A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIF AUTHORIZING THE EXCHANGE
OR CERTAIN PROPERTY OWNED BY THE CITY OF
.ANAHEIM FOR CERTAIN PROPERTY OWNED BY
MORAGA- FULTON BUILDING COMPANY.
WHEREAS, Noraga- Fulton Building Company, a limited
partnership, is the owner of the f.Alcving described property
situated in the City of .Anaheim, County of Orange, State of
California, to wit:

Parcel 1:
That portion of the Easterly 10.5 acres of the Southwesterly
4 of the Northeasterly of Section 7, Township 4 South,
Range 10 West, in the Rancho Los Coyotes, in. the City of
Anaheim, County of Orange, State of California, as said
Section is shown on map recorded in Book 51, Page 10 of
Niscellaneous Maps, in the office of the County Recorder of
said County, lying Northerly of the following described line;
Beginning at a point in the West line of said Northeasterly
4 distant thereon South 0 East 534.95 feet from the
Westerly prolongation of the South line of Tract No. 1161 as
per map recorded in Book 36, Pages 145 and 46 of Miscellaneous
Naps, in the office of the County Recorder of said County;
thence North 88° 34 East8L4,25feet; thence North 1 25'35"
West 32.00 feet; thence North 8S°314' 25" East 299.64 feet
to the beginning of a tangent curve concave Southwesterly
having a radius of 300.00 feet; thence Southeasterly along
said curve to the East line of said Southwesterly quarter.
Parcel 2:
That portion of the Southwesterly quarter of the Northeasterly
quarter of Section 7, Township 4 South, Range 10 West, in
the Rancho Los Coyotes, in the City of Anaheim, County of
Orange, State of California, as said Section is shown on map
recorded in Book 51, Page 10 of Miscellaneous Maps, in the
office of the County Recorder of said county, lying Northerly
of a line that bears North 88 34'25" East from a point in
the West line of said Northeasterly quarter distant thereon
South 0 °46'50" Eastt534.95 feet from the Westerly prolong-
ation of the South line of Tract No. 1161 as per map recorded
in Book 36, Pages 145 and 4 of Niscellaneous Maps, in the
office of the County Recorder of said County.
EXCEPT that portion lying East of the West line of the East
10.50 acres of said Southwesterly quarter.
ALSO EXCEPT that portion thereof included within the following:
Beginning at the intersection of the West line of said North-
east K with the Westerly prolongation of the South line of
Tract No. 1161, as per map recorded in Book 36, Pages 45 and
46 of Miscellaneous Naps, in the office of the County Recorder

said West line; thence North 88 East 8214.25 feet;
thence North 0 West 371.85 feet tc the beginning of a
tangent curve concave Southwesterly and having a radius of
200.00 feet; thence Northwesterly 83.10 feet along said curve
through a central angle of 2.3"21 to the beginning of a
reverse curve concave Northeasterly and having a radius of
200.00 feet; thence Northerly 83.10 feet along said reversecur
through a central angle of 23 °L1- 8'24." to a line tangent;

AND WHEREAS, The City of Anaheim is the owner of the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:

That portion of the Southeasterly of the Northeasterly 4
of Section 7, Township L South, Range 10 West, in Rancho
Los Coyotes, in the City of Anaheim, County of Orange, State
of California, as said Section is shown on map recorded in
Book 51, Page 10 of Iviscellaneous Naps, in the office of the
County Recorder of said County, described as follows:
Beginning at a point in the West line of said Northeasterly
distant thereon South 0 East 534.95 feet from the
Westerly prolongation of the South line of Tract No. 1161
as per map recorded in Book 36, Pages L5 and 46 of Miscel-
laneous Naps, in the office of the County Recorder of said
County; thence North 88 34'25" East 111 feet; thence
North 1 2.5 1 35" West 32.00 feet to the beginning of a curve
concave Southwesterly having a radius of 300.00 feet, the
radial at the beginning of said curve bearing North 1°25t35"
West; thence Southeasterly along said curve 188.65 feet
more or less to a point in the West line of said Southeasterly
said point being the true point of beginning; thence
continuing Southeasterly along said curve 286.10 feet to a
line tangent to said curve and parallel with the West line
of said Southeasterly thence along said parallel line

