A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM FINDING AND DETERMINING THAT A CHANGE
OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE
CITY AND THAT ARTICLE IX CHAPTER 2 OF THE
ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO
ACCOMPLISH SAID CHANGE OF ZONE.
WHEREAS the City Planning Commission of the City of
Anaheim has heretofore duly passed and adopted a resolution declar-
ing its intention to change the boundaries of the zone or zones
hereinafter mentioned and described and did fix a time and place
for the holding of a public hearing thereon in the manner and as
prescribed in Article.IX Chapter 2 of the Anaheim Municipal Code
and did duly hold and conduct such public hearing to consider said
proposed change of zone or zone and did receive evidence and
reports from persons interested therein; and
WHEREAS, within a period of forty (40) days following the
final hearing thereon the Planning Commission did duly announce by
formal resolution its findings of facts and declare its opinions
and reasons for recommending an amendment to said Article IX
Chapter 2 of the Anaheim Municipal Code to effect the proposed
changes in the boundaries of the zone hereinafter mentioned and
described; and
WHEREAS upon receipt of the report and recommendation of
the City Planning Commission the City Council did thereupon fix
the 10th day of Na 19 60 9 as the time and the
Council hamber in the ity a of thety of Anaheim as the place
for a public hearing upon said proposed change of zone and did give
notice thereof in the manner and as provided in said Article. IX
Chapter 2 of the Anaheim Municipal Code; and
WHEREAS at the time and place fixed for said public hear=
ing the City Council did duly hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports and did thereupon con-
sider the recommendations of the City Planning Commission; and
WHEREAS the City Council does find and determine that the
property and area proposed to be changed from the zone in which it
is now situated to a different zone, as hereinafter set forth is
more suitable for the zone or zones to which it is proposed to
change said property and area and that the inclusion of said prop'
erty and area in such new zone or zones will increase the value of
said property and area and will not depreciate the values of prop-
erty in adjoining zones.
NOW THEREFORE BE IT RESOLVED by the City Council of the
City of Anaheim that all of the property and area situated in the
City of Anaheim County of Orange State of California described
as follows: to wit:

That portion of Lot 16, Anaheim Extension of the Rancho San
Juan Cajon de Santa Ana, as per map thereof as surveyed by
William Hamel on file in the office of the rec ,rder of Los
Angeles County, Calif rn ia, more particularly described as
follows
Beginning at the intersect ion of the center Rine of Placentia
Avenue with the center line of South Street, running thence
South 74® 36 05 West 261010 feet, along the said center line
of South Street; thence South 15' 45 2 East 188075 feet;
thence North 74* 36 05 East 207.63 feet to a point in the
said center line of Placentia Avenue; thence North 0' 050
15" E st 895084. feet along the said center line of Placentia

Map by Wm. Hamel, on file in the Reccorderls Office of Los
Angeles County, California, a copy of which is recorded on
pages 163, et seq. Book 3, entitled "L +s Angeles County Maps"
in the office of the County Recorder of said Orange County,
described as follows.
BEGINNING at a point on the center line *f Placentia Avenue,
distant thereon South 0' 059 15 West 493097 feet from the
Northeast corner of said Lot 16, said corner being considered
to be the intersection of the center lines of South Street
and Placentia Avenue; thence South 74' 36 05 West 238023
feet parallel with said center line of South Street to the
East line .f th land described in the deed to Co L Becker,
recorded in Book 161, Page 89, Deeds, records of said Orange
County; thence South 15* 45 25 East along said East line
of said Becker land to the Southwesterly corner of the land
described in deed to Jennie Bo Matouk, recorded June 39 1943,

Beginning at a point in the center line of Placentia Ave.,
said point being 195084 feet South O 051 154 West from the
intersection of said center line of Placentia Ave., with the
center line of South Street, running thence from said point
of beginning South 0 O5Q 15" West 73000 feet to the South-
easterly corner of that certain parcel of land conveyed to
James B. Kerwin by deed recorded October 28, 1947 in Book 1590,
at page 187 of Official Records, in the office of County Recorder
of said Orange County. Thence South 74® 36 05` West 299070
feet along a line parallel with said center line of South Street,
to the most Southerly corner of said Kerwin parcel of land

of South Street to a point in the East line of that certain

Northeast corner of said Lot 16, said corner being con-
sidered to be the intersection of the center lines of South
Street and Placentia Ave, and running thence South 0 05
15" West 118.98 feet along said center line of Placentia
Ave.; thence South 74° 361 05" West 238,23 feet along a line
parallel to the said center line of South Street to a point
in the East line of that certain parcel of land conveyed to
C. L. Becker by deed recorded in Book 161, at page 89, of
Deeds, records of said Orange County; thence North 15° 45
25" West 114,69 feet along said East line of the land con-
veyed to C. L. Becker to a point in a line which bears
South 74 36 05" West from the point of beginning, said
line being parallel to the said center line of South Street;

upon the following conditions:
1. That the owners of the respective parcels of subject
property deed to the City of Anaheim a strip of land
53 feet in width, from the center line of the street,
along Placentia Avenue, and a strip of land 32 feet
in width, from the center line of the street, along
South Street, for street widening purposes.
2. That sidewalks be installed along South Street and
Placentia Avenue as required by the City Engineer
and in accordance with standard plans and specifica-
tions on file in the office of the City Engineer.
3. That the owners of the property pay to the City of
Anaheim the sun of $2.00 per front foot along
Placentia Avenue, South Street and Iviorava Street
for street lighting purposes.
4. That the buildings now located on subject property
shall be removed before the respective parcels are
developed.
5. That all buildings or structures to be erected on
subject property shall be limited to one story in
height.
6. That no single store building in the entire develop-
ment shall exceed 4,000 square feet in area.
7. That each parcel of subject property shall be
developed substantially in accordance with the
over -all site plan.
8. That the layout, landscaping and construction of
the buildings shall be substantially in accordance
with the plans submitted to the City Council, marked
Exhibits 'A," "3" and "C," signed by Applicant J. B.
Kerwin, June 7, 1960, and on file with the City of
Anaheim.
9. That a 10 -foot buffer strip shall be established and
maintained along the west property line, and said
buffer strip shall be landscaped in conformance with
the requirements of the Parks and Recreation De-
partment.
10. That the owners of the respective parcels of subject
property place of record City of Anaheim C -1 Deed
Restrictions approved by the City Attorney, which
restrictions shall limit the uses of the property to
the following:
1. Offices (Business, Professional and
Real Estate Agencies.)
2. Telephone Answering Service.
3. Bank.
4. Exhibit Halls (No Retail Sales from floor).
5. Barber shop or beauty parlor.

22. Confectionery stores with ice cream.
23. Mens, wormens and children apparel shops.
24. Studio related to permitted uses in area.
25. Interior decorator studios.
26. Neighborhood grocery store (with limited
floor space of 24.,000 sq. ft. No off
sale beer, wine, or liquor).
27. Toy and hobby shop.
and shall provide that all buildings or structures to
be erected on subject property shall be limited to
one story in height and no building shall exceed
4,000 square feet in area.
11. That a bond in an amount and form satisfactory to the
City of Anaheim be posted with the City to guarantee
the installation of the sidewalks mentioned in
Condition No. 2 hereof.
12. That Conditions Nos. 1, 3, 10 and 11 above mentioned
be complied with within a period of 180 days from
date hereof, or such further time as the City Council
may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an amendment to Article IX, Chapter 2 of the
Anaheim Municipal Code to amend said Anaheim Municipal Code to
accomplish the object herein found and determined to be necessary
and proper.
THE FOREGOING RESOLUTION is signed and approved by me
