AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING SECTION 1.04.960 OF CHAPTER 1.04
OF TITLE 1 TO CHANGE THE NAME OF THE SENIOR
CITIZEN COMMISSION TO THE OLDER ADULTS
COMMISSION AND REPEALING SECTION 13.04.035 OF
CHAPTER 13.04 OF TITLE 1 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO THE PARKS AND RECREATION
COMMISSION
WHEREAS, in 1980, a seven -member Anaheim Senior Citizen Commission was
established by the City Council as an advisory body to make recommendations to the City
Council concerning the needs of senior citizens in the community; and
WHEREAS, in 2010 the City Council voted to dissolve the Senior Citizen Commission
but later re-established the Commission in 2017 to meet the needs of the community; and
WHEREAS, at the Senior Citizen Commission meeting of January 16, 2025, the
Commission recommended to the City Council that its name be changed to the Older Adults
Commission; and
WHEREAS, the recommendation was grounded in building better public perceptions of
aging; and
WHEREAS, the City Council desires to change the name of the Senior Citizen
Commission to the Older Adults Commission; and
WHEREAS, the changes to the name of the commission requires changes to certain
existing provisions of Chapter 1.04 of the Anaheim Municipal Code; and.
WHEREAS, Chapter 13.04.035 of the Municipal Code references a Senior Citizen
Advisory Subcommittee which was dissolved when the Senior Citizen Commission was re-
established in 2017 and Chapter 13.04.035 is being deleted to reflect this change.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
ORDAIN AS FOLLOWS:
SECTION 1.
Section 1.04.960 of the Anaheim Municipal Code is hereby deleted in its entirety and
replaced with the following, to read in full as follows:
"1.04.960 OLDER ADULTS COMMISSION.
.010 Establishment. The Older Adults Commission is hereby established pursuant to
Section 900 of the Charter of the City of Anaheim.
020 Composition. The Older Adults Commission shall consist of seven (7) members.
.030 Qualifications. Each member of the Commission shall be sixty (60) years of age
or older, a resident of the City of Anaheim at the time of appointment and during the entire
tenure of service on the Commission, and shall not hold any paid office or employment in the
City government.
.040 Term of Office. Each member of the Commission shall serve a term that runs
concurrently with the current term of the elected official who appointed the member and until his
or her successor is appointed and qualified.
.050 Unscheduled Vacancies. Any vacancy occurring before the expiration of the term
of a Commission member shall be filled by appointment for the remainder of such term. The
vacancy shall be filled by the affirmative vote of the elected official who appointed the member
at a public meeting.
.060 Organization, Meetings and Procedures.
.0601 The Commission shall elect one of its members as a chairperson on an annual
basis, which chairperson shall preside at meetings of the Commission and shall serve at the
pleasure of the Commission. The Commission shall also elect one of its members as a vice -
chairperson on an annual basis, which vice -chairperson shall preside at meetings from which the
chairperson is absent.
.0602 The Commission shall meet regularly at least six times each year and shall hold
such other meetings as from time to time shall be called in the manner and form required by law.
Meetings shall be conducted in accordance with Section 904 of the Anaheim City Charter.
Regular meeting dates and times shall be established by the Commission. A majority of the total
number of members of the Commission then in office shall constitute a quorum.
.0603 The meetings and procedures of the Commission shall be subject to and governed
by the resolutions and ordinances of the City Council establishing rules and regulations for City
boards and commissions.
.070 Powers and Duties. The Older Adults Commission shall act in an advisory
capacity and shall have the power and duty to:
.0701 Advise the City Council as to the needs of older adults within the community and
make recommendations to the City Council of possible City or community projects that would
directly affect Anaheim older adults;
.0702 Meet at least six times per year to act on matters referred to it by the City Council
and receive input regarding older adult needs and projects that would assist in meeting those
needs; and
.0703 Perform such additional functions as may be delegated or required by the City
Council from time to time.
.080 No Compensation. Members of the Commission shall serve without
compensation.
SECTION 2.
That Section 13.04.035 of Chapter 13.04 of Title 1 of the Anaheim Municipal Code be,
and the same is hereby, repealed, in its entirety, to reflect the 2017 dissolution of the Senior
Citizen Advisory Subcommittee of the Parks and Recreation Commission.
SECTION 3. SEVERABILITY.
If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be
invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby
declares that it would have passed this Ordinance, and each and every section, subsection,
sentence, clause or phrase not declared invalid or unconstitutional without regard to whether any
portion of the ordinance would be subsequently declared invalid or unconstitutional.
SECTION 4. SAVINGS CLAUSE.
Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in
any manner affect the prosecution for violations of ordinances which violations were committed
prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the
penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as
they are substantially the same as ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and continuations, and not as new
enactments.
SECTION 5. CERTIFICATION.
The City Clerk shall certify to the passage of this ordinance and shall cause the
same to be printed once within fifteen (15) days after its adoption in the Anaheim
Bulletin, a newspaper of general circulation, published and circulated in the City of
Anaheim, and thirty (30) days from and after its final passage, it shall take effect and be
in full force.
THE FOREGOING ORDINANCE was introduced at a regular meeting of the
City Council of the City of Anaheim held on the 2 5 th day of
March 2025, and thereafter passed and adopted at a regular meeting of said
City Council on the 8th day of April 2025, by the following roll call
vote:
