A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING VARIANCE NO. 1259
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
PATRICIA E. LINTON, owner of certain
real property situated in the City of Anaheim, County of Orange,
State of California, described as follows:
Lot 16 of Tract No. 483, as per map thereof
recorded in boo'-:. 17, page 20 of Miscellaneous
Maps, records of Orange County, California.;
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on July 5, 1960 9 notices of which said
public hearing were duly given as required by law and the provi-
sions of Section 9200,17 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due in-
spection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. 2 Series
1960 -61 recommending that Variance No. 129 be denied;
and
WHEREAS, thereafter, within twenty (20) days from the
date of the adoption of said resolution, a written appeal was filed
with the City Council of the City of Anaheim protesting the action
of the City Planning Commission denying said variance, and said
appeal was set for public hearing on August 16 19L at
7:00 o'clock P. M. at the City Hall in the City of Anaheim, and
notice of such public hearing was duly given as required by law and
the provisions of Section 9200.17 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by it-
self and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council does
find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the prop-
erty involved or to the intended use of the
property that do not apply generally to the
property or class of use in the same vicinity
and zone.
2. That such a variance is necessary for the pre-
servation and enjoyment of a substantial prop-
erty right possessed by other property in the
same vicinity and zone and denied to the prop-
erty in question.

Tt t the granting of such variancE will not
be materially detrimental to the public
welfare or injurious to the property or
improvements in such vicinity and zone in
which the propery is located.
That the granting of such variance will not
adversely affect the comprehensive general
zoning plan.
NO4, THEREFORE, DE IT RESOLVED by the City Council of the
City of Anaheim that a co ditional zoning variance be, and the same
is hereby granted to PATRICIA E. LII 1765 WEST LA PALMA AVET
ANAHEIM, CALIFORNIA, permitting the removal of the three houses
now located on the property bereinsbove described, and the con-
struction of a single-family residential building on said property,
subject to the following conditions:
1. That said single-family residential building shall
be constructed in accordance with the plans sub-
mitted to the City Council and on file with the
City of Anaheim.
2. That a strip of land 53-feet in width, from the
centerline of the street along La Palma Avenue,
shall be deeded to the City of Anaheim for street
widening purposes.
3. That sidewalks shall be installed along La Palma
Avenue as required by the City Engineer and in
accordance with standard plans and specifications
on filo in the office of the City Engineer.
That a bond, in an amount and form satisfactory
to the City of Anaheim, be, posted with tt City
to guarantee the installation of said sidewalks,
the removal of the houses above mentiond, and
the completion of any engineering requirements
as required by the City Engineer.
That the sum of 52.00 per front foot shall be
paid to the City of Anaheim, to be used for
street lighting purposes.
The City Council bcreby reserves the right to revolve
such variance pemit for good cansc or failure of said owner,
her hairs, successors or assigns, to comply with the Anaheim
Code and regulations and the conditions horein. Said
variance is granted for the term prescribed by the Anaheim Muni-
cipal Code unless otherwise specified herein.
