AVE. annexation of said territory to the City of Anaheim and did there- upon approve the circulation of said petition; and WHEREAS, on the 25thday of April 19 the City Council did receive a petition signed by not less than one-fourth of the qualified electors residing within the territory hereinafter described, as shown by the County Registration of Voters, containing a description of the new territory proposed to be annexed to the City of Anaheim and asking that said territory be annexed to the City; and the City Council does find and de- termine that said proponents have done and performed the acts and things required to be done and performed by the Annexation Act of 1913, at the time and in the manner as required by the pro- visions of said Act; and that said petition was circulated more than twenty-one (21) days after the publication of notice of in- tention to circulate such petition and that it is signed by not less than one-fourth of the qualified electors residing within the territory proposed to be annexed, as shown by the County Registration of Voters and as appears from the certificate of the City Clerk of the City of Anaheim presented to the City Council at the time of consideration of said petition and prior to the adoption of this resolution; and does further find that more than twelve (12) qualified electors resided within the boundaries of the territory proposed to be annexed at the time of the filing of said petition for said annexation; and does further find, from evidence and reports received and from said petition, that at the time of the filing and presentation of said petition, that said new territory proposed to be annexed to said City of Anaheim did not form a part of any other city or municipal corporation, and that said territory was, at the time of filing said petition inhabited territory and is contiguous to the City of Anaheim; and WHEREAS, the City Council does further find that it would be to the advantage and for the best interests of the City of Anaheim, and the residents thereof, and the qualified electors residing within the territory proposed to be annexed, as herein- after more particularly described, to submit the question of the annexation of said territory to the City of Anaheim to the elect- ors residing within said territory; and WHEREAS, The City Council does further find that said territory should be designated by some appropriate name by which it may be referred to upon the ballots used at the election at which the question of annexation of said territory to the City of Anaheim shall be submitted to the electors residing within said territory and that an appropriate designation for such territory is WAGNER SUNKIST ANNEXATION; and WHEREAS, The City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed and sought to be annexed to the City of Anaheim as as follows, to -wit: Said territory is situated in the County of Orange, State of California, and the specific boundaries thereof are as follows WAGNER SUNK i ST ANNEXA i ON -3- Ordinance No. 1018, September 27, 1955, and filed with the Secretary of State October 28, 1955, said point of beginning being 30.00 feet East of the West line and 30.00 feet Southerly of the North line of the Northwest quarter of said Section 24, Town- ship 4 South, Range 10 West, San Bernardino Base and Meridian; thence, 1. Along the existing City of Anaheim City limit lines and along a line parallel with and 30 feet Southerly of the North line of the Northwest quarter of said Section 24, and along a He 30 feet Southerly of the North line of the Northeast quarter of said Section 23, Township 4 South, Range 10 Wes`,:, San Bernardino Base and Meridian, South 89 56° West a distance of 680 feet more or less to the intersection of the existing City of Anaheim City 1 imi t i i S e, being the Southeast corner of the East Street Annexation to the City of Anaheim as established by Ordi c nonce No. 954, December 28, 1954, and filed with the Secretary of State January 31, 1955; thence, 2. Along the existing City of Anaheim City limit line North 15°23 West a dis- tance of 2,058 feet more or less to the i,terse of the existing City of Anaheim City limit line as established by the Ball Road A: exa i to the City of Anaheim, passed by Ordinance No. 814, August 19, 1952, and filed with the Secretary of State September 22, 1952; thence, 3. Along the existing City of Anaheim City limit line North 74 34° East a dis- tance of 1,287 feet more or less to the intersection of a line parallel with and 30.00 feet Easterly of the West line of the Southwest quarter of Section 13, Town- ship 4 South, Range 10 West, San Bernardino Base and Meridian; thence, 4. Along the existing City of Anaheim City limit line and the last mentioned parallel line North 00 East a distance of 1,100 feet, more or less, to the southwest corner of the Placentia Avenue No. 2 Annexation to the City of Anaheim, as established by Ordinance No. 936, October 13, 1954, and filed with the Secretary of State, November 15, 1954; thence, A parcel of land, located in the County of Orange, State of California, being portions of Sections 12, 13, 14, 23 and 24 of Township 4 South, Range 10 West, San Bernardino Base and Meridian and Sections 7 and 18 of nship 4 South, Range 9 West, San Bernardino Base and Meridian described as follows: Beginning at a point in the existing City it line of the City of Anaheim, as established by the Placentia Ball Annexation to the City of Anaheim, passed by 2/15/61 -4- 2/15/61 5. Along the existing City of Anaheim CI; limit