A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM REQUESTING THE METROPOLITAN WATER
DISTRICT OF SOUTHERN CALIFORNIA TO CONSTRUCT
A 14-INCH SERVICE CONNECTION ON THE SANTIAGO
LATERAL OF THE METROPOLITAN WATER DISTRICT AT
STATION 201+88; AUTHORIZING THE PAYMENT BY THE
CITY OF ANAHEIM OF ONE-THIRD OF THE COST
THEREOF; AND RESCINDING RESOLUTION NO. 3491.
WHEREAS, the Superintendenl of lhe Light, Power
and Water Deparlmenl of lhe Cily of Anaheim has requested
lhal a l4-inch service conneclion be construcled on the
Santiago laleral at Slation 201+88 of The Metropolitan
Waler District of Southern California in accordance with
preliminary layouts and estimated costs in the amount of
$18,000 submitted by The Metropolitan Water District; and
WHEREAS, the City Council finds that the Orange
County Municipal Water District and the City of Orange wish
to have the joint use of said connection with the City of
Anaheim, and each to pay one-third of the cost of the con-
struction and maintenance thereof; and
WHEREAS, the City Council finds that it is proper
and necessary that such service connection be constructed,
and that it would be to the advantage and for the best in-
terest of the City of Anaheim that such connection be con-
structed at the joint expense of the City of Anaheim, the
Orange County Municipal Water District and the City of
Orange; and that after said connection is constructed and
placed in use that it be jointly used and maintained by
the City of Anaheim, the Orange County Municipal Water Dis-
trict and the City of Orange upon such terms and conditions
as they may, from time to time, agree upon.
NOW, THEREFORE, BE IT RESOLVED that a l4-inch
service connection be constructed on the Santiago lateral
of The Metropolitan Water District, Orange County feeder
line, at Station 201+88, in accordance with preliminary
layouts and estimate of costs as set forth in a letter of
August 23, 1956 from The Metropolitan Water District of
Southern California addressed to Quinton Engineers, Ltd.,
812 West 8th Street, Los Angeles, California, and such
construction thereof is hereby authorized on behalf of the
City of Anaheim, subject to the following terms and condi-
tions, to wit:
1. That said service connection shall be located
on the Santiago lateral feeder of The Metropolitan Water
District at Station 201+88.

2. That said service connection shall be con-
structed by The Metropolitan Water District in accordance
with plans and specifications approved by the General
Manager and Chief Engineer of The Metropolitan Water Dis-
trict, by the Superintendent of the Light, Power and Water
Department of lhe Cily of Anaheim, and by proper officials
of the Orange County Municipal Waler Dislrict and lhe City
of Orange. All equipment and materials required for con-

struction of said l4-inch service connection shall be pur-
chased by Metropolitan in its customary manner, or Metro-
politan may furnish therefor suitable equipment and
materials on hand. All labor and materials furnished in
connection with the construction of said connection, or the
award of any contract therefor, shall be in accordance with
all of the requirements of the laws of California governing
the doing or the award of a contract for the construction
of public improvements in the State of California.
3. All costs of procuring equipment and materials
for and construction of said 14-inch service connection shall
be borne by the City of Anaheim, the Orange County Municipal
Water District and the City of Orange as follows:
The City of Anaheim shall pay one-third thereof;
the Orange County Municipal Water District shall
pay one-third thereof; and the City of Orange
shall pay one-third thereof.
One-third of all such costs incurred by Metropolitan shall be
paid or reimbursed to The Metropolitan Water District by the
City of Anaheim. The City of Anaheim shall deposit the sum
of $6,000 with The Metropolitan Water District as a fund based
upon the estimated proportionate share of the City of Anaheim,
said fund, along with similar deposits from the Orange County
Municipal Water District and the City of Orange, to be drawn
upon for costs incurred by The Metropolitan Water District.
Said deposit by the City of Anaheim is based upon the estimated
proportionate share of the total costs, and should the costs
exceed the estimate, the City of Anaheim shall pay its pro-
portionate share of the additional costs when a demand there-
for is submitted by The ~~tropolitan Water District. Should
the costs be less than the estimate, the difference between
costs and estimate shall be refunded to the City of Anaheim.
Said costs incurred by The Metropolitan Water District shall
include the cost of all equipment and materials so procured
or furnished by it therefor, the cost of all applicable labor
and taxes, and all other direct costs, all of said costs to
be determined in accordance with the methods of cost account-
ing customarily employed by The Metropolitan Water District.
All costs incurred by The Metropolitan Water District so to
be borne by the City of Anaheim, the Orange County Municipal
Water District and the City of Orange shall be audited and
certified in accordance with the customary practice of The
Metropolitan Water District.

