A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING VARIANCE NO. 1267.
WHEREAS, the City Planning Commission of the City
of Anaheim: did receive a petition for zoning variance from
uESTPORT DEVELOPMENT COIPANY, owner of certain real property
situated in the City of Anaheim., County of Orange, State of
California, described as follows:
That portion of the Southeast quarter of Section 5, in
Township 4 South, Range 10 West, in the Rancho San Juan Cajon
de Santa Ana,as shown on a map recorded in book 51, page 10,
I".iscellaneous Ih aps, records of Orange County, California, de-
scribed as follows:
Beginning at the intersection of the center lines of
La Palma and Euclid (formerly Nicholas) Avenues, as
shown on the map of Tract No. 403, recorded in boo. 17,
page 20, Iiscellaneous Maps, records of said Orange
County, and running thence North 0 02 23" East along
said center line of Euclid Avenue, 103.50 feet to the
Northeast corner of said Tract No. 403, thence North
39° 551 37" along the North line of said Tract No.
433, 393.00 feet to the true point of beginning of the
boundary of the land described herein; thence North
0° 02 23" East parallel with said center line of Euclid
Avenue, 170.b.3 feet to a point in a curve concave South-
easterly and having a radius of 160.00 feet, a radial line
to said point bearing South. 35 351 x8" East; thence North-
easterly along said curve through a central angle of
35° 40' 11" an arc distance of 1 ?1.59 feet to the end
of said curve; thence North 0 °02 23" East parallel with
said center line of Euclid Avenue 106.50 feet to the
North line of the land described in the deed to Clarence
Beatty Neighbors and others, recorded December 30, 1949,
in book 19L8, page 265, Official Records; thence along
said North line, North 89° 551 37" West 1350.02 feet to
the Northwest corner of the land described in said Deed
to Clarence Beatty Neighbors; thence along the oest line
of said land South 0° 02 23" West 406.50 feet to the
Northwest corner of said Tract No. 403; thence along the
North line of said Tract, South. 89° 551 37" East 1252.00
feet, more or less, to the true point of beginning;
AND WHEREAS, the City Planning Cor,Imission did hold a
public hearing at the City Hall in the City of J\naheir: upon said
petition on July 18, 1960, notices of which said public hearing
were duly riven as required by law and the provisions of Title
13, Chapter 13.76 of the Anaheim_ I=uni.cipal Code; and
WHEREAS, said City Planning Corr_r after due in-
spection, investigation and studies Trade by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. 20, Series
1900 -61, recoieD ending that Variance No. 1267 be granted upon
the conditions stated in said resolution; and

WHEREAS, thereafter, within twenty (20) days from the
date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action taken by the
City Planning Commission and did set a public hearing thereon
to be held on the 16th day of August, 1960, at 7:00 otclocxk
P. N. in the City Hall in the City of Anaheim., and notice of
such public hearing was duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheii+,Nunicipal
Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all
the evidence and reports offered at said hearing, the City
Council does find and determine that:
1. There are exceptional or extraordinary circumstances
cr conditions applicable to the property involved or
to the intended use of the property that do not apply
generally to the property or class of use in the same
vicinity and zone.
1. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted to i; ESTPORT DEVELOPiv:ENT COMPANY,
12863 Palm Street, Garden Grove, California, permitting the
construction of 2 -story apartment buildings on all lots which
may be cut from the above- described property.
The City Council hereby reserves the right to revoke
such variance pc rrrit for good cause or failure of said owner,
its successors cr assigns, to comply with the AnaheimNNuni.cipal
Code and regulations and the conditions herein. Said variance
is granted for the term prescribed by the Anaheim Nunicipal Code
unless otherwise specified herein.
THE FOREGOING RESOLUTION is signed and approved by
me this 16th day of August, 1960,
2. That such a variance is necessary for the preservation
and enjoyment of a substantial property right possessed
by other property in the same vici gnd zone and
denied to the property in quest.i
3. That the granting of such variance not be mater-
ially detrimental to the public welfare or injurious
to the property or improvements in such vicinity and
zone in which the property is located.