That portion of the Southwesterly of the Northeasterly
of Section 7, Township L;- South, Range 10 West, in the Rancho
Los Coyotes, in the City of Anaheim, County of Orange, State
of California, as said Section is shown on map recorded in
Book 51, Page 10 of Miscellaneous Maps, in the office of the
County Recorder of said County, described as follows:
Beginning at a point in the West line of said Northeasterly
distant thereon South 0 °46'50" East 5311.95 feet from the
Westerly prolongation of the South line of Tract. No. 1161 as
per map recorded in Book 36, Pages 1.15 and i.6 of Miscellaneous
Naps, in the office of the County Recorder of said County;
thence North 88 31'25" East 81;_1 feet to the true point
of beginning; thence North 0 West 32.00 feet; thence
South 88 °34'25" West 27)1 feet; thence South 1 25 1 35"
Fast 32.00 feet; thence North 88 °3 L1 1 23" East 273.65 feet to
the true point of beginning.
AND WHEREAS, the above described property presently owned
by the City of Anaheim is separated from other property of the
City of Anaheim; and
WHEREAS, the property o.i Forage- Fulton Building Company
hereinabove described, is contiguous to other property owned by
the City of Anaheim, and the exchange of the properties, herein
above described, would enable the City to use the property more
advantageously; and
hHE.REAS, the ltoraga- Fulton Building Company is willing to
exchange the above described property awned by it for the above
described property owned by the City of Anaheim and the sun of
$36,057.08 cash, lawful Loney of the United. States; and
WHEREAS, the City Council finds that it would be to the
advantage and for the best interests of the City of Ana11ei, and
the citizens and residents thereof, to exchange said properties
as above set forth, and to pay to Moraga- Fulton Building Company
the sun of .$36,057.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the
City of Anaheim that the property hereinabove described, owned
by the City of Anaheim, be exchanged for the property, herein-
above described, owned by Noraga- Fulton Building Company, and
that the Mayor and the City Clerk be, and they are hereby,
authorized and directed to execute a deed conveying said property
owned by the City of Anaheir to Ioraga- Fulton Building Company,
and to deliver said deed into escrow at the California Bank,
Anaheim Office, Anaheim, California, to be delivered to Moraga-
Fulton Building Company when a good and sufficient deed has been
executed conveying to the City of Anaheim the property herein
above described owned by Eoraga- Fulton Building Company, and
delivered into escrow at the California Bank, Anaheim Office,
Anaheim, California, and when title to said property can be
conveyed to the City of Anaheim, free and clear of all encum-
brances except covenants, conditions, restrictions, reservations,
rights of way and easements of record approved by the City
Attorney, and all general and special taxes for the fiscal year
1960 -61, including any special district levies payment of which
is included therein and collected therewith;
BE IT FURTHER RESOLVED that the City Auditor be and he is
hereby authorized to deposit in escrow at said Bank of California
the sum of $36,057.08 cash, lawful money of the United States,
to be paid to said Noraga-Fulton Building Company at the time the
deed, hereinabove mentioned, conveying the property owned by the
City of Anaheim is delivered to said Moraga Fulton Building
Company.
BE IT FURTHER RESOLVED that the grantor of the respective
parcels of property shall furnish a policy of title insurance
issued by Orange County Title Insurance Company showing ti tle
vested in the grantee, free and clear of all encumbrances, except
covenants, conditions, restrictions, reservations, rights of way
and easements of record; and all general and special taxes for
the fiscal year 1960 -61, including any special district levies,
payment of which is included therein and collected therewith;
and that the policy covering the property vested in the Morale,-
Fulton Building Company shall be issued in the amount of $211_,30L.50,
and the policy issued to the City of Anaheim shall guarantee title
in the amount of $60,361.53;
BE IT FURTHER RESOLVED that the City Manager be and he is
hereby authorized and directed to sign escrow instructions for
and on behalf of the City of Anaheim at the California Bank,
Anaheim Office, Anaheim, California, in accordance with the
provisions of this resolution.
THE FOREGOING RESOLUTION is signed and approved by me
this 13 day of September, 1960.
