1960-6211RESOLUTION NO. 6211 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING SPECIAL USE PERMIT NO. 78 TO FIRST BAPTIST CHURCH OF ANAHEIM. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from the First Baptist Church of Anaheim, 701 West Broadway, Anaheim, California, for a Special Use Permit to demolish and remove the church build- ings now situated on the following described property and replace them with new church buildings (social hall and educational wings): All that certain land situated in the City of Anaheim described as follows: PARCEL 1. That portion of Vineyard Lot E6, as shown on a map recorded in Book 4, Pages 629, and 630 of Deeds, Records of Los Angeles County, California, described as follows: Beginning at the Northeasterly corner of Citron Street and Broadway, said Northeasterly corner being 41.75 feet North 15 30' West from the Southwest corner of Vineyard Lot E6, thence Northerly on the East line of Citron Street 130 feet to an alley; thence Easterly, parallel with Broadway, 90 feet; thence Southerly parallel with Citron Street, 130 feet to the Northerly line of Broadway; thence Westerly on the Northerly line of Broadway, 90 feet to the point of beginning. PARCEL 2. That portion of Vineyard Lot E6, as shown on a map recorded in Book L Pages 629, and 630 of Deeds, Records of Los Angeles County, California, described as follows: Beginning at a point on the Northerly line of West Broadway 90 feet Easterly from the intersection of the said Northerly line of West Broadway and the Easterly line of South Citron Street; thence Northerly parallel to said Easterly line of South Citron Street, 130 feet to the Southerly line of a 20 -foot alley; thence Easterly along said Southerly line, 55 feet; thence Southerly parallel to the Easterly line of South Citron Street, 130 feet to the present Northerly line of West Broadway; thence Westerly along said Northerly line 55 feet to the point of beginning. PARCEL 3. That portion of Vineyard Lot E6, as shown on a map recorded in Book Pages 629, and 630 of Deeds, Records of Los Angeles County, California, described as follows: -1 Commencing at a point on the East line of Citron Street, as said street is shown on a map of the Langenberger Tract recorded in Book 1, Pages 550 and 551 of Deeds, Records of Los Angeles County, California, 41.75 feet North of the Southwest corner of said Vineyard. Lot E6, said point being also the intersection of the East line of Citron Street and the North line of West Broadway, as established by Deed to City of Anaheim recorded in Book 166, Page 21,6 of Deeds; thence East on the North line of said West Broadway, 145 feet to the true point of beginning of the property herein described; thence North parallel with the East line of said Citron Street, 130 feet; thence East parallel with the North line of said West Broadway, 55 feet thence South parallel with the East line of said Citron Street, 130 feet to the North line of West Broadway; thence West on the said North line 55 feet to the true point of beginning. PARCEL 4. That portion of Vineyard Lot E6, as shown on a map recorded in Book 4, Pages 629 and 630 of Deeds, Records of Los Angeles County, California, described as follows: Beginning at a point on the South line of said Lot E6, 200 feet East from the Southwest corner of said Lot E6, thence from said point of beginning continuing along the Southerly line of said Lot E6, a distance of 55 feet; thence Northerly parallel with the Westerly line of said Lot E6 to an intersection with the Southerly line of a certain alley as conveyed by Frank Baum and wife, to the City of Anaheim by deed recorded May 23, 1924 in Book 524, Page 297 of Deeds; thence Westerly, along the Southerly line of said strip of land so conveyed to the City of Anaheim, a distance of 55.42 feet, more or less, to a point in a line drawn parallel to and distant 200 feet Easterly from the Westerly line of said Lot E6, thence Southerly on a line parallel to the Westerly line of said Lot E6, and 200 feet distant therefrom to the point of beginning. EXCEPTING that portion thereof within the lines of Broadway. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on July 5, 1960, notice of which said public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 7, Series 1960 -61, granting said Special Use Permit No. 78, subject to certain conditions set forth therein; and -2- WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Special Use Permit and did thereupon fix the 9th day of August, 1960 as the time and the Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said Special Use Permit, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that said Special Use Permit should be granted upon the terms and condi- tions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting Special Use Permit No. 78 be, and the same is hereby sustained, and that Special Use Permit No. 78 be, and the same is hereby granted to the FIRST BAPTIST CHURCH OF ANAHEIM, 701 West Broadway, Anaheim, California, to demolish and remove the church buildings now situated on the property hereinabove described and replace them with new church buildings (social hall and educational wings) upon the following condi- tions: 1. That the minimum front and side yard setback re- quirements be waived, permitting the setbacks as presently established. 2. That a strip of land 30 feet in width, from the center line of the street, along Citron Street, be deeded to the City of Anaheim for street widening purposes. 3. That the curbs, gutters and sidewalks on both Broadway and Citron Street, which are in a broken or hazardous condition, be repaired or recon- structed as required by the City Engineer of the City of Anaheim. The City Council hereby reserves the right to revoke such Special Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
