1960-6547RESOLUTION NO. 6547 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA- HEIM ACCEPT as`, EALED PROPOSAL AND AWARDING A CON- TRACT TO TH ST RESPONSIBLE BIDDER FOR THE FURNISHING OF ALL PLANT LABOR, SERVICES, MATERIALS AND EQUIPMENT AND ALL UTILITIES AND TRANSPORTATION, INCLUDING POWER, FUEL AND WATER, AND PERFORMING ALL WORK NECESSARY TO CONSTRUCT AND COMPLETE THE FOLLOW- ING PUBLIC IMPROVEMENT, THE OLIVE STREET SEWER T FROM LA PALMA WHEREAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circulation, printed,,pubgAlpck and circulated in the City of Anaheim, to wits The Anaheim $ulletin on the �thda of December 1'60 a notice inv ling sealed proposals for furn sh'ng e o p ng. All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Engineer or City Clerk of the City of Anaheim, the following public improvement, to wit: The Olive Street Sewer Improvement, consisting of the construction of 8 -inch V.C.P. sewer laterals in Olive Street, from La Palma Avenue to Com- mercial Street, in the City of Anaheim, including exca- vation, flooding and backfill, construction of manholes, and appurtenant work as more particularly set forth in the plans and specifications on file in the Office of the City Clerk or City Engineer, Job No. 1199; in accordance with the design, pianal. profiles and specifications of said public improvement on file in the office of the City Clerk of the City of Anaheim; and WHEREAS., said notice inviting sealed proposals for said public improvement did provide that sealed proposals would be received by the City of Anaheim at the office of the City Clerk of the City of Anaheim up to the hour of 2:00 o °clock P.M. on the 15th day of December 9 19 60 for the furnishing of all plant, labor, services, materials and equipment, all utilities and transportation, including power, f p el and water, and performing all work necessary to construct and complete in a good and workmanlike manner, the public improvement hereinabove more particularly mentioned and described, and which notice did state and declare that pursuant to the. provisions of Section 1770 of the Labor Code, the City Council of the City of Anaheim had ascertained the prevailing rate of wages in the locality in which this type of labor is to be performed for each craft or type of workman or mechanic needed to execute the contract and did set forth the prevailing hourly wage scale so ascertained; and WHEREAS, the City Clerk of the City of Anaheim did receive the following sealed proposals rior to 2 :00 oaclock P.M. on the 15th day of December 19 60 D in response to the notice afores inviting sealed proposals, to wits:: NAME TOTAL PRICE BARKLEY PIPELINE CONSTRUCTION, INC. ORANGE COUNTY CONST. CO. DE LEON CONSTRUCTION CO. WEST COAST SEWER COMPANY 15,610.68 21,414.80 2 +,5 02 .53 25,518.50 AND WHEREAS, the City Engineer did thereupon examine and tabulate said sealed proposals and did report to the City Council the result of his examination and tabulation; and WHEREAS, the City Council finds that the sealed proposal submitted by BARKLEY PIPELINE CONSTRUCTION, INC. is the lowest pro- posal submitted and that the bid of ORANGE COUNTY CONST. CO., 1506 North Clinton, Santa Ana, California, is the next lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, and all utilities and transportation, in- cluding power, fuel and water and performing all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim, the public improvement hereinabove mentioned and described, together with the appurtenances thereto, and as specified in the notice in- viting sealed proposals, but that a clerical error was made by Barkley Pipeline Construction, Inc. in the computation of its bid, and that said corporation has requested leave to withdraw said bid because of said error and the fact that it would suffer a loss if compelled to accept and complete the contract for said improvement; and WHEREAS, the City Engineer has examined the computations of said Barkley Pipeline Construction, Inc. and has reported to the City Council that the error made by said corporation in the computa- tion of its bid was, in truth and in fact, a clerical error and not an error in judgment and has recommended that said corporation be relieved by being allowed to withdraw its bid; and WHEREAS, the City Council finds that the sealed proposal of ORANGE COUNTY CONST. CO. is the second lowest responsible proposal received, that the person submitting said proposal is a responsible person, and that the proposal submitted by him is the best suited and fitted for the public improvement to be constructed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that the sealed proposal submitted by ORANGE COUNTY CONST. CO., 1506 North Clinton, Santa Ana, California, for the fur- nishing of all plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifica- tions, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim and the notice inviting sealed propo- sals, the public works and improvement hereinabove more particularly mentioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, and that a contract for the con. struction and completion of said public improvement be, and the same is hereby, awarded to the said above named bidder. AND BE IT FURTHER RESOLVED that the successful bidder or bidders upon each contract awarded as hereinabove set forth, shall be, and they are hereby required to execute a contract in the re- quired form with the City of Anaheim upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the plans and specifications for said public improvement here- inabove described, and in accord- -2- ante with the terms, conditions and provisions of this resolution,. and that said successful bidder or bidders to whom each contract is awarded shall be required to furnish a surety bond in an amount equal to one hundred per cent (100 of the contract price.for:all labor, materials and equipment t_o_be furnished and performed, as set forth in the sealed proposal submitted by said bidder for the constructim of said public improvement, together with the appurtenances thereto. or such portion thereof as is covered by said contract,. as security. for the faithful performance of said contract and a separate surety bond in an amount equal to one hundred per cent (100 of the con- struction cost of said public improvement covered by said 'contract,. as Security for the payment of all persons performing labor.and fur nishing material for said project. AND BE IT FURTHER' RESOLVED that said successful bidder or bidders be, and they are hereby required to furnish to the City of Anaheim in companies satisfactory to the City of Anaheim,7.public. ii..a- bility, property damage, compensation, and other insurance in the amounts and for the purposes as set forth and specified in the notice inviting sealed proposals, and subject to the approval.of the City Attorney as to form and sufficiency. AND BE IT FURTHER RESOLVED that the Mayor and the. City Clerk of the City. of Anaheim.be, and they are here.by, authorized and directed to make,. execute and. enter into, for and on behalf of the_. City..of._..Anaheim, a..written.. contract with _,said successful bidder _.o.r bidders for .the .furnishing of all plant, labor, materials, and equip- ment and performing all work, as hereinabove more particularly des- cribed, for the construction, installation and completion of said public improvement hereinabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general specifications and..de tailed specifications and drawings, and all addenda thereto, and:all modifications incorporated therein prior to the date of the. opening of bids, on file in the office of the City Clerk of the ,City ::of _Ana- heim and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all ofthe. contract ments herein specified° THE FOREGOING RESOLUTION is signed and approved by.me.this. 20th day of December 19 60.
