A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH ORANGE COUNTY FLOOD CONTROL
DISTRICT FOR THE EXCHANGE OF PROPERTY OWNED
BY THE CITY OF ANAHEIM FOR AN EASEMENT FOR
ELECTRIC TRANSMISSION LINES OVER AND ACROSS
CERTAIN PROPERTIES OF SAID DISTRICT.
WHEREAS, the City Council of the City of Anaheim does
find and determine that it is necessary and desirable to acquire
an easement over and across certain properties of the Orange
County Flood Control District for electric transmission wires
together with poles and guy wires; and
WHEREAS, said Orange County Flood Control District
is desirous of obtaining certain properties owned by the City
of Anaheim for the construction and maintenance of a flood
control channel in the City of Anaheim; and
WHEREAS, the City of Anaheim is interested in seeing
to the completion of said flood control channel;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the following described property owned
by the City of Anaheim, to wit:
A strip of land 105.00 feet wide in the north half of
the south half of Lot 15 in Block K of the Kraemer
Tract, in the county of Orange, state of California,
per map recorded in book 12, pages 87 and 88 of Mis-
cellaneous Records, in the office of the County Re-
corder of Los Angeles County, California, said strip
lying 52.50 feet on each side of the centerline which
is described as follows:
Beginning at a point on the centerline of La Palma
Avenue, distant N. 73° 09' 45" E., 413.52 feet from
its intersection with the centerline of Dowling Street
as said intersection is shown in County Surveyor's
Transit Book 123, page 40, on file in the office of
the Orange County Surveyor, said point being on the
arc of a non tangent curve in the line herein to be
described, said curve being concave easterly and having
a radius of 4000 feet, a radial line through said point
bearing N. 82° 18' 28" W.; thence from said point of
beginning Northerly 273.42 feet along said curve through
a central angle of 3° 54' 59 thence tangent to said
curve N. 11° 36' 31" E., 1290.26 feet to the beginning
of a tangent curve, concave westerly and having a ra-
dius of 4000 feet; thence Northerly 1261.91 feet along
said curve through a central angle of 18° 04' 32
thence tangent to said curve N. 6° 28' 02" W., 77.88
feet to a point on the centerline of Anaheim Road,
said point being distant N. 73° 08' 31" E., 1582.53
feet along said centerline from its intersection with
the centerline of Dowling Street as said point of in-
tersection is shown in County Surveyor's Transit Book
123, page 22 on file in the office of the Orange County
Surveyor.

EXCEPT therefrom that portion of said north half
lying northerly of a line parallel with and north-
erly 202.10 feet (measured along the east line of
said lot) from the south line of said north half.
RESERVING, however, to the grantors, their heirs,
successors and assigns, easements for the construc-
tion, operation and maintenance of road bridges,
railroad bridges, railroad spur tracks, pipe lines,
utility lines, and appurtenant structures so as to
provide access across District's Channel in, over
and upon the land granted herein; the exact location
of said easements to be mutually agreed upon be-
tween the Orange County Flood Control District and
the grantors, their heirs, successors or assigns.
It is further understood that no construction will be
commenced within said easements until the plans there-
for, submitted by a Civil Engineer, duly registered
as such by the State of California, have been first
approved in writing by the grantee's Flood Control
Engineer, and grantee agrees that such plans will be
approved or disapproved by said Engineer within a
reasonable time following receipt thereof, and that
approval will not be withheld without good cause.
Excepting therefrom all minerals, gas, oil, petroleum,
naptha and other hydrocarbon substances in and under
the above described strip of land, together with all
necessary and convenient rights to explore for,
develop, produce, extract, and take the same, subject
to the express limitation that any and all operations
for the exploration, development, production, extrac-
tion, and taking of any of said substances shall be
carried on at levels below the depth of 100 feet from
the surface of the above described strip of land, by
means of mines, wells, derricks and /or other equipment
from surface locations on adjoining or neighboring
land lying outside of the above described strip of
land, and subject further to the express limitation
that the foregoing reservation shall in no way be
interpreted to include any right of entry in and
upon the surface of the above described strip of
land;
be conveyed to the Orange County Flood Control District in ex-
change for an easement for electric transmission lines in ac-
cordance with the terms of an agreement this day submitted
to the City of Anaheim by the Orange County Flood Control Dis-
trict and which is hereto attached; and said agreement is here-
by approved, and the Mayor and the City Clerk be, and they are,
hereby authorized to execute said agreement for and on behalf
of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 24th day of January, 1961.
