1961-6591WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ing F 60 =61 to consider an amendment to Title
18 of the Anaheim Municipal Code relating.to zoning and to con-
sider a change in the boundaries of the zone or zones hereinafter
mentioned and described, and at said hearing did receive evidence
and reports from persons interested therein and from its staff;
and
WHEREAS, within a period of forty days following said
hearing thereon, the Planning Commission did duly adopt a resolu-
tion containing a report of its findings, a summary of the evi-
dence presented at said hearing and a recommendation that the
proposed amendment be adopted by the City Council and that cer-
tain zone or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City Plan-
ning Commission, the City Council did fix-the:.,. 3rd day of
January 19 6 as the time, and the City Council Chambers
in the City Hall in the City of Anaheim as the lace for a public
hearing upon said proposed amendment to Title 18 of the Anaheim
Municipal Code, and the exclusion of said property, hereinafter
described, from the zone in which it is now situated and the in-
corporation thereof in the zones hereinafter set forth; and did
give notice thereof in the manner and form as provided in said
Title 18 of said Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard and did receive evidence and reports and did thereupon con
sider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings, and recom-
mendation; and

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM FINDING AND DETERMINING
THAT TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING SHOULD BE AMENDED
AND THAT THE BOUNDARIES OF CERTAIN ZONES
SHOULD BE CHANGED.
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated,
and incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby amended, and that the following
described property:

All that certain land situated in the State of California,
County of Orange, described as follows:
Those portions of the South half of the Southwest quarter
of the Northwest quarter of Section Twenty seven, Township
Four South, Range Ten West, in the Rancho Las Bolsas and
Rancho San Juan Cajon de Santa Ana, as shown on a Map re-
corded in Book 51, page 10 of Miscellaneous Maps, records
of Orange County, California, described as follows:
PARCEL 1. Commencing at the Northwest corner of said
South half of the Southwest quarter of the Northwest
quarter of said Section Twenty- seven; thence Easterly
along the North line of said South half, a distance of
27 rods 12Z feet; thence at right angles Southerly,
parallel with the West line of said South half, to a
point in the South line of said South half; thence
Westerly along said South line of said South half to
the Southwest corner of said South half thence Northerly
along the West line of said South half to the point of
beginning.
PARCEL 2. Commencing at a point in the North line of the
South half of the Southwest quarter of the Northwest quarter
of Section Twenty- seven, which point is 27 rods 12i feet
East of the Northwest corner of said South half; thence at
right angles Southerly and parallel with the West line of
said South half to a point in the South line of said South
half; thence Easterly along the South line of said South
half, 26 rods, 4 feet; thence Northerly, parallel with the
West line of said South half, to a point in the North line
of said South half; thence West along the North line of
said South half to the point of beginning.
PARCEL 3. Beginning at a point in the North line of the
South of the Southwest quarter of the Northwest quarter
of said Section Twenty seven, which point is 54 rods distant
Easterly from the Northwesterly corner of said South half;
thence at right angles Southerly, parallel with the West
line of said South half, to a point in the South line of
said South half; thence Easterly along said South line to
the Southeast corner of said South half; thence North
along said East line of said South half to the Northeast
corner of said South half; thence West along the North
line of said South half to the point of beginning.
All of the above described land was formerly registered
under the Land Title Law;
be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and
incorporated in the R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE upon
the conditions hereinafter set forth:

1. That a subdivision map of subject property be
recorded in the Office of the County Recorder
of Orange County, California, or
(a) That the owners of subject property deed
to the City of Anaheim a strip of land
45 feet in width, from the center line
of the street, along Orangewood Avenue,
and a strip of land 57 feet in width,
from the center line of the street,
along West Street for street widening
purposes.
(b) That sidewalks be installed along Orange-
wood Avenue as required by the City
Engineer and in accordance with standard
plans and specifications on file in the
Office of the City Engineer.
(c- 1)That all engineering requirements of the
City of Anaheim along West Street, such
as curbs and gutters, sidewalks, street
grading and paving, drainage facilities,
or other appurtenant work be complied
with as required by the City Engineer
and in accordance with standard plans
and specifications on file in the Office
of the City Engineer; and (c -2) that a
bond in an amount and form satisfactory
to the City of Anaheim be posted with the
City to guarantee the installation of
said engineering requirements and said
sidewalks along Orangewood Avenue re-
ferred to in Condition No. (b) hereof.
(d) That the owners of subject property pay
to the City of Anaheim the sum of $2.00
per front foot along Orangewood Avenue
and West Street for street lighting
purposes.
2. That the owners of subject property place of record
standard City of Anaheim R -3 Deed Restrictions
approved by the City Attorney.
3. That subject property be developed substantially in
accordance with the specifications set forth on
Pages 8 to 12, both inclusive, of the brochure
presented to the City Council by Tietz Construction
Company marked `Exhibit A and on file with the
City of Anaheim.
4. That detailed building plans be presented to and
approved by the City Council prior to the final
reading of the ordinance rezoning subject property.

5. That the owners of subject roperty pay to the
City of Anaheim the sum of p 25.00 per dwelling
unit, to be used for park and recreation pur-
poses, said sum to be paid at the time the
building permit is issued.
6. (a) That a 6 -foot masonry wall be constructed
along the north and east property lines, and
along the south and west sides of subject pro-
perty 5 feet from the property line, except at
the two points of access provided by the
street and alley to Orangewood Avenue and the
single point of access provided by the street
to West Street in accordance with the plan of
development presented in connection herewith
and designated "Tentative Tract No. 4001,"
received and accepted by the City Planning
Commission on December 5, 1960 and on file
with the City of Anaheim; and (b) that a bond
in an amount and form satisfactory to the City
of Anaheim be posted with the City to guarantee
the construction of said 6 -foot walls.
7. That Condition No. 1, or Condition (a), (b)
(c -2) and (d), and Conditions Nos. 3 and 6(b$
above mentioned be complied with within a
period of 180 days from date hereof or such
further time as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be,
and he is hereby authorized and directed to prepare and
submit to the City Council an ordinance amending Title 18
of the Anaheim Municipal Code to accomplish the objects
herein found and determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by
me this 17th day of January, 1961.
