RES-2025-020RESOLUTION NO. 2025- 0 2 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM PROVIDING SUPPLEMENTAL WAGE AND BENEFITS TO CITY EMPLOYEES CALLED TO INVOLUNTARY ACTIVE -DUTY MILITARY SERVICE WITH THE UNITED STATES ARMED FORCES WHEREAS, the City of Anaheim currently provides fully paid leaves of absence and continuation of benefits for a maximum of thirty (30) calendar days per fiscal year to employees who have been in City service for at least one (1) year and are ordered to report to active duty in the United States military; and WHEREAS, a number of City of Anaheim employees have been, and other employees may be, called into involuntary active military service; and WHEREAS, the City Council of the City of Anaheim desires to alleviate financial hardships that employees and their families may experience as a result of being called to active military duty for over 30 calendar days in a fiscal year. WHEREAS, the City Manager has the authority to make decisions regarding compensation and benefits; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. In addition to the fully paid military leave currently provided by the City of Anaheim in accordance with the provisions of the Military and Veterans Code of the State of California §389-999.5, the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), 38 U.S.C. §4301-4335, and with all federal provisions (Public Law §93-508), each full-time City employee who is eligible to receive such paid leave, and who has been, or is in the future, called to involuntary active military service with the Armed Forces of the United States, shall be entitled to leave with partial pay pursuant to the terms of this Resolution for the period of absence while on active military duty in excess of the period covered by current paid military leave provisions. 2. The amount of pay each employee shall be entitled to receive from the City for the additional (beyond 30 calendar days) period of military leave shall be the difference between the i) gross regular rate of pay that the employee would have received from the City of Anaheim, (subject to all required and appropriate deductions and withholdings) if they had not been called to active military duty, and ii) the gross pay and allowances actually received by the employee from the United States for the military service. 3. The City shall provide continued employer contribution for health and welfare benefits to employees' dependents during the period of active involuntary military service, provided that the dependents were covered for such benefits prior to the employee being called to active duty. 4. That wage or benefits authorized by this Resolution are conditioned upon the employee requesting such payment and providing satisfactory proof and documentation of eligibility and salary difference owed, to receive payment in accordance with procedures established by the Human Resources Director. 5. The pay and benefits authorized by this Resolution shall begin on January 1, 2025, and terminate on December 31, 2025, unless extended, in writing by the City Manager and filed with the Human Resources Director. 6. This Resolution further authorizes the City Manager to supplement future wages and benefits of employees who are called to involuntary active duty, for a period of one (1) year, unless extended, provided such decision is in writing, filed with the Human Resources Director, and consistent with the stated terms and established procedures. 7. The effective date of this Resolution shall be January 1, 2025.
