1961-6850RESOLUTION NO. 6850 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A GRANT FROM PACIFIC ELECTRIC RAILWAY CDMPANY OF THE RIGHT TO CON- STRUCT, RECONSTRUCT, MAINTAIN AND OPERATE A REINFORCED CONCRETE DRAIN PIPE UPON AND ACROSS PROPERTY OF THE GRANTOR; AND AUTHORIZING THE EXECUTION OF AN INDENTURE COVERING THE CON- STRUCTION, MAINTENANCE AND OPERATION OF SAID DRAIN PIPE. WHEREAS, the Pacific Electric Railway Company, a Cal- ifornia corporation, has tendered to the City of Anaheim an indenture granting to the City of Anaheim, subject to the re- servations, covenants and conditions therein contained, the right to construct, reconstruct, maintain and operate a 69 -inch reinforced concrete drain pipe upon and across that certain real property situate in the County of Orange, State of California, and more particularly described as follows: A strip of land, 15.00 feet in width, situate partly in the City of Anaheim and partly in the City of Buena Park, County of Orange, State of California, in the Southeast 1/4 of Section 15, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as described in Book 1, Page 486 of Patents, in the Office of the Recorder of Los Angeles County, being all those portions of that certain 100 -foot strip of land, described in deeds to the Los Angeles Inter -Urban Railway Company, recorded in Book 122, Page 278 of Deeds, in Book 122, Page 164 of Deeds, in Book 122, Page 166 of Deeds and in Book 122, Page 170 of Deeds, all in the Office of the Recorder of Orange County, lying 7.50 feet on each side of the following described center line: Beginning at the intersection of the South line of said Section 15, with a line parallel with and distant 7.50 feet southwesterly, measured at right angeles from the southeasterly prolongation of the northeasterly boundary of said 100 -foot strip; thence North 53° 39 54" West along said parallel line 1672.71 feet to the southeasterly boundary of that certain strip of land, 80 feet in width, described in the Indenture to the Orange County Flood Control District, recorded in Book )0)1 Page 172 of Official Records, in the Office of the Recorder of Orange County. The side lines of said 15.00 foot strip of land are to terminate northwesterly in said southeasterly boundary and southeasterly in the southerly boundary of said 100 -foot strip recorded in Book 122, Page 278 of Deeds. Sub'ect to easements, restrictions, reservations, cond ions and covenants of record. -1- AND WHEREAS, said grantor has tendered to the City of Anaheim the indenture above mentioned dated April 21, 1961, to be executed by said Pacific Electric Railway Company and the City of Anaheim, which indenture the City Council finds would be for the benefit and best interest of the City of Anaheim and should be accepted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the indenture tendered to the City of Anaheim by Pacific Electric Railway Company, a California corporation, dated April 21, 1961, granting to the City, but subject to the reservations, covenants and conditions therein contained, the right to construct, reconstruct, maintain and operate a 69 -inch reinforced concrete drain pipe upon and across the real property hereinabove mentioned and described, be, and the same is hereby, approved and accepted. BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to execute said indenture for and on behalf of the City of Anaheim as of the 21st day of April, 1961.
