A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE PURCHASE
AND ACQUJISITION OF CERTAIN REAL PROPERTY
FOR MUNICIPAL PURPOSES.
WHEREAS, public convenience and necessity require
the purchase and acquisition of the real property hereinafter
described for municipal purposes; and
WHEREAS, said real property is owned by the Estate
of Carmen Morales Gonzales, deceased; and
WHEREAS, Rafaela H. Morales, Administratrix of the
Estate of Carmen Morales Gonzales, deceased, has offered to
sell said property to the City of Anaheim for the sum of
$3,350.00 cash, lawful money of the United States; and
WHEREAS, the City Council finds that the price which
the Estate is willing to accept for said property is reasonable
and not out of proportion to the fair market value of said
property;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the offer of Rafaela H. Morales,
Administratrix of the Estate of Carmen Morales Gonzales,
deceased, to sell to the City of Anaheim all that real proper-
ty situated in the City of Anaheim, County of Orange, State
of California, described as follows, to wit:
Those portions of Lot A in Tract 97 of Sinclair Ranch
as per map thereof recorded in Book 11, Page 39 of
Miscellaneous Maps, records of said County, described
as follows:
Beginning at a point on the West line 395 feet South
of the Northwest corner of said Lot A; thence East on
line parallel with North line of said Lot 135.46 feet
to the true point of beginning; thence North parallel
with East line of said Lot, 40 feet to a point; thence
West along a line parallel with the North line of
said Lot 35.42 feet; thence South parallel to the East
line of said Lot 40 feet; thence East parallel to the
North line of said Lot 35.42 feet more or less, to the
true point of beginning, and being described as East
35.4 feet of Lot 14 of Hart's Subdivision according
to map recorded in Book 7, Page 20 of Miscellaneous
Maps, records of Orange County, California.
Beginning at a point on the West line 515 feet South
of the Northwest corner of said Lot A; thence East
parallel with the North line of said Lot 135.52 feet
thence North 10 feet parallel with the West line of
said Lot; thence West parallel with the North line
of said Lot to Parry Avenue; thence South along Parry
Avenue to a point of beginning;
for the sum of $3,350.00 cash, lawful money of the United
States be, and the same is hereby, accepted subject to the
following terms and conditions:
BE IT FURTHER RESOLVED that the City Manager and
the City Attorney of the City of Anaheim be, and either of
them is hereby, authorized for and on behalf of the City of
Anaheim to sign escrow instructions for the purchase of said
real property and to enter into an escrow with the owner of
said property at United California Bank, Anaheim Office,
Anaheim, California.
AND BE IT FURTHER RESOLVED that the City Auditor be,
and he is hereby authorized to deposit in escrow at said United
California Bank $3,350.00 cash, lawful money of the United
States, to be paid to the owner of said real property when
a deed conveying said property to the City of Anaheim free and
clear of all encumbrances, except as hereinabove set forth,
can be recorded and a policy of title insurance issued by
Title Insurance and Trust Company, 800 North Main, Santa Ana,
California, showing said property vested in the City of Anaheim
as hereinabove specified.
AND BE IT FURTHER RESOLVED that the Seller shall pay
the usual and customary Seller's charges for furnishing a
policy of title insurance necessary to show title vested in
the City of Anaheim, as herein provided, and that the City
of Anaheim shall pay the usual Buyer's charges in the pur-
chase of said property.
THE FOREGOING RESOLUTION is approved and signed by
me this 2nd day of May, 1961.
That said property shall be conveyed to
the City of Anaheim free and clear of all
encumbrances except all general and special
taxes for the fiscal year.1961 -62; a lien
not yet payable, including any special dis-
trict levies, payment of which is included
therein and collected therewith; all taxes
and assessments levied or assessed subsequent
to the date the escrow, hereinafter referred to,
is entered into between Buyer and Seller; and
all covenants, conditions, restrictions, re-
servations, rights, rights of way and easements
of record approved by the City Attorney.
