1961-6596RESOLUTION NO. 6596 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL PURPOSES. Accounting Officer R/W WHEREAS, JOSEPHINE OCHOA, as her sole and separate property, is the owner of the hereinafter described real property situated in the City of Anaheim, County of Orange, State of California; and WHEREAS, said owner has offered to sell said property to the City of Anaheim for the sum of Eleven Thousand Five Hundred and no /100 Dollars ($11,500.00) cash, lawful money of the United States; and WHEREAS, the City Council does find and determine that public convenience and necessity require the purchase and acquisition of said parcel of real property for municipal purposes, and that the price which the owner thereof is willing to accept is reasonable and not out of proportion to the fair market value of said property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of Josephine Ochoa, as her sole and separate property, to sell said property, situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of Lot A of Tract No. 97, in the City of Anaheim, as shown on a map thereof recorded in Book 11, Page 39, of Miscellaneous Maps, Records of Orange County, California, described as follows: Beginning at a point on the West line 475 feet South of the Northwest corner of said Lot A; thence East 67 feet parallel with the North line of said lot; thence North 40 feet parallel with the West line of said lot; thence West parallel with the North line of said lot to Parry Avenue; thence South along Parry Avenue to the point of beginning; for the sum of Eleven Thousand Five Hundred and no /100 Dollars ($11,500.00) cash, lawful money of the United States, be, and the same is hereby, accepted subject to the following terms and conditions: 1. Said property shall be conveyed to the City of Anaheim free and clear of all encumbrances except the second half of all general and special taxes for the fiscal year 1960 -61, including special district levies, payment of which is in- cluded therein and collected therewith; and all covenants, conditions, restrictions, re- servations, rights, rights of way and ease- ments of record approved by the City Attorney. 2. Seller shall have the right to remove the wall -to -wall carpeting and -the aluminum awnings from the building now located on ,subject property. 3. That the Seller shall pay that portion of the second half of the taxes for the fiscal year 1960 -61 on subject property, from January 1, 1961, to date the deed to the City of Anaheim is recorded. BE IT FURTHER RESOLVED that the City Manager and the City Attorney of the City of Anaheim be, and either of them is hereby, authorized for and on behalf of the City of Anaheim to sign escrow instructions for the purchase of said property at Grover Escrow Corporation, 1741 South Euclid Avenue, Anaheim, California. AND BE IT FURTHER RESOLVED that the City Auditor be, and he is hereby, authorized to deposit in escrow at said Grover Escrow Corporation, 1741 South Euclid Avenue, Anaheim, California, Eleven Thousand Five Hundred and no /100•Dollars ($11,500.00) cash, lawful money of the United States, to be paid to the owner of said real property when a deed conveying said property to the City of Anaheim free and clear of all encumbrances, except as hereinabove set forth, can be recorded and a policy of title insurance issued by a reputable title company, showing said property vested in the City Of Anaheim as hereinabove specified. AND BE IT FURTHER RESOLVED that the seller shall pay the usual and customary seller's charges for furnishing a policy of title insurance necessary to show title vested in the City of Anaheim, as herein provided, and that the City of Anaheim shall pay the usual buyer's charges in the purchase of said property.
