A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 1217.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from Con
ventionLand U.S.A., Inc. and U.S.A. Hotel Corporation, 7805
Sunset Boulevard, Los Angeles, California., owners and /or
lessee of certain real property situated in the City of
Anaheim, County of Orange, State of California, described
as follows:
Lot 1 of Tract No. 2854, in the City of Anaheim,
County of Orange, State of California, as per map
recorded in Book 90, Pages 39 and 40 of Miscellaneous
Naps, in the Office of the County Recorder of said
County.
EXCEPT that portion of said Lot 1 included within the
East 190.00 feet of the South 210.00 feet, measured
along the South and East lines of Section 21, Township
4 South, Range 10 West, as shown on the map of the
Fairview Colony Tract, as recorded in Book 1, Page 33
of Miscellaneous Maps, in the Office of the County
Recorder of said County.
ALSO EXCEPT that portion thereof lying southerly of a
line which is parallel with and 570.00 feet northerly
from the center line of Katella Avenue as said center line
is shown on said .map and lying westerly of a line which is
parallel with and 420.00 feet easterly from the center
line of Walnut Street as said center line is shown on
said map.
ALSO EXCEPT that portion of the East 300.00 feet thereof,
lying North of the South "210.00 feet, measured along
the East line of Section 21, Township l;. South, Range
10 West, as shown on the map of the Fairview Colony
Tract recorded in Book 1, Page 33 of Miscellaneous
Maps, in the office of the County Recorder of said
County, and South of a line which bears South 890 L8+ 33"
West from a point on the East line of said lot distant
South 00 05' 20" East 785.00 feet from the northeast
corner thereof.
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim upon
said petition on ''arch 21, 1960, notices of which said public
hearing were duly given as required by law and the provisions
of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf
and after due consideration of all evidence and reports offered
at said hearing, did adopt its Resolution No. 199, recommending
to the City Council of the City of Anaheim that Variance No.
1217 be granted upon the conditions stated in said resolution;
and

WHEREAS, the City Council does find that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property
in question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in
such vicinity and zone in which the property
is located.
L. That the granting of such variance will not
adversely affect the comprehensive general
zoning plan.
NOW THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance be,
and the same is hereby granted to ConventionLand
and U.S.A. Motel Corporation, 7805 Sunset Boulevard, Los
Angeles, California, to construct a multi-story hotel of
approximately 300 rooms, together with necessary landscaping,
parking facilities and other on -site and off -site improvements,
and a shopping center with facilities for approximately 200
separate shops, together with parking facilities and other
on -site and off -site improvements, on the property herein
above described, subject to the following conditions:
1. That the owners of the property deed to the City
of Anaheim a strip of land 45 feet in width, from
the center line of the street, along West Street,
and a strip of land 60 feet in width, from the
center line of the street, along Walnut Street,
for street widening purposes.
2. That all engineering requirements of the City of
Anaheim, along Walnut Street and Katelia Avenue,
such as curbs and gutters, sidewalks, street grading
and paving, drainage facilities, or other appurtenant
work be complied with as required by the City Engi-
neer and in accordance with standard plans and
specifications on file in the office of the City
Engineer.
3. That sidewalks be installed along West Street as
required by the City Engineer and in accordance
with standard plans and specifications on file
in the office of the City Engineer.
4. That the wall and landscaping heretofore installed
along Walnut Street by Wonder Bowl be continued
along Walnut Street on subject property.

The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owners,
their successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein.
Said variance is granted for the terra prescribed by the
Anaheim Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is signed and approved by
me this 7th day of June, 1960.

5. That a bond in an amount and for satisfactory
to the City of Anaheim be posted with the City
to guarantee the installation of said engineering
requirements above mentioned along Walnut Street
and Katella Avenue, said sidewalks along West
Street, and said wall along Walnut Street.
6. That the owners of subject property pay to the
City of Anaheim the sum of $2.00 per front foot
along West Street, Katella Avenue and Walnut
Street for street widening purposes.
7. That all detailed plans of construction shall be
presented to the City Council for approval, prior
to the issuance of any building permit.
8. That there shall be no access to, nor egress from
subject property on Walnut Street.
9. That the letter dated May 23, 1960, addressed to
the City Council of Anaheim, City of Anaheim, City
Hall, Anaheim, California, signed by James L.
Fallon, President of ConventionLand U.S.A.,Inc.,
and on file with the City, a copy of which is
attached hereto, shall be and is hereby incorporated
by reference in Variance No. 1217 and made a part
thereof, and that all stipulations contained in
said letter shall be adhered to by ConventionLand
U.S.A., Inc., except that the stipulation with
reference to the area to be devoted to perishable
food products shall not apply, but that the
maximum area which shall be devoted to perishable
food products shall not exceed 15% of the total
project.
