A RESOLUTION OF' THE CITY COUNCIL 01<' THE
CITY OF ANAHEIM AUTHORIZING THE PURCHASE
OF CERTAIN REAL PROPERTY HEREINAFTER
DESCRIBED FOR FUBLIC PURPOSES
WHEREAS, VALENCIA IRRIGATION COMPANY, a corporation,
is the owner of the hereinafter described real property
situated in the County of Orange, State of California; and
V\HEREAS, said Company has offered to sell said property
to the City of Anaheim for the sum of Four Thousand Dollars
($4,000.00) cash, lawful money of the United States of America;
and
WHEREAS, the City Council does find and determine that
there is a water well located upon said hereinafter described
property capable of producing approximately six hundred twenty-
five (625) gallons of water per minute, equipped with a Layne &
Bowler pump and a fifty horse power (50 hap.) General Electric
motor, pump house and accessories and appurtenances; and
WHEREAS, the City Council finds that said offer of the
Valencia Irrigation Company to sell said property to the City
of Anaheim is made upon the following conditions:
1. Subject to all general and special taxes for the
fiscal year 1956-1957.
2. Subject to conditions, restrictions, reservations,
covenants, easements, rights of way and rights of
record, if any.
3. The reservation of an easement for existing pipe
lines along or near the Northerly and Easterly
lines of said land.

5. That the City will continue to serve irrigation water
to the property owned by J. Earl Talcott for agricultural
purposes until such time in the future when he shall
dispose 01' his orange grove, at which time this said
service will be discontinued. The price for water
delivered shall be computed on the standby proportion
of the original Valencia hOlding, (10/102 shares for
the parcel of propdrty), plus energy charges, plus
pumping tax 01' 1p3. 90 per acre 1'oot of water pumped.
6. That the City assume all obligations for the operation
and maintenance of said water well and equipment from
and after July 24, 1956; and

that pUblic convenience and necessity require the purchase and
acquisition or said parcel or real P"O.:d:d;y :BI'el11afteI' described,
4. That the City continue to serve irrigation water to
a one acre parcel of land owned by Joseph PaCker,
located on 7881 North West Street, Anaheim, until
such time in the near 1'uture when he disposes of said
property, at which time the service will be discontinued.

upon thd terms and conditions above speciried and that the
price which the owner thereof is willing to accept is reason-
able an"; not out or proportion to the rair market value of the
said property,
NOW THEREFORE, BE IT RESOLVED by the City Councilor the
City or Anaheim that the offer of said Valencia Irrigation
Company to sell the property situated in the County or Orange,
state of Calirornia, described as follows, to wit:
Commencing at a point in the West line of' Lot 10
of the Miles Rancho, as shown on a Map recorded
in Book 4, page 7 of Miscellaneous Maps, records
of Orange County, Calirornia, said point being
909 reet North of the pouth line of section 4,
Township 4 South, Range 10 West, S. B. B. & M.,
and running thence So~thwesterly and parallel with
the right of way of the Anaheim Union Water Company,
105 feet; thence Nort~, 50 feet to said right of way;
thence Northeasterly along said right or way 105 feet
to the West line or Lot 10 or said Miles Rancho; thence
South along said West line, 50 feet to the point or
beginning,
together with the Layne & Bowler pump, 50 horse power General
Electric Motor, accessories and appurtenances, together with all
rights to the well and pumping plant located thereon, for the
sum of Four Thousand Dollars (~4,000.00) cash, lawful money of
the United States of America upon the conditions hereinabove
specified, be and the same is hereby accepted.
AND BE IT FURTHER R8S0LVED, that the City Administrator
of the City of Anaheim be, and he is hereby authorized for and
on behalf' of the City of Anaheim to sign Escrow Instructions
ror the purchase of said real property and to enter into an
escrow with the owner of said property at the Calif'ornia Bank
in the City or Anaheim, California, upon the terms and conditions
herein specified and with the usual and customary provisions
relating to escrows of this character.
AND BE IT }'URTffBR RESOLVED, that the City Treasurer be,
and she is hereby authorized to deposit in Escrow in the California
Bank, Anaheim, Cal j,f'ornia, Escrow Department, the sum of Four
Thousand Dollars ($4,000.00) cash, lawrul money or the United
states of America to be paid to the owner of said real property
when a Deed conveying said property to the City of Anaheim, free
and clear of all encumbrances except as hereinabove set forth
can be recorded and a Policy of Title Insurance issued by the
Orange County Title Company showing said property vested in the
CITY 01<' ANAHEIM, a municipal corporation, free and clear of all
encumbrances except as herein otherwise specified.

AND BE IT FURTHER RESOLVED, that the seller shall pay the
usual and customary seller's charges for purchasing a Policy of
Title Insurance necessary to show title vested in the City of
Anaheim as herein provided and that the City of Anaheim shall
pay the usual buyer's escrow and recording charges.
