A RESOLUTION CF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT A
CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS
OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2
OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED
TO ACCOMPLISH SAID CHANGE OF ZONE.
WHEREAS, the City Planning Commission of the City of
Anaheim has heretofore duly passed and adopted a resolution
recommending denial of a change in the boundaries of the zone
or zones hereinafter mentioned and described, after baying fixed
a time and place for the holding of a public hearing thereon
in the manner and as prescribed in Article IX, Chapter 2 of the
Anaheim Municipal Code, and after havino duly held and conducted
such public hearing to consider said proposed change of zone or
zones, and after having received evidence and reports from
persons interested therein; and
WHEREAS, within a period of forty (40) days following
the hearing thereon, the Planning Commission did duly announce
by formal resolution its findings of facts and declare its
opinions and reasons for recommending that said proposed change
in the boundaries of the zone or zones hereinafter mentioned and
described be denied; and
WHEREAS, upon receipt of the report and recommendation
of the City Planning Commission, the City Council did thereupon
fix the 31st day of May, 1960, as the time and the Council Chamber
in the City Hall of the City of Anaheim as the place for a public
hearing upon said proposed change of zone, and did give notice
thereof in the manner and as provided in said Article IX, Chapter
2 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such public
hearing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports, and did thereupon
consider the recommendations of the City PlanningCommission; and
WHEREAS, the City Council does find and determine that
the property and area proposed to be changed from the zone in which
it is now situated to a different zone, as hereinafter set forth,
is more suitable for the zone or zones to which it is proposed to
change said property and area and that the inclusion of said prop-
erty and area in such new zone or zones will increase the value of
said property and area and will not depreciate the values of prop-
erty in adjoining zones.
NOW, THEREFORE, BE IT RESOLVED by tbe City Council of
the City of Anaheim that all of the property and area situatec
in the City of Anaheim, County of Orange, State of California,
described as follows, to wit:

be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE to C-3,
HEAVY-COMMERCJPI, ZONE, upon the following conditions:
1, That the owner of subject property deed to the
City of Anaheim a strip of land 53 feet in width,
from the center line of the street, along Bali
Road for street widening purposes.
2. (a)That all engineering requirements of the City
of Anaheim, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities,
or other appurtenant work be complied with as
required by the City Engineer and in accordance
witb standard plans and specifications on file
in tle office of the City Engineer; and (b) that
a bond in an amount and form satisfactory to the
City of Anaheim be posted with the City to guar-
antee the installation of said engineering
requirements.
PARCEL 1: The Northerly 182.13 feet of the
Easterly 131.15 feet of the Northeast quarter
of the Northeast quarter of the Northeast
quarter of Section 24, in Township 4. South,
Range 11 West, in the City of Anaheim, as
shown on a map thereof recorded in book 51,
page 11, Miscellaneous Maps, records of said
Orange County;
EXCEPTING THEREFROM any portion of said land
which is included within the pumping plant
located on the Northeast quarter of the North-
east quarter of the Northeast quarter of said
Section 24, as referred to in the deed from
Louis Riehl, et al, recorded September 26, 1923,
in book 1489, page 143, Deeds, records of said
Orange County;
3. That the owner of subject property pay to the
City of Anaheim the sum of $2.00 per front foot,
along both Dail Road and Magnolia Avenue, for
street lighting purposes.
That subject property be developed in accordance
with the plans presented to the City Council and
on file with the City of Anaheim.
5. That all of the above conditions, with the excep-
tion of Conditions No. 2(a) and L, be complied
with within a period of 90 days from date hereof,
or such further time as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be,
and he is hereby authorized and directed to prepare and submit
to the City Council an amendment to Article IX, Chapter 2 of
the Anaheim Municipal Code to amend said Anaheim Municipal
Code to accomplish the object herein found and determined to
be necessary and proper.