line and the last mentioned parallel line North 00 East a distance of 630 feet, more or less, to the inter- section of the existing City of Anaheim City limit line, said intersection being the southwest corner of the Placentia South Annexation to the City of Anaheim, as established by Ordinance No. 1000, July 12, 1955, and filed with the Secretary of State, August 12, 1955; thence, 9. Along the existing City limit line of the City of Anaheim, South 89 °54' East a distance of 2,020 feet, more or less; thence, 10. Along the existing City of Anaheim City limit line North 00 °11' East a distance of 690 feet, more or less, to the intersection with the northerly line of the south half of the southeast quarter of the southwest quarter of Section 12, Township 4 South, Range 10 West, San Bernardino Base and Meridian; thence, 11. Along the existing City of Anaheim City limit lime and the north line of the south half of the southeast quarter of the southwest quarter of said Section 12„ South 89 58' West a distance of 70 feet, more or less, to the easterly line of the northwest quarter of the southeast quarter of the southwest quarter of said Section 12; thence, 12. Along the existing City of Anaheim City limit line North 00 East a distance of 660 feet, more or less, to the intersection with the northerly line of the south half of the southwest quarter of said Section 12; thence, -5- 2/15/61 13. Along the existing City of Anaheim City limit line North 89045' West a dis- tance of 660 feet, more or less, to the intersection with the east line of the north- west quarter of the southwest quarter of said Section 12, said point of intersection being the southeast corner of the Wagner Annexation to the City of Anaheim, passed by Ordinance No. 1079, July 10, 1956, and filed with the Secretary of State, August 10, 1956; thence, 14. Along the existing City of Anaheim City limit lire North 00 East a dis- tance of 1,220 feet, more or less, to the intersection with the existing City of Anaheim City limit line, as established by the North Sunkist Annexation, passed by Ordinance No. 1002, July 26, 1955, and filed with the Secretary of State, September 2, 1955; thence, 15. Along the existing City of Anaheim City limit line South 78 55' East a distance of 1,370 feet, more or less, to the southeast corner of the aforementioned North Sunkist Annexation, said southeast corner being in the northerly right of way line of Anaheim -Olive Road, 60 feet wide, and the easterly right of way line of Sunkist Street, 50 feet wide; thence, 16. Continuing along the northerly right of way line of Anaheim -Olive Road, 60 feet wide, South 78 °55° East a distance of 3,400 feet, more or less, to the point of intersection with a line bearing North 11 05' East, said line being a distance of 680.79 feet South 78 °55° East,(measured along the center line of said Anaheim Olive Road) from the west line of Section 7, Township 4 South, Range 9 West, San Bernardino Base and Meridian, as said line bearing North 11 05' East was established in the deed to the State of California recorded November 11, 1948, as Document No. 46076 in Book 1725, Page 422, of Official Records of Orange County, California; thence, 17. North 11 East, 39.80 feet, more or less, to the point of intersection with a line parallel with and 69.80 feet, northerly of the center line of said Anaheim -Olive Road; thence, 18. South 78 °55' East, 650 feet, more or less, and thence South 75000' East, 1,350 feet, more or less, along the' northerly right of way line of said Anaheim- Olive Road, to the point of intersection with the easterly line of the Rancho San Juan Cajon de Santa Ana Rancho line, as said Rancho line was recorded, July 9, 1877, in Book 2, Page 256 of Patents, Records of Los Angeles County, California; thence, 19. South 35 °48' West along the Sam Juan Cajon de Santa Ana Rancho line, a distance of 950 feet, more or less; thence, -6— 2/15/61 20. South 21 °10' West along the San Juan Cajon de Santa Ana Rancho line, a dis- tance of 300 feet, more or less, to the intersection with the south line of the south- west quarter of Section 7, Township 4 South, Range 9 West, San Bernardino Base and Meridian; thence, 21. North 89 54' West along the south line of the southwest quarter of said Section 7, a distance of 1,130 feet, more or less, to the northwest corner of that parcel of land conveyed to Henry Wagner by Document No. 46178, March 2, 1906, recorded in Book 124, Page 381, Records of Orange County, California, said northwest corner being distant 792 feet, easterly of the southwest crner of the southwest quarter of said Section 7; thence, 22. South 11 19' West along the west line of said Henry Wagner property a dis- tance of 693 feet; thence, 23. Continuing along the said west line of Henry Wagner property South 00 °47' West, 660 feet, more or less, to the point of intersection with the south line of the southwest quarter of the northwest quarter of the northwest quarter of Section 18, Township 4 South, Range 9 West, San Bernardino Base and Meridian; thence, 24. North 89 °19' West along the south line of the southwest quarter of the northwest quarter of the northwest quarter of Section 18, Township 4 South, Range 9 West, San Bernardino Base and Meridian, a distance of 630 feet, more or less, to the intersection with a line parallel with and 30.00 feet easterly of the westerly line of the northwest quarter of Section 18, Township 4 South, Range 9 West, San Bernardino Base and Meridian; thence, 25. North 89 56° West along a line parallel with