proportion to the
fair market value of said property,
NOW, THEREFORE, BE IT HESOLVED by the City Council of
the City of Anaheim that the offer of Nutwood Properties, Inc.,
and Nutwood Properties #3 Inc., to sell said property, situated
in the City of Anaheim, County of Orange, State of California,
described as follows, to wit:
That portion of the Northeast quarter of
the Southwest quarter of Section 17, Town-
ship 4 South, Range 10 West, S.P.B. & M.,
described as follows:
Co~~encing at the intersection of the
center line of Orange Avenue with the
center line of Primrose Street as shown
on a Map of Tract No. 2369, recorded in
Book 74, pages 1 to 6 inclusive of Mis-
cellaneous Maps, records of Orange
County, Cali:fornia; thence North 89030'
06" East along the center line of said
Orange Avenue a distance of 137.60 feet;
thence South 0029'54" East at right angles
to the center line of said Orange Avenue
a distance of 130.00 feet; said point
being the true point of beginning; thence
North 89030'06" East parallel with the
center line of said Orange Avenue a dis-
tance of 83.02 feet; said point being the
beginning of a curve concave Northwesterly
having a radius of 163.95 feet; a radial
line throush said point bears South 650
15'26" Easi; thence Southwesterly along
said curve through a central angle of
8001'08" a distance of 22.95 feet; thence
South 89030'06"West parallel with the
center line of said Orange Avenue a dis-
tance of 71.81 feet; thence South 0029'54"

Together with the well, meter and appur-
tenances thereto located on said property.
:for the sum of $4,975.00, cash, lawful money of the United States,
be, and the same is hereby accepted, subject to the following
terms and conditions:
1.
That subject property shall be conveyed
to the City of Anaheim free and clear of
all encumbrances except all taxes here-
after assessed, and covenants, conditions,
restrictions, reservations, rights, rights-
of-way and easements of record.
2.
Purchaser a~rees at its expense to black-
top the app~oach to said well site and pro-
vide plant screening on each side of said
approach and also provide a gate at the
entrance to said well site.
3. Purchaser will install necessary concrete
block wall to minimize interference with
the residential use of adjacent property.
BE IT VuRTHER RESOLVED that the City Administrator of
the City of Anaheim be, and he is hereby, authorized for and on
behalf of the City of Anaheim to sign escrow instructions for the
purchase of sai.d property and to enter into an e2crow with the
owners of said property at Orange County Title Company, Santa Ana,
California.
AND BE IT b~RTEER RESOLVED that the City Treasurer be,
and she is hereby, authorized to deposit in escrow at Or~nge
County Title Company, Santa Ana, California, the sum of $4,975.00,
cash, lawful money of the United States, to be paid to the owners
of said property when a deed conveying said property to the City
of Anaheim free and clear of all encumcrances, except as herein-
above set fort~, can be recorded and a policy of title insurance
issued by 8 reputable title company showing said property vested
in the City of Anaheim free and clear of all encumbrances as herein
specified.
AND 3E IT F'UR1'HER RESOLVED that the sellers shall pay
the usual and customary sellers' charges for furnishing a policy
of title insurance necessary to show title vested in the City of
Anaheim, as herein provided, and that the City of Anaheim shall
pay the usual buyer's share in the purchase of said property.