4. Said service connection shall include facili-
ties for diversion of water from said Santiago lateral
feeder and for delivery of such water for use by the City
of Anaheim, the Orange County Municipal Water District and
the City of Orange. Said facilities shall consist of a
branch pipe connected to The Metropolitan Water District's
Santiago feeder pipe line, a shutoff valve, a 14" x 4"
compound propeller type meter equipped with indicating, re-
cording and totalizing instruments, a check valve or other
device for preventing backflow from the distribution system
of the City of Anaheim, the Orange County Municipal Water
District or the City of Orange into The Metropolitan Water
District's works, together with appropriate piping, fit-
tings and other appurtenances, and, if deemed necessary or
desirable by The Metropolitan Water District's General
Manager and Chief Engineer, an additional shutoff valve to

enable the meter to be isolated for maintenance or repair.
Said meter and valves shall be housed in ventilated, rein-
forced concrete vaults, and said meter instruments shall be
provided with a suitable weather-proof metal cabinet. Said
service connection up to and including the fitting connect-
ing with the pipe line through which the City of Anaheim,
the Orange County Minicipal Water District and the City of
Orange will receive water delivered through said service
connection, and including said meter instruments and cabinet
therefor, shall be and become the property of The Metropoli-
tan Water District, and shall be operated, maintained and
controlled by it. On said pipe line through which the City
of Anaheim, the Orange County Municipal Water District and
the City of Orange will receive water so delivered, there
shall be a control valve or control valves installed, owned
and controlled by the City of Anaheim, the Orange County
Municipal Water District and tre City of Orange.
5. The City of Anaheim shall grant, or cause to
be granted, to The Metropolitan Water District such permanent
easement as may be necessary for the construction, reconstruc-
tion, operation, maintenance, repair and removal of said
service connection in, over, through and under a parcel of
land, the location and dimensions of which parcel of land
shall be adequate for said purposes as determIned by the
General Manager and Chief Engineer of The Metropolitan Water
District, and which easement shall be in form satisfactory
to the General Counsel of The Metropolitan Water District.
6. The authorization to construct said service con-
nection in the manner and subject to the terms and conditions
set forth in this resolution shall not become effective until:
a. The Board of Directors of the Orange County
Municipal Water District and the City Council of the City of
Orange shall have adopted resolutions requesting The Metro-
politan Water District to construct said l4-inch service
connection on the Santiago lateral at Station 201+88, in the
manner and upon the conditions hereinabove set forth, and
shall have approved and authorized the payment of their pro-
portionate share, as hereinabove set forth, of the costs of
the construction of said connection, and shall have authorized
and approved the joint operation and maintenance of said con-
nection upon such terms and conditions as shall, from time
to time, be agreed upon by the City of Anaheim, the Orange
County Municipal Water District and the City of Orange.

b. The City of Anaheim shall have requested The
Metropolitan Water District to construct said service con-
nection in the manner and upon the terms and conditions
prescribed in this resolution, said request by the City of
Anaheim to be in form satisfactory to the General Counsel
of The Metropolitan Water District.
c. The City of Anaheim shall have agreed to pay
or reimburse to The Metropolitan Water District one-third of
all costs of providing, constructing and installing said
service connection in accordance with the provisions of this
resolution, and shall have deposited, pursuant to said agree-
ment, the sum of $6,000 with ihe Metropolitan Water District,
said agreement by the City of Anaheim to be in form satis-
factory to the General Counsel of The Metropolitan Water
District.

AND BE IT FURTHER RESOLVED that the Mayor and the
City Clerk be, and they are hereby, authorized to execute on
behalf of the City of Anaheim an agreement or agreements
necessary or proper to be entered into by and between The
Metropolitan Water District and the City of Anaheim, and by
and between the Orange County Municipal Water District, the
City of Orange and the City of Anaheim, in order to carry
out the terms and provisions of this resolution and provide
for the construction of and payment for said water service
connection in the manner and subject tothe terms and condi-
tions herein set forth.
BE IT FURTHER RESOLVED that the City Treasurer be,
and she is hereby, authorized and directed to deposit the sum
of $6,000 with The Metropolitan Water District for the pur-
poses hereinabove set forth, and in order to carry out the
terms and provisions of this resolution.
That RESOLUTION NO. 3491 adopted by the City Council
of the City of Anaheim be, and the same is hereby, rescinded.
THE FOREGOING RESOLUTION is approved and signed by
me this 9th day of October, 1956.