and 30.00 feet southerly of the north line of the northeast quarter of said Section 24, being the southerly right of way line of Ball Road (60 feet wide) a distance of 686 feet, more or less, to the point of intersection with a line parallel with and 26.35 feet west of the east line of the west half of the west half of the northeast quarter of said Section 24; thence, 29. North 00 °04' East along a line parallel with and 26.35 feet Westerly of the East line of the West half of the West half of the Northeast quarter of said Section 24, and along a line parallel with and 26.35 feet Westerly of the East line of the West half of the West half of the Southeast quarter of Section 13, Township 4 South, Range 10 West, San Bernardino Base and Meridian, a distance of 1,350 feet, more or less, to the point of intersection with the South line of the Northwest quarter of the Southeast quarter of said Section 13; thence, 30. North 89 54' West along the South line of the Northwest quarter of the Southeast quarter of said Section 13, and its Westerly prolongation, a distance of 653 feet,more or less, to the point of intersection with a line parallel with and 20.00 feet Westerly of the East line of the Southwest quarter of said Section 13, said intersection also being in the existing City of Anaheim City limit line as established by the Southeast Annexation No. 2, passed by Ordinance No. 1402, October 13, 1959, and filed with the Secretary of State, November 13, 1959; thence, 31. Along the existing City of Anaheim City limit line and along a line parallel with and 20.00 feet Westerly of the East line of the Southwest quarter of said Section 13, North 00 °17' East a distance of 1,300 feet more or less to the Northeast corner of the aforementioned Southeast Annexation No. 2, said Northeast corner being a point in a line parallel with and 20.00 feet Southerly of the North line of the Southwest quarter of said Section 13; thence, 32. Along the existing City limit line of the City of Anaheim, and the last mentioned parallel line, North 89 °54 West a distance of 1960 feet, more or less, to the -hire: as l r-r+er of the Northwest quarter of the Northwest quarter of the -7- 2/15/61 Southwest quarter of said Section 13; thence, 33. Along the existing City of Anaheim City limit line South 00 West a distance of 640 feet, more or less, to the Southeast corner of the Northwest quarter of the Northwest quarter of the Southwest quarter of said Section 13; thence, 34. Along the existing City of Anaheim City limit line and the South line of the Northwest quarter of the Northwest quarter of the Southwest quarter of said Section 13, North 89 °59' West a distance of 630 feet more or less to a point in a line parallel with and 30.00 feet Easterly of the West line of the Southwest quarter of said Section 13; thence, 35. Along the existing City of Anaheim City limit line also being a line parallel with and 30.00 feet Easterly of the West line of the Southwest quarter of said Section 13, and its Southerly prolongation South 00 West a distance of 2,010 feet, more or less, to the point of beginning. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare its .intention to call a special election for the purpose of submitting to the electors residing in the hereinabove described new territory, the question whether said new territory shall be annexed to, incorporated in, and made a part of the City of Anaheim and the property therein be, after such annexation, subject to taxation equally with the property within said City of Anaheim, to pay its pro rata share, based upon assessed valuation, of all of the bonded indebtedness of said City of Anaheim outstanding or authorized as of the date of the first publication of the notice of special election, or theretofore authorized; and BE IT FURTHER RESOLVED that the territory so proposed to be annexed shall be designated as "WAGNER SUNKIST ANNEXATION" and BE IT FURTHER RESOLVED that th.e 1St day of May 1961 at the hour of 7 :00 o'clock F.M. in the City Council Chamber of the City Hall in the City of Anaheim be, and the same is hereby,: fixed as the day, hour and place when and where any person owning real property within the territory so proposed to he annexed and having any objections to the proposed annexation, may appear before the City Council of the City of Anaheim and show cause why such territory should not be so annexed; that all persons having any objections to such proposed annexation are hereby notified to appear on said day, at said hour and place, to show cause, if any they have, why such territory should not be so annexed, and all such persons are further notified that any protests against the calling of an election to submit to the electors residing within said territory the question of annexation of said territory to the City of Anaheim, or any protests against the annexation of said territory to the City of Anaheim Faust be in writing and may be filed with the City Clerk of the City of Anaheim at any time not later than the hour and date set forth herein for the hearing of objections to said election. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to cause a copy of this resolution to be published at least once a week for two weeks prior to the date hereinabove fixed for the hearing of protests and objections to said .election and the annexation of said territory to the City of Anaheim, in the Anaheim Bulletin a newspaper of general circulation, published and circulated in the City of Anaheim, County of Orange, State of California.
