A RESOLUTION O F THE CITY COUNCIL OF THE CITY
OF ANAHEIM`: AUTHORIZING THE PURCHASE AND ACQUISI-
TION OF CERTAIN REAL PROPERTY FOR MUNICIPAL
PURPOSES.

WHEREAS, L. B. HARBOUR, JR. and RUTH I. HARBOUR, his
wife, MERRILL BUTLER, JR. and SALLY R. BUTLER, his wife, F. C.
HARRINGTON and JUANITA HARRINGTON, his wife, C. GILMORE WARD
and NILDRED E. WARD, his wife, and CHARLES W. HESTER and NCRA L.
HESTER, his wife, are the owners of the hereinafter described
real property situated in the City of Anaheim, County of Orange,
State of California; and
WHEREAS, said owners have offered to sell said pro-
perty to the City of Anaheim for the sump of $16,056.50 cash,
lawful money of the United States; and
WHEREAS, the City Council does find and determine that
public convenience and necessity require the purchase and acqui-
sition of said parcel of real property for municipal purposes,
and that the price which the owners thereof are willing to
accept is reasonable and not out of proportion to the fair
market value of said property;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of L. B. HARBOUR, JR. and
RUTH I. HARBOUR, his wife, NERRILL BUTLER, JR. and SALLY R.
BUTLER, his wife, F. C. HARRINGTON and JUANITA HARRINGTON, his
wife, C. GILNORE WARD and MILDRED E. WARD, his wife, and
CHARLES W. HESTER and NORA L. HESTER, his wife, to sell to the
City of Anaheim all that certain real property situated in the
City of Anaheim, County of Orange, State of California, des-
cribed as follows, to wit:
That portion of the West half of the Southeast
quarter of the Southeast quarter of Section 7,
Township L} South, Range 10 West, in the Rancho
Los Coyotes, as shown on a Map recorded in BoDi
51, Page 10 of Miscellaneous Maps, Records of
Orange County, California, described as follows:
Beginning at the Northwesterly corner of Lot B of
Tract No. 2.625, as shown on a Map recorded in Book
9L Pages 9 to 11 of Miscellaneous Maps, Records of
Orange County, California; thence along the West
line of the Southeast quarter of the Southeast
quarter of said Section 7, North 0° 16' 57" West
227.92 feet to the Northwest corner of said West
half; thence along the North line of said West half
North 89° 25 29" East 1 feet to a point distant
along said North line South 89° 25 29" Vest 165.02
feet from the Northeast corner of said West half;
thence South 0° 16' 20" East 90.16 feet to the
Northwesterly line of Lot E of said Tract No. 2625;
thence along the boundaries of said Tract No. 2.625,
South 67° 23' 02" West 11 feet, South 89° 01 59"
West 208.67 feet, South. 0 16' 57" East 118.80 feet
and South 89° 01' 59" West 247.W feet to the point
of beginning,

for the sum of $16,056.50 cash, lawful money of the United
States, be, and the same is hereby accepted, subject to the
following terms and conditions:
That subject property shall be conveyed to the City
of Anaheim free and clear of all encumbrances except
all general and special taxes for the fiscal year
1960 -61, and covenants, conditions, restrictions,
reservations, rights, rights of way and easements
of record approved by the City Attorney.
BE IT FURTHER RESOLVED that the City Manager of the
City of Anaheim be, and he is hereby, authorized for and on
behalf of the City of Anaheim to sign escrow instructions for
the purchase of said real property, and to enter into an escrow
with the owners of said property at Orange County Title Company,
Main Street at Fifth, Santa Ana, California.
BE IT FURTHER RESOLVED that the City Auditor be, and
he is hereby, authorized to deposit in escrow at Orange County
Title Company, Main Street at Fifth, Santa Ana, California, the
sum of $16,056.50 cash, lawful money of the United States, to be
paid to the Sellers hereinabove named when a deed conveying said
property to the City of Anaheim, free and clear of all encum-
brances, except as hereinabove set forth, can be recorded and a
policy of title insurance issued by Orange County Title Company,
showing said property vested in the City of Anaheim free and
clear of all encumbrances, except as hereinabove specified.
BE IT FURTHER RESOLVED that the Sellers shall pay the
usual and customary Sellers' charges for furnishing a policy of
title insurance necessary to show title vested in the City of
Anaheim, as herein provided, and that the City of Anaheim shall
pay the usual Buyer's share in the purchase of said property.
THE FOREGOING RESOLUTION is approved and signed by me
this 6th day of September, 1960.

AND I FURTHER CERTIFY that the Mayor of the City of Anaheim
approved and signed said Resolution No. 6263 on the 6th day of
September, 196Q.
