A RESOLUTION OF TFTE CITY COUNCIL OF THE CITY
OF ANAHEIM' FINDING AND DETERMINING THAT A
CHANGE GE OF ZONE IS NECESSARY IN CERTAIN AREAS
OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2
OF THE ANAHEIM' MUNICIPAL CODE SHOULD DE
AMENDED TO ACCO 'LIS; SAID C U GE OF ZONE.
WHEREAS, tl e C i.'; 1ann i ng Commission of the City
of Anaheim has h 'r c tofor duly passed and adopted a resolution
recommending denial of a change in the boundaries of the zone
or zones hereinafter mentioned and described, after having
fixed a time and place for the holding of a public hearing
thereon in the manner and as prescribed in Article IX, Chapter
2 of the Anaheim i-lunicioal Code, and after having duly held and
conducted such public hearing to consider said proposed change
of zone or zones, and after having received evidence and re-
ports from persons interested therein; and
WHER AS, within a period of forty ('!.0) days following
the hearing thereon, the Planning Conmi ss ion did d u l y announce
by formal resolution its f indi.nns of facts and declare its
opinions and reasons for recommending denial of said proposed
change i the boundaries of the zone or zones hereinafter men-
tioned and described; and
WHEREAS, upon receipt of the report and recommendation
of the City Planning Commission, the City Council did there
upon fix the 9th day of August, 1960, as the time and the Council
Chamber in the City Hall of the City of Anaheim as the place for
a public hearing upon said proposed chance of zone or zones
and did give notice thereof ;of in the manner and as provided in
said Article I', Chapter 2 of the Anaheim Municipal Code; and
WHEREAS, at the time and plat fixed for said public
hearing, the City Council did duly hold and conduct such public
hearing and did give; all persons interested therein an oppor-
tunity to be beard and did receive evidence and reports and did
thereupon consider the recommendations of the City Planning
Commission; and
WHEREAS, the City Council does find and determine that
the property and area proposed to be changed from the zone in
which it is now situated to a different zone, as h
set forth, is nor: suitable for the zon or zones to which it
is proposed Lo change said property` and area and that the in-
clusion of said property and arca in such new zone or zones will
increase the value of sold property and area and will not
preciat e'. the values of propz%r ty in adjoining zon

be changed from R -A, RESIDENTIAL AGRICULTURAL ZONE to C -3 HEAVY
COMMERCIAL ZONE upon the fo

1. That the use of subject property be limited to a wheel
alignment and brake service business only. No other
auto repair business nor any C -1 uses shall be permitted.
2. That the owner of subject property deed to the City of
Anaheim a strip of land 53 feet in width from the center
line of the street, along La Palma Avenue, for street
widening purposes.
3. (a) That sidewalks be installed as required by the City
Engineer and in accordance with standard plans and speci-
fications on file in the Office of the City Engineer;
and (b) that a bond in an amount and form satisfactory
to the City of Anaheim be posted with Lhe City Lo guar
antee the installation of sa sidewalks.
4. That the owner of subject property pay to the City of
Anaheim the sum of $2.0C per front foot for street
lighting purposes.
r- That the owner of subject property place of record
standard City of Anaheim C-3 Deed Restrictions, approved
by the City Attorney, which restrictions shall limit the
use of property to a wheel alignment, and brake service
business only.
6. That Conditions Hos. 2, 3 (b), L. and ,,above- mentioned,
be complied. with within a period of 90 days from date
hereof, or such further time as the City Council may
grant.
BE IT FURTHER RESOLVED that the City Attorney be and he
is hereby authorized and directed to prepare and submit to the
City Council an amendment to Article IX Chapter 2 of the Anaheim
Municipal Code to amend said Anaheim Municipal Code to accomplish
the object herein found and determined to be necessary and proper.
